Bids for the following items will be publicly opened and read aloud at 10:00 am on Wednesday, March 11, 2026 at the
Office of the County Superintendent of Highways. All bids must be placed in a sealed envelope and shall be clearly
marked in the bottom left corner of outside envelope “SEALED BID -
”. All materials being bid must meet the
specifications of the New York State Department of Transportation. It is the bidder’s responsibility that bids are received
by this office prior to the start of the bid opening. Late submissions for any reason will not be opened. No emailed or
faxed bids are accepted. Detailed information and specifications may be obtained by visiting or contacting the Office of the
County Superintendent of Highways to have them emailed. PDF versions of Bid Opportunities will be available on the

- The County of Wyoming reserves the right to utilize National Cooperative Contracts, NYS Office of General Services
(OGS) Contracts or other Municipal Contracts to procure any supplies, commodities, services or technology that are
available under those programs, which may include items or services included in the bid solicitation.
- Crushed aggregates, stone fill and asphaltic concrete are to be hauled from source in County Trucks and/or delivered by
suppliers, as specified.
- In purchase of above materials, where County Trucks are used for delivery, the County of Wyoming reserves the right to
purchase all or part of a season’s requirements from the source requiring the shortest haul to a destination, to obtain the
most advantageous total price to the County.
- The County of Wyoming reserves the right to make purchases of materials for specific projects during the year and to
make awards for such materials on the basis of separate bids where it appears in the best interest of the County to do so.

BASE TERMS FOR ALL BID SOLICITATIONS
1. Executory Clause
Wyoming County shall have no liability under any contract or contracts or to anyone else beyond funds appropriated and
available for the purpose of this specification and resultant contract(s).
2. Assignability
The contractor shall not assign, transfer, convey, sub-contract, sublet or otherwise dispose of all or portions of this contract
(and/or work to be performed as a result of the contract) or its right, title, or interest to any other person, company,
corporation, without prior written consent of the Superintendent of Highways.
3. Extension of Contract Usage
Political subdivisions within New York State (Towns, Villages, School Districts and Fire Districts), as defined in Section
#103 of the General Municipal Law may participate in any contract awarded as a result of this bid document as long as it is
mutually agreed to by both parties. Responsibility, financial or otherwise, for purchase(s) made by other parties as a result
of the extension of this contract, shall not be borne by Wyoming County.
4. Contractor’s Failure to Comply
The contractor’s failure to perform in compliance with the bid award shall result in withholding of payment. The payment
shall be withheld until such times as the contractor fulfills its responsibilities. Compliance shall be determined by and to
satisfaction of Wyoming County. Such action would not necessarily preclude further initiatives on the part of Wyoming
County to protect and preserve its best interest.
5. Cancellation of Contract
Wyoming County reserves, as its right, to cancel the contract(s) resulting from an award of this bid solicitation at any time
during the contract period, without penalty to Wyoming County and without stated reason, by delivering a written ten (10)
day notice of intent to the contractor(s) or its representative(s). Said notification mailed to the contractor or its
representatives via the US Postal Service, First Class Mail shall be considered sufficient and delivered.
6. Contractor Registration Requirement (NYS Labor Law 220-i)
Effective December 30, 2024, all contractors submitting bids for or performing work for a municipality must be registered
with the New York State Department of Labor (NYSDOL) in accordance with Labor Law 220-i.
Contractors must be registered prior to submitting a bid or starting work. Proof of registration, in the form of a Certificate
of Registration issued by NYSDOL, must be provided to the County upon submission of each bid. Failure to comply may
result in rejection of bid.
7. Certified Payroll
Pursuant to Article 8 of the New York Labor Law, the Contractor and all Subcontractors shall maintain and submit certified
payroll records for all work performed under this Contract. Certified payroll transcripts shall be provided to the
Municipality within thirty (30) days of the first payroll and every thirty (30) days thereafter for the duration of the Work,
and as a condition of final payment. All payroll submissions shall comply with applicable New York State prevailing wage
requirements, including electronic submission requirements where mandated by law.

Ultra-Thin Overlay – Bid Specifications
Description:
The Paver Placed Surface Treatment system shall consist of a warm polymer modified emulsion sprayed
immediately preceding the application of a hot mix asphalt wearing course which forms a homogeneous
well-textured and wearing surface that can be opened to traffic immediately on cooling. The normal
thickness of the layer shall be 5/8”; the maximum thickness of the mat shall not exceed 1½”. The Asphalt
Binder used can be either a conventional PG64S-22 or a polymer modified PG64V-22.
Polymer Modified Asphalt Emulsion Material:
The liquid material shall be a cationic, rapid setting, asphalt emulsion, NYS item 702-4001 except as
modified in Data Table I – Polymer Modified Asphalt Emulsion. The emulsion shall be obtained from a
storage facility that has been approved by the Director of the Materials Bureau, NYSDOT, within the
calendar year, prior to the start of work.
Hot Mix Asphalt Material for Wearing Course:
The wearing course shall be a mixture of single size coarse aggregate, fine aggregate, mineral filler and
asphalt cement. The single size coarse aggregate shall be nominal ¼” for Type-A mix, nominal 3/8” for
Type-B mix or nominal ½” for Type-C mix, according to the gradation specifications in Data Table II.
The hot mix asphalt concrete shall be obtained from a facility that has been approved by the Director of the
Materials Bureau, NYSDOT, within the calendar year, prior to the start of work. The asphalt content of the
mix shall be 4.8-5.3% by weight of the total mix and must be computed based on the actual job mix.
Standard and Polymer Grade PG Asphalts are presented as options.
Surface Preparation:
The following items will be performed by the contracting agency, unless otherwise directed.
A. Manhole covers, water valves, catch basins and other such drawings shall be clearly referenced for
location and adjustment after the surfacing operation.
B. Thermoplastic traffic markings shall be removed. All vegetation at the edge of the pavement shall be
removed.
C. Pavement cracks and joints, greater than ¼” wide shall be cleaned and filled with an approved material
prior to surfacing operation.
D. Before applying Paver Placed Surface Treatment, serious surface irregularities shall be corrected.
Wheel ruts greater than 1” in depth shall be filled prior to the resurfacing operation.
E. The pavement surface area to be overlaid shall be cleaned and made free of any debris that may hinder
bonding of the overlay.
Application:
- Paver Placed Surface Treatment shall be placed on a dry or damp, but not on a wet pavement
surface. The pavement temperature shall not be less that 50°F and rising.
- The polymer modified asphalt emulsion shall be applied by the asphalt emulsion spray system
mounted on the self-priming paver. The spray system shall accurately, uniformly and continuously
monitor the rate of application across the entire width to be overlaid.
- The rate of spray shall be 0.2 + 0.05 gallons per square yard. The asphalt emulsion shall be applied at a
temperature of 140–180°F. No wheel or other part of the paving machine shall come into contact with
the polymer modified asphalt emulsion before the hot mix asphalt-wearing course is applied.
- The hot asphalt concrete wearing course shall be delivered to the self-priming paver at a temperature of
315+15°F. The application rate of the hot asphalt aggregate mixture shall be:
Type A (nominal ¼”) 60 + 10 pounds per square yard
Type B (nominal 3/8”) 65 + 10 pounds per square yard
Type C (nominal ½”) 70 + 10 pounds per square yard
- The hot mix asphalt-wearing course shall be spread over the polymer modified asphalt emulsion within
seconds of the spray application. Where shape correction is necessary or the old surface is porous, the
application rate of the emulsion and hot mix asphalt wearing course may need to be increased.
- Compaction of the Paver Placed Surface Treatment shall be accomplished with a minimum of at
least one steel wheeled, double drum roller of a minimum dead weight of ten (10) tons before the
material temperature has fallen below 180°F at mid-layer.
Traffic:
Traffic control in work zones shall be provided as per the NYS Manual of Uniform Traffic Control Devices
and all signs, barricades, and signaling devices will be in accordance with this manual to protect both
public and the contractor’s personnel. Flagmen will be provided by the contractor to guide and direct
traffic around said contractor’s operation and to control traffic speed on completed work.

Verification of Quantities and Testing:
At the end of each working day or completed job site, a check shall be made to determine the quantities of
polymer modified asphalt emulsion used. The check shall be made by means of the gauge on the self-
priming paver or the unit used to transport the material. The total gallons of material sprayed shall be
divided by the total square yards sprayed to determine yield per square yard.
The hot mix asphalt concrete spread rate shall be calculated by dividing the tonnage by the square yards
covered to determine yield per square yard.
Samples of hot mix asphalt shall be taken at a rate of 1 per 250 tons and tested for aggregate gradation and
asphalt cement content. Samples of the polymer modified asphalt emulsion shall be taken once per tanker
load or once per day.
At the conclusion of each day’s production, delivery ticket or invoice shall be completed by the contractor
and signed by a representative of the contracting agency.
DATA TABLE I
Polymer Modified Asphalt Emulsion: This material shall be cationic asphalt emulsion modified with an approved
polymer, using either natural or synthetic latex. It shall be smooth and homogeneous and shall conform to the
following requirements and be available on site at a temperature of not less than 140°F.

Asphalt Binder: Use the appropriate performance Graded asphalt binder for the project geographical location and
design traffic level. PG 64S-22 or PG 64V-22.
PRICE ADJUSTMENTS:
Price adjustments allowed will be based on the (November 1, 2025) average of the FOB terminal price per US ton
of unmodified PG 64S-22 binder without anti-stripping agent (base average FOB terminal price). The new monthly
average terminal price will be determined by the New York State Department of Transportation based on prices of
pre-approved primary sources of performance graded binder in accordance with the New York State Department of
Transportation Standard Specification.
The November 2025 average is $638.00 per US Ton
NOTE: The same grade of asphalt cement used in establishing the base average FOB terminal price shall be used in
establishing the new average FOB terminal price.
In the event that one or more of the New York State Department of Transportation pre-approved sources discontinue
posting a price for asphalt cement, the base average FOB terminal price shall not be recalculated.
The new average FOB terminal price will be determined based on the above FOB terminal prices posted on the third
Wednesday of each month of each month, hereafter known as the “Adjustment Date”, during the contract period
starting with (May 15, 2026). However, price adjustments, in accordance with the formula below, will be effective
for deliveries made on and after the first of the month, i.e. - June 1, 2026, following the adjustment date.
The unit prices of bituminous materials from any award based on these specifications will be subject to adjustment
based on the following formula:
