Water Treatment Plant Improvements

NOTICE TO BIDDERS
PUBLIC NOTICE IS HEREBY GIVEN that sealed bids will be received by the Township of Florence
for the Florence Township Water Treatment Plant Improvements in Township of Florence,
Burlington County, New Jersey. In general, the work of this project consists of improvements to the
Florence Township Water Treatment Plant (WTP). The Florence Township WTP is located at 236 W 6th
Street, Florence Township, Burlington County, New Jersey. The improvements proposed at the plant
include the installation of pressurized iron and manganese filtration system with GreenSand+ media, the
installation of a Granular Activated Carbon (GAC) adsorption system for removal of per- and
polyfluoroalkyl substances (PFAS) contamination, and a complete filter backwash wastewater handling
and discharge system. The upgrades shall be installed with all process and potable water and sanitary
piping, valves, and appurtenances, electrical, instrumentation and controls, and connections to the existing
system. The improvements shall also include the construction of a new CMU masonry building, and all
associated structural improvements necessary to support the structures.
Said Bids will be received, opened and read aloud in public at the Administrative building,711 Broad
Street. Florence, New Jersey 08518 on September 9, 2026 at 10 AM prevailing time.

PAYMENT MUST BE RECEIVED PRIOR TO OBTAINING SAID SPECIFICATIONS.
NO BIDS ARE TO BE DROPPED OFF AT THE ENGINEER'S OFFICE.
The Township of Florence reserve the right to consider the bids for sixty (60) days after the receipt
thereof, and further reserves the right to reject all bids and also to waive minor informalities or non-
material exceptions in a bid and make such awards or take action as may be in the best interest of the
Township of Florence, in accordance with applicable law. In no case shall the advertisement for bids to
be published less that 30 days prior to the date fixed for receiving bids on the purchase or contract.
The project is funded in part by New Jersey Environmental infrastructure Trust Program, and the
successful bidder must comply with all the provisions of N.J.A.C. 7:22-9.1 et seq. for the participation of
small business enterprises owned and controlled by socially and economically disadvantaged individuals.
This subchapter (7:22-9) establishes procedures for provided opportunities for socially and economically
disadvantaged "SED" contractors and vendors to supply materials and services under State financed
construction contracts for environmental infrastructure facilities. To implement the policies established in
N.J.S.A. 58:11B-26, 40:11A-41 et seq., and 52:32-17 et seq., this subchapter applies to environmental
infrastructure projects receiving financial assistance from the Department and the Trust pursuant to
N.J.A.C. 7:22-3, 4, and 6 and 7:22A-6 and 7. Under the provisions of N.J.A.C. 7:22-3, 4, and 6 and
7:22A-6 and 7, the Department and the Trust required recipients of Trust and Fund loans and other
assistance to establish such programs for socially and economically disadvantaged small business

concerns, to designate a project compliance officer, and to submit to the Department and Trust
procurement plans for implementing the SED program.
In accordance with N.J.A.C. 7:22-9.6:
All project sponsors, at least 30 days prior to public advertisement for bids, shall notify the agencies
specified in N.J.A.C. 7:22-9.13(a)8, of the availability of opportunities for SEDs to provide services, to
bid on unrestricted contracts or subcontractors, or to provide any other necessary purchase or
procurement. The notice shall include a description of the type and scope of the services involved.
Bids must be on the bid form prepared by Remington & Vernick Engineers, in the manner designated
therein and required by the specifications, must be enclosed in sealed envelopes bearing the name and
address of the bidder on the outside and also bearing on the outside reference to the particular work bid
upon. Said bids are to be submitted and addressed to the Municipal Clerk, Nancy L. Erlston, RMC, at
711 Broad Street, Florence, New Jersey 08518.
Each bid shall be accompanied by a certified check, cashier's check or bid bond duly executed by the
bidder as principal and having as surety thereon a surety company listed on the Federal Treasury List
(Environmental Protection Department Circular 570 Surety Companies Acceptable on Federal Bonds) as
required by N.J.A.C. 7:22-3.17(g) and approved by the Township of Florence in a goal amount not less
than ten percent (10%) but in no case in excess of $20,000.00 of the amount bid.
The project sponsor has identified that the SED utilization goal for this project is 10 PERCENT. The goal
of 10 percent applies to the total amount of all contracts for building, materials, and equipment, or
services (including planning, design, and building related activities for a construction project). Any such
bid bond shall be without endorsement or conditions. The bid shall also be accompanied by a certificate
letter from a surety company stating that it will provide the bidder with the completion bond. The 10
percent SED utilization requirement shall be accomplished by the following:
1. Bids shall be solicited in an unrestricted basis. The bid documents, however, shall include a
statement to the effect that the successful bidder must fulfill the SED utilization requirements by
subcontracting portions or the work to SEDs.
2. Contractors also have the option of establishing unrestricted bidding procedures to fulfill the 10
percent SED utilization requirement for the project.
In accordance with N.J.A.C 7:22-9.10:
a. If the contracting agency determines that the acceptance of the lowest responsible bid will result
either in the payment of an unreasonable price or in a contract otherwise unacceptable pursuant to
the statues and rules governing public contracts, the contracting agency shall reject all bids.
b. Bidders and the office shall be notified of the rejection of all bids, the reasons for the rejection,
and the contracting agency's intent to solicit bids for a second time.
c. If the contracting agency determines a second time that the acceptance of the lowest responsible
bid will result either in the payment of an unreasonable price or in a contract otherwise
unacceptable pursuant to the statues and rules governing public contracts, the contracting agency
shall reject all bids and notify the NJDEP Office of Equal Opportunity and Public Contract
Assistance and, after receipt of the NJDEP Office of Equal Opportunity and Public Contract
Assistance's approval, shall amend the project plan accordingly.

d. Bidders shall be notified of the cancellation, the reasons for the cancellation and the contracting
agency's intent to resolicit bids on an unrestricted basis. SEDs may participate in the bidding on
an unrestricted basis.
The award of the contract shall be made subject to the certification of funds to do the work being
provided by the Township of Florence in a lawful manner. The contact to be executed by the successful
bidder will provide that it shall not become effective until the necessary monies to do the work have been
securing of necessary State, Federal, if Local permits governing the work.
In accordance with N.J.A.C. 7:22-9.7(b), the advertisement for bids shall indicate that:
Awards will be made only to socially and economically disadvantaged business concerns that are certified
by the New Jersey Commerce, Economic Growth and Tourism Commission, the new Jersey Department
of Transportation, the Port Authority of New York and New Jersey, New Jersey Transit or other agencies
deemed appropriate by the Office as eligible minority businesses or female businesses.
The invitation to bid is on an unrestricted basis whereby the successful bidder must fulfill the SED
utilization requirements.
N.J.A.C. 7:22-9.7 requires project sponsors to adhere to specific advertisement criteria and duration.
Specifically, relating to advertisement duration: In no case shall the advertisement for bids be published
less than 30 days prior to the date fixed for receiving bids on the purchase or contract.
In accordance with the provisions of N.J.S.A. 10:5-33 et seq., P.L. 1975, c. 127, N.J.S.A. 34:11-56.25 et
seq. (New Jersey Prevailing Wage Act), and Americans with Disabilities Act of 1990 (42 U.S.C. S12101,
et seq.) bidders are required to comply with all provisions.
In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7l22-3.17(a)24 and 4.17(a)24, the
contractor (subcontractor) shall comply with all the provisions of N.J.A.C. 7:22-9.
N.J.A.C. 7:22-3.17(a)24, 4.17(a)42, 6.17(a)24 and 7:22A-2.4(a) provide that a goal of not less than 10
percent be established for the award of contracts to small business concerns owned and controlled by one
or more socially and economically disadvantaged individuals. The goal of 10 percent applies to the total
amount of all contracts for building, materials and equipment, or services (including planning, design and
building related activities) for a construction project. The project sponsor has identified that the SED
utilization goal for this project is: 10 percent.
The contractor (subcontractor) is further notified that they must comply with provisions of N.J.S.A.
52:25-24.2 and submit a Disclosure Statement listing stockholders with their bid.
The contractor is further notified that they must comply with N.J.S.A. 34:11-56.48 et seq. Public Works
Contractor Registration Act and them and any subcontractors must be registered in accordance with the
act.
The contractor is also further notified that they must comply with N.J.S.A. 52:32-44 and submit proof of
business registration and submit proof of business registration for any named subcontractors in
accordance with the act.
This contract or subcontract is expected to be funded in part with funds from the New Jersey Department
of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State of
New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies, or

employees is, or will be a party to this contract or subcontract or any lower tier contractor or subcontract.
This contract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10. In accordance with the
provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a) 24 and 4.17(a) 24, the contractor (subcontractor)
shall comply with all of the provisions of N.J.A.C. 7:22-9.
This Notice shall appear in the Newspaper not less than ten (10) working days before the bid opening; and
notice of revisions or addenda to advertisements or bid documents will be as outlined in N.J.S.A. 40A:11-
23.
