Separate sealed BIDS for the construction of: Wastewater Treatment Facility Phase 1 Upgrade will be received by City of
Nashua Purchasing Department at the office of 229 Main Street, Nashua, NH 03060 until 3:00 pm Local Time on July 21,
2026 and then at said office publicly opened and read aloud.
1. Completion time for the project will be calculated as calendar days from the date specified in the "Notice to Proceed"
as follows:
615 calendar days for substantial completion.
675 calendar days for final completion
Liquidated damages will be in the amount of $1,500, for each calendar day of delay from the date established for
substantial completion, and $1,500 for each calendar day of delay from the date established for final completion.
2. Each General Bid shall be accompanied by a Bid Security in the amount of 5% of the Total Bid Price.
3. The successful Bidder must furnish 100% Performance and Payment Bonds, and will be required to execute the
Contract Agreement within 10 days following notification of the acceptance of his Bid.
4. Any contract or contracts awarded under this Advertisement for Bids are expected to be funded in whole or in part

A loan from the NH CWSRF.
A loan from the NH DWSRF.
A loan from the NH Drinking Water and Groundwater Trust Fund.
A grant from the NH Drinking Water and Groundwater Trust Fund.
A State Aid Grant from the NH Department of Environmental Services (SAG).
A loan or grant from USDA Rural Development.
A Community Development Block Grant (CDBG) from the NH Community Development Finance Authority.

5. The successful Bidder on this work is required to comply with the President's Executive Order No. 11246 entitled
"Equal Employment Opportunity" as amended by Executive Order 11375, and amendments or supplements thereto,
and as supplemented in Department of Labor Regulations (41 CFR Part 60). The requirements for bidders and
contractors under this order are explained in the Information For Bidders.
6. Utilization of Minority and Women's Business Enterprises (MBEs and WBEs). The successful Bidder on this work
must demonstrate compliance with the U.S. Environmental Protection Agency's MBE/WBE rule in order to be
deemed a responsible bidder. The requirements for bidders and contractors covered by this rule are explained in the
Information for Bidders.
7. The successful Bidder on this work is subject to U.S. Department of Labor's Davis Bacon wage provisions.
8. The successful bidder on this work is subject to the "American Iron and Steel (AIS)" requirements of the CWSRF and
DWSRF programs.
9. No Bidder may withdraw a Bid within 90 days after the actual date of opening thereof.
10. A mandatory pre-bid conference will be held on Tuesday, June 23, 2026 at 1:00 pm at the City of Nashua's
Wastewater Treatment Facility, 2 Sawmill Road, Nashua, NH immediately followed by a walkthrough of the
proposed project. Bidders are required to attend and participate.

12. Bidding Documents may be obtained in PDF format on-line at https://www.nashuanh.gov/bids.aspx. No paper
sets will be distributed by the Issuing Office.
13. Bidders are encouraged to submit questions via email; however, the City of Nashua assumes no liability for
assuring accurate/complete email transmission/receipt and is not responsible to acknowledge receipt. Inquires
must be submitted in writing, citing the IFB title, IFB number, Page, Section and received no later than Tuesday,
June 30, 2026 at Noon to:

Interpretations or clarifications considered necessary by Engineer in response to such questions will be issued by
Addenda delivered to all parties recorded as having received the Bidding Documents. Questions received less
than seven working days prior to the date for opening of Bids may not be answered. Only questions answered
by Addenda will be binding. Oral and other interpretations or clarifications will be without legal effect.
Addenda may be issued to clarify, correct, supplement, or change the Bidding Documents. Addenda will be
issued not later than five working days before the bid opening. Bidders are responsible for determining that
they have received all Addenda issued.
14. The City of Nashua will consider all timely-received questions and requests for change and, if reasonable and
appropriate, will issue addendum(s) to clarify or modify this IFB. Answers to Bidder submitted questions and other
addenda will be posted under document IFB0285-072126 on the City of Nashua website, www.nashuanh.gov,
under Services; Bid Opportunities; Current Bids no later than Thursday, July 9, 2026 at 3:00 pm.
