(Request for Qualifications)

Request for Qualifications will be received by the Town Clerk of the Town of Guttenberg, in the County of Hudson, New Jersey, at the Town Clerk's Office in the Municipal Building, 6808 Park Avenue, Guttenberg, N.J. from Wednesday, February 4, 2026 till Tuesday, February 24, 2026 10:00 a.m. prevailing time for the following titles, in accordance with the Request for Qualifications now on file in the office of the Town Clerk, Municipal Building, 6808 Park Avenue, Guttenberg N.J., where same may be obtained during office hours from 9:00 a.m. to 3:00 p.m.:

Request for Qualifications:

All RFQs shall be submitted in sealed envelopes addressed to the Town Clerk of the Town of Guttenberg, the envelope shall have marked conspicuously on its face on the top right-hand side in letters not less than one inch the word “Request for Qualifications”   followed immediately below those words in letters not less than one half inch high: “Request for Qualification of (insert whichever title you are submitting a response)” and underneath that “To be received on or before Tuesday, February 24, 2026.” and underneath that the time (“10:00 a.m.”)  Qualification Statements will not be accepted by facsimile transmission or e-mail.

If RFQs are to be accepted by mail or courier, the RFQs must be placed in an outer envelope, which on the top right-hand side shall clearly designate in the same manner as set forth above, the same size and information. The inner envelope shall have specifically placed in the center the same information as set forth above and on the bottom left-hand side the name and address of the Respondent.

The burden is upon the Respondent to comply specifically with the directions in this “Notice for Request for Qualifications”.  The Respondents are put on notice that because of precautions resulting from terrorist’s threats; packages may be opened if directed to the wrong office of the Town.

Any RFQ not delivered in the manner as set forth in this “Notice for Request for Qualifications” shall be declared void.

Qualification Statements are being solicited through a fair and open process in accordance with N.J.S.A. 19:44A-20.5 et seq. Responders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 and all other requirements set forth in the Request for Qualifications.

A Respondent may submit supplemental information that it feels may be useful in evaluating its Qualification Statement. Respondents are encouraged to be clear, factual and concise in their presentation of information.

Respondents must submit an original and one (1) copy use white 8 1/2 x 11 paper.  Qualification Statement to the designated contact person or designee:

The Town of Guttenberg reserves the right to waive informalities in Requests for Qualification and to reject any and all Requests for Qualification, if deemed in the best interest of the Town so to do.

The Town reserves the right to amend any posted RFQ prior to February 24, 2026.

THE TOWN OF GUTTENBERG (“TOWN”) REQUESTS QUALIFICATIONS
FROM LAW FIRMS/ATTORNEYS INTERESTED IN SERVING AS
SPECIAL COUNSEL REDEVELOPMENT” TO THE TOWN FOR
THE PERIOD MARCH 1, 2026 TO DECEMBER 31, 2026
Introduction
Pursuant to the Fair and Open Process described under N.J.S.A. 19:44A-1, et sq., the
Town seeks Requests for Qualifications (“RFQ”) from law firm/attorneys licensed to practice
law in the State of New Jersey that wish to provide general counsel and litigation services as
Special Counsel Redevelopment to the Town as directed by the Town Attorney or other
appropriate Town official for the term of March 1, 2026 through December 31, 2026.
All necessary documents can be downloaded from the official Guttenberg website,
www.guttenbergnj.org. Copies of this standardized submission requirements and selection
criteria are also on file and available from the Office of the Town Clerk.
All candidates are required to comply with N.J.S.A. 10:5-31 et seq and N.J.A.C. 17:27
et seq. as amended. (Affirmative Action). Each candidate shall submit proof of business
registration with the New Jersey Division of Taxation (P.L. 2004, C.57) prior to the award of
contract but preferably with their proposal.
The successful firm must have significant experience in representing New Jersey
municipalities in all aspects of municipal law. The successful firm will provide the Town with
legal guidance relating to, but not necessarily limited to:
1. Legal research and/or advisory opinions as needed;
2. Research and draft ordinances and/or resolutions;
3. Represent the Town in litigation in federal and state courts and administrative
forums;
4. Review and/or draft contacts, bid specifications and legal notices;
5. Attend meetings of the Town Council upon request;
6. Conduct programs on specified legal issues for appropriate elected officials
and/or Town employees upon request;
7. Notify the Town of changes in municipal law or state regulations, as well as
Court decisions, that impact the operation of the Town; and
8. Any other matters as directed by the Town.
Professional Information and Qualifications
Each interested firm shall submit the following information:
1. Name of firm;
2. Address of principal place of business and all attorneys or firm’s offices and
corresponding telephone and fax numbers. Please note specifically which
attorneys will be assigned to work with the Town;
3. Areas of Practice;
4. Description of firm’s attorney’s education, experience, qualifications, number
of years with the firm and a description of their experience with projects similar
to those described above;
5. Experience related to representation of public entities;
6. Examples of your record of success representing public entities;
7. The firm’s ability to provide the services in a timely fashion (including staffing,
familiarity and location of key staffing);
8. Cost details, including the hourly rates of each of the individuals who will
perform the services and the time estimates for each individual, all expenses,
and where appropriate, total cost of “not to exceed” amount. The Town will pay
no more than $150.00 per hour for attorney services;
9. Business Registration Certificate (prior to contract award);
10. Statement of Ownership Disclosure (form provided);
11. Letter of Qualification (form provided);
12. Letter of Intent (form provided);
13. Non-Collusion Affidavit (form provided);
14. Americans with Disabilities Act form (form provided);
15. Affirmative Action Compliance Notice (form provided);
16. Minority/Woman Business Enterprise form (form provided);
17. Disclosure of Investment Activities in Iran form (form provided); and
16. Any other information which the interested firm deems relevant.
Section Criteria
The Town reserves the right to award a contract or contracts to the vendor(s) as
determined to be in the best interests of the Town based upon the selection criteria.
The selection criteria used in awarding a contract or agreement for professional
services as described herein shall include:
1. Qualifications of the individuals who will perform the tasks and the amounts of
their respective participation;
2. Experience and references;
3. Ability to perform the task in a timely fashion, including staffing and familiarity
with the subject matter;

5. Other factors, if demonstrated to be in the best interest of the Town.

Qualifications in response to a Request for same from the Town in regards to Services Special
Counsel (General). I further certify that:
1. I executed said Proposal with full authority so to do;
2. All statements contained in the Submission and in this affidavit are accurate, factual and
complete, and made with full knowledge that the Town of Guttenberg is relying upon the truth of
the statements contained in the Submission and the statements contained in this affidavit in
evaluating Respondent’s Qualifications;
3 Respondent has not, directly or indirectly, entered into any agreement, participated in any
collusion, or otherwise taken any action in restraint of free, competitive bidding in connection with
the above named project through participation with any other person, firm or party;
4. Respondent agrees to participate in good faith in the procurement process as described in
the RFP and to adhere to the Town’s procurement schedule;
5. Respondent acknowledges that all costs incurred by it in connection with the preparation
and submission of the Qualification Statement-Proposal and any proposal prepared and
submitted in response to the RFP, or any negotiation which results therefrom, shall be borne
exclusively by the Respondent. In no event shall the Town have any liability to Respondent
for any costs incurred by the Respondent for the Qualification Statement-Proposal.
6. Respondent acknowledges and agrees that the Town may modify, amend, suspend and/or
terminate the procurement process in its sole judgment.
7. Respondent is aware that any contract executed with respect to the services referred to in the
RFP must comply with the applicable affirmative action and similar laws, and agrees to take such
actions as may be required to comply with such applicable laws in the event that a contract is
formed.
