Sealed bids will be received by the City of Ardmore and Ardmore Main Street Authority, Ardmore, Oklahoma, on the sale of surplus land, located in the City limits of Ardmore, Oklahoma, through 2:00 P.M., C.S.T. on Tuesday, April 21, 2026. The bids will be opened in the First Floor Conference Room, City Hall, at that time. Bids will be delivered to Sherrill Shaw, Purchasing Coordinator, in the Purchasing Department, 23 South Washington, or mailed to P.O. Box 249, Ardmore, OK 73402.


Bids are tentatively scheduled for consideration by the Ardmore Main Street Authority Board of Directors on Tuesday, April 28, 2026.


Each bid shall also be accompanied by an acceptable form of bid guaranty in the amount of at least 5% of the amount of bid, as guaranty; that if the bid is accepted, the bidder will execute the Contract within ten (10) days after the Notice of Award. No bid may be withdrawn for at least sixty (60) days after the scheduled closing time of receipt of the bids.

Purpose:
Through a formal Invitation to Bid (ITB) process, the intent is to enter into a written contract with the highest most
responsible bidder for the sale of surplus land for the Legislative Department of the City of Ardmore.
Award:
2.1 The City of Ardmore and Ardmore Main Street Authority reserve the right to change dates the bid will be considered,
reject any or all bids, waive all formalities and accept that deemed most advantageous for value received.
2.2 The City will review responses to the ITB. The vendor meeting the minimum specifications with the highest, most
responsible bid shall receive the award.
Invitation to Bid Organization/Submittal:
3.1 One (1) original bid shall be submitted in a sealed envelope addressed to or hand delivered no later than the closing
date and time to the following location:

3.2 All bids shall be in the office of the Purchasing Coordinator for the City of Ardmore before the FINAL CLOSING DATE
AND HOUR as shown in this Invitation to Bid. Bids received after the time set for receipt of bids SHALL NOT BE
CONSIDERED.
3.3 All bids shall be submitted on the form provided and placed in a sealed envelope, plainly marked with bid number
21-1201, Surplus Land, and shall bear on the outside the vendor's name and address. When submitting more than
one (1) bid, they shall be in separate envelopes. All costs associated with responding to this ITB shall be borne by
the bidder.
3.4 Bids shall be original and hard copy. Facsimile bids shall not be accepted. Bid shall be filled out in ink or typewritten.
Initial all corrections.
3.5 Failure to provide required data or failure to complete the ITB form(s) may be grounds for rejection.
3.6 All bids shall be signed and the Bid affidavit executed and notarized upon the submission of the ITB.
3.7 Inquiries: Inquiries regarding specifications shall be submitted in writing via e-mail to:

Any interpretations, corrections and changes to this bid and specifications or extensions to the opening date will
be made by addenda. Sole issuing authority of addenda shall be vested in the Purchasing Coordinator. Addenda
will be mailed to all who are known to have received a copy of this bid. Bidders shall acknowledge receipt of all
addenda. Written requests for interpretation shall be received no later than 5:00 P.M., C.S.T., Wednesday, April
8, 2026. Answers to all questions will be forwarded to all prospective bidders no later than 5:00 P.M., C.S.T.

Terms & Conditions:
4.1 Bids must comply with all federal, state, county, and local laws and regulations concerning this type of

material/item/service.
4.2 Conflict of Interest: In the event there is a potential or actual conflict of interest, the vendor shall provide full
disclosure to the City of Ardmore. The City shall determine if the conflict, whether potential or actual, is material.
4.3 Choice of Law and Venue: The resulting contract shall be construed under the laws of the State of Oklahoma and
venue in any action and/or litigation commenced to enforce the contract shall be instituted in the appropriate courts
in Carter County, in the State of Oklahoma.
4.4 Successful bidder shall defend, indemnify, and save harmless the City and all its officers, agents and employees from
all suits, actions, or other claims of any character, name and description brought for or on account of any injuries or
damages received or sustained by any person, persons, or property on account of any negligent act or fault of the
successful bidder, or of any agent, employee, subcontractor or supplier in the execution of, or performance under,
any contract which may result from bid award. Successful bidder shall pay any judgment with cost which may be
obtained against City growing out of such injury or damages.
4.5 Any variations or exceptions to the specifications must be stated by the bidder. All bids must meet minimum
standards.
4.6 Exceptions/Substitutions: All bids must meet minimum specifications to be considered for award. Vendors bidding
substitutions shall state these exceptions by attachment, as part of the bid. The absence of exceptions shall indicate
that the bidder has not taken exceptions and shall hold the bidder responsible to perform in strict accordance with
the specifications of the bid.
4.7 Silence of Specification: The apparent silence of these specifications as to any detail or to the apparent omission
from it of a detailed description concerning any point, shall be regarded as meaning that only the best commercial
practices are to prevail. All interpretations of these specifications shall be made on the basis of this statement.
4.8 Minimum Standards for Responsible Prospective Bidders: A prospective bidder must affirmatively demonstrate
bidder's responsibility, and shall meet the following requirements:
4.8.1 Have adequate financial resources, or the ability to obtain such resources as required;
4.8.2 Be responsible for making the abstract current;
4.8.3 Be otherwise qualified and eligible to receive an award.
The City may request representation and/or other information sufficient to determine bidder's ability to meet these
minimum standards listed above.
4.9 Warranty: Land is sold as is, where is, without recourse, with no warranty given by City of Ardmore or Main Street
Authority. The Ardmore Main Street Authority makes no claim or guarantee relative to the current or future fitness
of the land offered for sale for any purpose. The bidder is advised to view the land. The City of Ardmore and Ardmore
Main Street Authority shall not be responsible for the purchaser's failure to inspect the land prior to use, nor shall
the City be responsible for damages by the future use of the land.
ITB Status
5.1 City of Ardmore and Ardmore Main Street Authority Rights:
5.1.1 The City of Ardmore and Ardmore Main Street Authority, and its designees reserve the right to determine
whether a bid is responsive in compliance with the specifications.
5.1.2 The City and Ardmore Main Street Authority reserve the right to reject bids when procedures stated
within are not followed.
5.2 Effective Period: Bids submitted shall remain in effect for a period of sixty (60) days after closing date.
5.3 Withdrawal of Bid: Bids may be withdrawn any time prior to the closing date, however, the City reserves the right
to withdraw vendor(s) from future bids/proposals who have withdrawn a bid after the closing date and prior to the
effective period of the ITB without the City's approval.
5.4 Changes: It shall be the bidder's responsibility to bring to the attention of the City any discrepancies in, omissions
from, or errors in the documents, or enhancements which would be in the best interest of the City, or if they are in
doubt as to the meaning of any part of this ITB.
5.5 Examinations: Before submitting a bid, the bidder shall thoroughly examine the ITB and otherwise be fully informed
as to all existing conditions and limitations.
5.6 Modifications of ITB: Oral modifications will not be considered. Any bidder may modify their bid before closing.
Only modifications received in sealed envelopes with the ITB number, item description and closing date clearly
marked on outside shall be accepted. Written confirmation must be received under the same signature as prior
submitted bid. All modifications are to be clearly numbered and dated as to determine the final one.
5.7 Sales Tax: Bidders are hereby advised that all sales of personal property to individuals or business organizations are
subject to sales tax. (Governmental organizations are exempt.) Sales tax, at the current applicable rate, must be

added to the bid amount at the time of sale to determine the total charges to be paid.

SALE OF SURPLUS LAND DESCRIPTION & BID SHEET
The City of Ardmore and Ardmore Main Street Authority are accepting bids for the sale to the highest bidder, of surplus
land in Ardmore, Oklahoma. The minimum bid requirement is $450,000.00. The appraised value is $750,000.00 and was determined
by an updated appraisal of the property, as of February 2026. The property is zoned Commercial Downtown (CD). It is the desire of
Ardmore Main Street Authority that this property remains a Farmers Market. The property may be viewed on Tuesday, April 7, 2026
from 2:00 P.M.-3:00 PM., C.S.T. The Ardmore Main Street Authority will assume the financial responsibility of making the abstracts
current. The Ardmore Main Street Authority, as Owner, reserves the right to waive all informalities, change the dates the bid will be
considered, terminate the bid process, reject or accept any and all bids or portion, thereof, or accept that bid deemed most
advantageous. All title and escrow costs and expenses incidental to the closing of this transaction shall be charged to the Buyer(s).
The security deposit will be returned if the bid is not accepted within sixty (60) days of opening. Should the proposal be accepted, the
deposit will be applied to the purchase cost. Attachment A is the survey. The land's legal description being offered is as follows:
All of Lot 2, all of Lot 23, and the West 5.0 feet of Lot 5 of Block 323, Original Townsite of Ardmore, Carter County, Oklahoma
Bid Security Required: All bidders are required to submit a bid security in an amount equal to five percent (5%) of the total bid, at
the time of the bid opening. A bid bond provided by a surety company authorized to do business in the State of Oklahoma, a bank
cashier's check, or a governmental agency check, if submitted by a governmental agency, are acceptable forms of security.
Terms of Purchase: The successful bidder shall be allowed ten (10) days, following written notification of award, to make payment in
full to the Ardmore Main Street Authority, unless special arrangements are made. A Quit Claim Deed will be issued to the awarded
bidder: within ten (10) business days after payment in full by cash, cashier's check or money order. If paying by personal check the
Quit Claim Deed will be issued 21 days after receipt of payment in full. Checks shall be made payable to the Ardmore Main Street
Authority. It shall be the awarded bidder's responsibility to file the quit claim deed with Carter County, Oklahoma, and provide a
copy of the filed quit claim deed to the Ardmore Main Street Authority within thirty (30) calendar days.
