SUMMARY
The Wyoming County Department of Buildings & Grounds is issuing this advertisement for BIDs to engage a
qualified contractor to provide labor and material for the milling, repair, and resurfacing of an estimated 3,200
square foot of parking lot entrance. The scope of services is outlined below and generally include implementing
the Department's requirements in providing, but not limited to: labor, materials, tools, equipment supervision
and other services necessary to mill, repair base materials, adjust grades, resurface, and stripe the outlined
parking lot. BIDS are due no later than May 21st 2026 at 1:00pm.
Sealed Bid: Bids are to be submitted in a sealed envelope with the title of "Training Center Lot Entrance" to
the Wyoming County Buildings and Grounds office located at: 36 Center Street Suite B3, Warsaw NY 14569
by May 21st 2026, at 1:00pm. Bids may NOT be submitted via fax or email, and any Bid received after this
deadline will not be eligible for consideration. Bids will be reviewed and evaluated by Wyoming County Public
Works Committee in anticipation of the awarding of a contract.

Wyoming County reserves the right to reject and or waive any and all Bids/Proposals and to waive any
irregularities in procedure.
Form of Contract:
Unofficial letter of award will be issued within 10 business days. Formal contract can take up to 30 days.
Bidder qualifications:
1. Mandatory Site walkthrough/meeting with Buildings & Grounds Director - must be scheduled with the Buildings
and Grounds Office - 585 786 8958
2. Contractors business/company must have at least 10 years' experience in lot maintenance, paving, and general site
work.
3. Agency submitting the Bid is the agency completing more than 75% of the work.
4. Contractor must be registered with NYS to Qualify to bid

Project Site Details and site Specifications:
The estimated parking lot entrance is 3200 sf. (contractor to measure for accuracy)
The operating hours of the building vary with potential of needing access 24/7
All work is to be completed in accordance with the most current NYS Building code/ DOT specifications.
Bids are to include prevailing rate as per NYS DOL Article 8 PRC#2026-011567
The use of any building restroom facilities will be prohibited, contractor to furnish temp restroom for all project
workforce.
Water is available at the pond that is on premises
Project is to be completed between October 1st and October 31st 2026.
Project expected scope of work:
Milling of all asphalt to the stone base, repair of base where necessary, compaction, installation of 3 inches of
binder (min), 2 inches of top coat (min)
o Wyoming County Dump Trucks/workforce to haul all milled materials from site.
o Besides County owned trucks for millings transport, all construction equipment and material are to be
provided by the contractor.
Alterations of daily parking lot operations will take place during the timeline of the project
o Note: construction needs to take place while maintaining multiple safe entry and exit points for employee
foot traffic to and from the facility.
Contractor to Repair any compromised or soft spots within the gravel base.
Gravel base (clean) should be a minimum of 8 inches thick in all areas, and it is the duty of the contractor to
ensure any non-gravel or "dirty" base material is removed adding and compacting new gravel to the proper grade.
o Note: as base materials are unknown, please submit bid with allowances for providing and installing up
to 20 ton of Crusher #2 gravel (or comparable). Any/all additional material to be proposed as a project
change order process.
Asphalt Material Installation - Minimum of 3 inches of HOT asphalt binder w/ a minimum of 2 inches of HOT
asphalt top coat. - Total of 5 inches of material
Asphalt is to transition to all sidewalks, roadways, drainage devices, etc. without possibility of trip hazards.
Grade set so all water sheds towards DIs and/or away from lot.
Ponding or stagnant water is not acceptable and will be properly fixed/repaired at the contractor's expense.
All site/grade prep work and clean up are the responsibility of the Contractor.
Any alteration to the work detail must be approved by the Buildings & Grounds Director.
o Any changes or alterations outside of the contract must have approval via written consent/Change order -
no exceptions

Project Delivery:
Contractor will be required to field measure all parking lot areas as outlined per attachment A providing all labor,
materials, equipment, supervision and other services as may be necessary to complete the resurfacing project unless
otherwise specified. Weather permitting, Wyoming County anticipates that the work will be performed on a rolling basis
from project start to project completion. (Working nights only if absolutely necessary).
The Contractor will be required to coordinate all work with the Director of Facilities,
and shall be responsible for proper safety precautions, barriers and ensuring signage is in place to keep all personnel safe
and will ensure building accessibility.
Contractor to provide detailed Scope of Work including a Schedule that coordinates around all Court House scheduling.
Submitted schedule needs County approval before any work begins.
The buildings are to remain open for business during all construction.
Performance Bond:
Contractor shall furnish a performance bond in an amount of 5% of the contract. The bond shall remain in effect until the
final completion and inspection of the project.
Performance Criteria:
The Contractor shall be required to conduct project in a workman-like and professional manner. In performing this work,
the Contractor shall be required to field measure all lot areas and verify grades as well as square footages.
Please NOTE: Tobacco, Alcohol, and Drug use are not prohibited on County property. Anyone found using these items
on County grounds will be escorted off the premises immediately.
Construction Phase:
During the Construction Phase, constructor shall carry out such activities as are
necessary to complete the construction described in the document scope of work.
Contractor to maintain safe environment for all persons utilizing surrounding buildings and properties.
Contractor's Compensation:
As will be more fully described in the Form of Contract, this will be a Lump Sum type contract.
Offerors will be required to submit with their bid a Lump Sum Price for the work. The
Lump Sum Price should include sufficient funding to cover all of the costs necessary to complete the Project, including,
but not limited to, profit, home and field office overhead, supervision, labor, materials, equipment, bonds, insurance and
other services as may be required to obtain the necessary permits, and construct the work. The Lump Sum Price should
also include sufficient funding to fund items that are not specifically identified on the Drawing and Specifications portion
of the bid spec but which are reasonably inferable from therefrom, as well as the performance criteria outlined in the
Details and Specifications portion of this Bid platform.

This Agreement may be modified or amended only by MUTUAL consent of both parties involved. Any such
modification or amendment must be in writing, duly executed by both parties and shall be attached to and
become part of this Agreement. This Agreement may not be assigned or transferred or any way disposed of by
the contractor without prior written approval from Wyoming County.
The contractor is held responsible for all terms outlined within this Advertisement. Once formally approved,
the attached proposal will be formed into a contract that outlines said project.
The term of this proposal as well as all costs associated will be valid for days and can be extended only
with written confirmation by both parties.

Insurance Requirements
Edition 3/2011
I) The contractor shall procure and maintain at his own expense and without expense to the County,
insurance for liability for damages imposed by law, of the kinds and in the amounts hereinafter
provided. The Insurance shall cover all operations under the contract whether performed by the
contractor or by subcontractors. This insurance must remain in force until final acceptance by the
County of the work covered by the contract.
II) The policies must name the County as an additional insured and shall:
A) Be an insurance policy from an A.M. Best rated New York State licensed, admitted insurer; with a
rating of an A or better.
B) State that the coverage shall be primary for the Municipality, its Board, employees and volunteers.
At least ten (10) working days prior to the commencement of the work, the Contractor and all
subcontractors shall submit to Wyoming County evidence of insurance coverage as required by
these documents. The Certificate of Insurance shall provide no less than thirty (30) days' notice
of cancellation or non-renewal of the insurance coverage. All Certificates of Insurance must be
signed by a licensed agent or authorized representative of the insurance carrier. Broker signature
is not acceptable.
The terms of this appendix shall control over any contractual terms elsewhere in the contract unless
specifically exempted in writing.
III) The contractor/permittee agrees to indemnify the municipality for any applicable deductibles.
IV) The types and limits of insurance are as follows:
A) Commercial Automobile Liability and Property damage Insurance covering all owned, leased,
hired and non-owned vehicles used in connection with the Work with a combined single limit for
Bodily Injury and Property damage of at least $1,000,000 per occurrence.
B) Workers' Compensation Insurance. A policy covering the obligations of the contractor in
accordance with the provisions of the Workers' Compensation Law covering all operations under
the contractor, whether performed by him or by his subcontractor. The contract shall be void and
of no effect unless the person or corporation making or executing same shall secure compensation
coverage for the benefit of, and keep insured during the life of said contract such employees in
compliance with the provisions of the Workers' Compensation Law (State Finance Law 142).
The "All States" endorsement must be attached to the Workers' Compensation Insurance.
C) Commercial General Liability (CGL) with a combined single limit for Bodily Injury, Personal
Injury, and Property Damage of at least $1,000,000 per occurrence and $2,000,000 aggregate.
Coverage shall provide and encompass the following:
1. Written on an occurrence form.

2. Endorsement naming the County of Wyoming as an additional insured.
3. Policy, or policies, must be endorsed to be primary as respects the coverage
afforded the Additional Insured and such policy shall be primary to any other
insurance maintained by the County. Any other insurance maintained by the
County shall be excess of and shall not contribute with the Contractor's or
Subcontractor's insurance, regardless of the "other insurance" clause contained in
the County own policy of insurance.
4. Policy shall contain a per job aggregate.
D) Umbrella and/or Excess Liability policies used must follow the form of the CGL, Automobile
Liability and Employers Liability policies shown above and warranted to be in excess of limits
provided by primary CGL, Automobile Liability, and Employer's Liability, but not excess to other
insurance maintained by the County, at a limit of $5,000,000.00 per occurrence. (The umbrella
limit shall be determined by the County on a job-to-job basis depending on the County's
exposure.)
V) Should the Contractor engage a Subcontractor, the same conditions as are applicable to the
Contractor under these insurance requirements shall apply to each subcontractor of every tier.
Proof thereof shall be supplied to the Wyoming County agency.
VI) At any time that the coverage provisions and limits on the policies required herein do not meet the
provisions and limits set forth above, the Contractor shall immediately cease work on the Project.
The Contractor shall not resume work on the Project until authorized to do so by the County, any
delay or time lost as a result of the Contractor not having insurance required by this Article shall
not give rise to a delay claim or any other claim against the County.
VII) Notwithstanding any other provision in the Article, the County may require the Contractor to
provide, at the expense of the county, any other form or limit of insurance necessary to secure the
interests of the County.
VIII) The Contractor shall secure, pay for, and maintain Property Insurance necessary for protection
against the loss of owned, borrowed, or rented capital equipment and tools, including any tools
owned by employees, and any tools or equipment, staging towers, and forms owned, borrowed, or
rented by the Contractor. The requirement to secure and maintain such insurance is solely for the
benefit of the Contractor. Failure of the Contractor to secure such insurance or t maintain
adequate levels of coverage shall not render the Additional Insured or their agents and employees
responsible for any losses; and the Additional Insured, their agents and employees, shall have not
such Liability.
IX) Neither the procurement nor the maintenance of any type of insurance by the County, the
Contractor, or the Construction manager shall in any way be construed or deemed to limit,
discharge, waive or release the Contractor from any of the obligations or risks obligations or risks
accepted by the Contractor or to be a limitation of the nature or extent of said obligations and risk.

HOLD HARMLESS

and save harmless the County of Wyoming from and against all losses from claims, demands,
payments, suits, actions, recoveries and judgments of every nature and description brought or
recovered against it by reason of any omission or act of the contractor, its agents, employees, or -
subcontractors in the performance of this contract, to the extent permissible by law. This
indemnification shall include all costs and disbursements incurred by the County of Wyoming in
defending any suit, including attorneys' fees. Furthermore, at the option of the County of
Wyoming, the Contractor shall provide defense for and defend all claims, demands and causes of
action referred to above, and bear all other costs and expenses related thereto.
