Each site requires varying monitoring and reporting requirements as outlined below, and therefore, will require review of SMPs, Periodic Review/Annual Reports, and other documents on record and filed with New York State Department of Environmental Conversation (NYSDEC) as part of the work performed under this proposal. Most SMPs, PRRs and other files relevant to these sites are available at the DEC Info Locator website or can be electronically requested by the consultant from the City. The Unity Island Landfill Closure Plan and 2022 Annual Monitoring Report, and 1318 Niagara Street 2023 PRR are included under the Bid Posting – Related Documents. I. Project Purpose & Scope of Work
The City of Buffalo is currently responsible for monitoring and reporting requirements for Bern Metal,
Unity Island Landfill, Kingsley Park, Franczyck Park and 1318 Niagara Street as part of their respective Site
Management Plans (SMPs) for remediation work. Each site requires varying monitoring and reporting
requirements as outlined below, and therefore, will require review of SMPs, Periodic Review/Annual
Reports, and other documents on record and filed with New York State Department of Environmental
Conversation (NYSDEC) as part of the work performed under this proposal. Most SMPs, PRRs and other
files relevant to these sites are available at the DECInfo Locator website or can be electronically requested
by the consultant from the City. The Unity Island Landfill Closure Plan and 2022 Annual Monitoring Report,
and 1318 Niagara Street 2023 PRR are included under the Bid Posting Related Documents. Any additional
records that are not available online or in the Bid Posting deemed necessary for review prior to submission
of a proposal can be requested and sent via email (pending attachment file size limits, please indicate
maximum file size limits in request) or can be uploaded to an FTP site hosted by the consultant.
For each site, existing work plans will need to be reviewed (and updated when applicable) to ensure the
summary of the site background, previous assessment activities, and the present status of the site are
accurate. Monitoring and maintenance activities scheduled for the site, the purpose, approach and
procedures to be followed during the implementation of those activities will also be delineated and/or
confirmed. Performance of the tasks in the existing or proposed work plans will be undertaken to meet
the requirements of the site Operations, Maintenance & Monitoring (OM & M) requirements of each site.
Existing QA/QC Plans will need to be reviewed for each site (and updated when applicable) in order to
define the Quality Assurance measures necessary to ensure that accurate and precise data are collected
during the sampling activities. The plans must conform to NYSDEC Contract Laboratory Protocols.
In addition, prior to conducting any on-site activities, existing site-specific health and safety plans must be
reviewed (and updated when applicable) for each site to ensure consultant worker safety while
conducting on-site activities. The plans should detail personnel responsibilities, protection equipment,
procedures and protocols, contingency plans, decontamination, training, and medical surveillance
procedures, as well as potential problems or hazards that may be encountered. The plans should be in
conformance with all applicable state and federal worker safety regulations. The health and safety plans
must be completed prior to commencing any on-site activities. All field personnel implementing OMM
activities at the sites must have completed at least 40 hours of hazardous waste operations-related
training, as required by Occupational Safety and Health Administration (OSHA) Regulation 29 Code of
Federal Regulations (CFR) 1910.120.
It is the intent of the City to have one (1) qualified firm provide professional environmental services for
these five (5) sites under an initial one-year contract, with an option to extend up to two additional years.
A. Bern Metal (AKA 22/23 Bender Street) Site No. 915135
This site is located at 22/23 Bender Street and is the site of a former scrap reprocessor. The City is
responsible for ensuring groundwater monitoring is being conducted as part of ongoing OM & M activities
at the site. Groundwater monitoring and reporting is to be completed once every five (5) years (next due
July 2027, so this will not be applicable to this contract term), as well as an annual inspection and Periodic
Review Report (reporting period August 1, 2023 August 1, 2024, PRR due August 31, 2024).

To monitor groundwater quality conditions, four groundwater monitoring wells are used with the
monitoring well network consisting of one upgradient monitoring well (RD-1) and four downgradient wells
(RD-2, RD-3, RD-4 and RD-5). The groundwater monitoring program is to confirm that consolidated
materials beneath the final cover system on the Bern Metal property are not impacting the underlying
groundwater with lead concentrations that exceed the maximum contaminant level (MCL) standard for
lead, as specified in Part 703 of Title 6 of the New York Code of Rules and Regulations (6 NYCRR) for
groundwater Class GA. As previously stated, as the groundwater monitoring event is not required until
July 2027, existing groundwater monitoring wells will only need to be inspected for the term of this
contract as part of the annual inspection and PRR.
B. Unity Island Site No. 915052
Unity Island Landfill (Solid Waste Facility No. 15S27) is located at 13 Black Rock Harbor south of the
International Railroad between the Niagara River and Black Rock Canal. The City is responsible for ongoing
groundwater monitoring which consists of semiannual inspections; semiannual routine groundwater/gas
sampling and analysis; and annual reporting, as required as part of the Unity Island Post Closure Long
Term Monitoring and Maintenance Plan. The landfill was used for the disposal of Construction and
Demolition (C&D) waste, municipal incinerator residue, incinerator bypass and permitted municipal waste
from approximately the mid-1950s to 1979.
The Post-Closure Maintenance and Monitoring Plan (Malcolm Pirnie, 2001) requires that inspections of
the landfill be performed on a quarterly basis with an annual report. The inspection includes a visual site
inspection of the integrity of the landfill, including vegetative cover, drainage ditches, and presence of
erosion and/or settlement. The integrity and functionality of the monitoring wells, gas vents, and related
infrastructure are also addressed during the landfill inspection. The Unity Island monitoring program
includes the collection of groundwater samples from ten monitoring wells and three surface water
samples designated as SW-1 (South Pond), SW-2 (Central Pond) and SW-3 (North Pond). The program also
requires combustible gas monitoring as measured from seven landfill gas monitoring vents on the south
end of the landfill designated GV-1 through GV-7. Inspections and groundwater/gas sampling events are
conducted generally mid-summer and mid-spring, with the annual report submitted in late spring to the
NYSDEC. These events are generally confirmed with the NYSDEC prior to work commencing.
C. Kingsley Park (former Diarsenol Company) Site No. C915124
The Diarsenol Company, Kingsley Park Site is an approximately 2-acre Inactive Hazardous Waste Site
located at 52 Kingsley Street in the City of Buffalo. The Site is situated in an urban residential neighborhood
and is bounded by Kingsley Street on the south and Riley Street on the north. The Site is east of Jefferson
Avenue and west of Roehrer Avenue, with homes located in close proximity to the Park along the south
side of Riley and Kingsley Streets.
The City is responsible for periodic reporting ensuring groundwater monitoring is being conducted as part
of ongoing OM & M activities at the site. The program consists of groundwater monitoring and reporting
every five (5) years (next due December 11, 2026) for all monitoring wells (MW-1 through MW-9), as well
as an annual inspection and certification of site conditions (i.e. well conditions).

D. Franczyck Park Site No. B00174
The Franczyck Park Site is located at 550 and 564 Babcock Street and was first developed by Buffalo
Fertilizing Chemical Works, (L.L. Crocker) as an agricultural fertilizer manufacturing facility and later used
as an automobile junk yard before being sold to the City in 1984. The Site is composed of two adjoining
parcels totaling an approximately 15.49-acre area bounded by Lyman Street to the north, Fleming Street
to the south, New Babcock Street to the east, and Lewis Street to the west. The Site is generally
rectangular in shape and is in an area that is zoned for industrial use. Land use in the vicinity of the Site is
characterized as a mixture of commercial, industrial, and residential. Residential properties are located
on the south side of Fleming Street and on the west side of Lewis Street.
The City is responsible for periodic reporting and groundwater monitoring as part of ongoing OM & M
activities at the site. The program consists of annual groundwater monitoring and reporting (next due
October 15, 2024) for all monitoring wells (MW-03, MW-05, MW-07, and MW0-8), as well as an annual
inspection and certification of site conditions.
E. 1318 Niagara Street Site No. E91523
1318 Niagara Street (Site) is a 0.77-acre property located at west side of the intersection between Niagara
Street and Lafayette Avenue. The primary contaminants of concern at the Site are polychlorinated
biphenyls (PCBs). Beginning in 2019, and concluding in 2020, an interim remedial measure (IRM) was
performed at the Site where PCB-contaminated soil was removed from the top 1, 2, or 4 feet in different
areas of the Site. The objective of this remediation was to place or document, at minimum, two feet of
soil cover with concentrations of PCBs less than the commercial soil cleanup objective of 1 milligram per
kilogram across the Site. This Interim Site Management Plan (ISMP) was developed as part of the
conclusion of the IRM and outlines the engineering and institutional controls for the Site, as well as
required periodic monitoring and maintenance.
The City is responsible for periodic reporting and groundwater monitoring as part of ongoing ISMP
activities at the site. The program consists of annual groundwater monitoring and reporting (next due
January 11, 2025) for all monitoring wells (MW-1 through MW-5), as well as an annual inspection and
certification of site conditions.
F. Additional Sites
Although not part of this scope of services, the City may request additional services from the selected
consultant for additional locations on a case by case basis. Costs estimates for additional services would
be requested separately as necessary.
II. Project Timeline
Completion of monitoring and reporting requirements for the five (5) sites under Tasks A, B, C, D and E
shall be completed in compliance with the reporting submission dates provided by and confirmed with
the NYSDEC. In the event additional time is required to complete the tasks, the Consultant shall confer
with the City and NYSDEC prior to any extensions being approved. Reasons for time extensions must be
provided in writing with any supporting documentation.
