Overview
The City of Centerville, in partnership with the Centerville Arts Commission and Keep Centerville
Beautiful, invites qualified artists to submit their credentials for consideration in creating the
Stubbs Park Storybook Trail Mural.
This mural will be located on the concrete retaining wall north of the Stubbs Park Amphitheater
plaza and is intended to complement the Storybook Trail experience.
The artwork should reflect a whimsical, storybook illustration style with a focus on nature, trees
and outdoor themes, aligning with the visual character of the Storybook Trail. A photo with
approximate measurements of the mural location is provided in Attachment 1. Reference
images from the Storybook Trail are included in Attachment 2.
Artists may incorporate subtle references to Stubbs Park features such as the Monkey House,
Amphitheater, Veterans Memorial, Miami Valley Firefighter/EMS Memorial, playgrounds or
other elements.
This Request for Qualifications (RFQ) does not require artists to submit a preliminary rendering
or conceptual design with their application; however, they may include one if they wish.
Selected artists must be prepared to move immediately into design finalization and installation,
following the established project timeline.
Compensation
* The selected artist will receive a $10,000 stipend, which must cover all project-related
expenses, including artist labor, paint and any necessary materials and supplies.
* The artist may engage supporting artists and is responsible for ensuring fair
compensation.

* Enhance the Storybook Trail experience through engaging public art
* Attract visitors to Stubbs Park
* Encourage stewardship of public spaces
* Provide opportunities for artists
Project Details
* Location: Concrete retaining wall north of the Stubbs Park amphitheater plaza
* Address: 255 W. Spring Valley Rd., Centerville, OH
* Installation Timeline: June-July 2026
* Completion Deadline: July 4, 2026
* Dimensions: 120 feet wide overall; the center 85 feet is 6 feet tall, with the height
tapering down at both ends of the wall.
* Medium: Durable outdoor mural materials (e.g., acrylic paint)
* Prep: Artist must prepare the surface to ensure proper paint adhesion.
Eligibility
* Open to all professional visual artists
* Local and regional artists encouraged
* Lead artist must have mural experience and leadership ability
* Lead artist responsible for managing supporting artists

Stubbs Park Storybook Trail Mural Artist Licensing Agreement
This Artist Licensing Agreement (the "AGREEMENT") is entered into effective this date, (date)
between ___________________ ("ARTIST") and the City of Centerville, an Ohio municipal
corporation, ("City"), facilitating the Stubbs Park Storybook Trail Mural ("Program").
Scope of this Agreement: This Agreement applies to any image, graphics, digital assets, or
digital images created or taken by Artist and delivered to the City (collectively known as
"IMAGES"). This Agreement governs the relationship between the parties and no
communication or other exchange shall modify the terms of this Agreement unless agreed to in
writing.
Rights: All Images and rights relating to them, including copyright and ownership rights in the
media in which the Images are stored, will be shared between the City and Artist. This license
provides the City and the Artist with the right to reproduce, publicly display, and distribute the
Images only for the following agreed upon terms:
* Usage of the Images in the creation of a mural in Centerville, Ohio at
__(address)_____________
* All proceeds earned by the sale of the Images by the City must be used for Program
needs only.
* Artist and City may use the Images for any public marketing purposes.
* The City of Centerville, the Centerville Arts Commission and Keep Centerville Beautiful
are partner organizations with this Program and may use the images for marketing
usage directly related to the City or the Program.
Images used for any purpose not directly related to these terms, must be with the express
permission of Artist and may include the payment of additional fees, unless otherwise agreed to
in writing.
Images may contain copyright management information (CMI) at the discretion of the Artist or
City in the form of either 1) a copyright notice (C) and/or 2) other copyright and ownership
information embedded in the metadata or elsewhere, unless otherwise agreed to by the Parties.
Removing and/or altering such information is prohibited and constitutes violation of the Digital
Millennium Copyright Act (DMCA).
Relationship of the Parties: The parties agree that Artist is an independent contractor, and that
neither Artist, nor Artist's employees or contract personnel are, or shall be deemed to be,
employees of City. No agency, partnership, joint venture, or employee-employer relationship is
intended or created by this Agreement. Neither party is authorized to act as agent or bind the
other party except as expressly stated in this Agreement. Artist and the Images or any other
deliverables prepared by Artist shall not be deemed a work for hire as defined under Copyright
Law. All rights granted to City are contractual in nature and are expressly defined by this
Agreement.
Creation: The manner and method of creating any of the Images is solely at the discretion of
Artist and the City has no right to control Artist's manner and method of performance under this
Agreement. Artist will use his/her best efforts to: (a) ensure that the Images conform to City's
specifications; and (b) submit all Images to City in publishable quality, on or before the
applicable deadlines.
If Artist is not appointed by City as lead artist to paint the Images as a mural, Artist gives
permission for a team of artists, selected solely by the City, to create a mural using the Images.
Artist understands that this team will attempt to closely follow the Images, but that changes
necessary to the success of the mural could be made including, but not limited to, portions of
the Images and colors.
Delivery: Artist may select delivery of Image photographs in JPEG, TIFF, or PNG at a high-quality
resolution (8"x10" at 600 dpi minimum, larger sizes encouraged if possible) either
electronically or via USB drive due at the time this license is signed. It is the City's responsibility
to verify that the Images are suitable for reproduction and that if the Images are not deemed
suitable, to notify the Artist with ten (10) business days of receipt of the Images. Artist's sole
obligation will be to replace the Images at a suitable resolution but in no event will Artist be
liable for poor reproduction quality, delays, or consequential damages.
Artist has no obligation to retain or archive any Images delivered to City.
Fees: All fees and expenses payable under this agreement (one-time fee of $___________) are
to be paid to Artist no later than ten (10) business days from the delivery of the approved
Images; and is payable irrespective of whether City makes actual use of the Images. If full
payment has not been received within thirty (30) days of delivery, all rights are revoked at
Artist's discretion. In the event that rights are revoked, all images in the possession of City will
be removed from all forms of media and permanently destroyed within ten (10) days of
revocation.
Cancellation: If City cancels this Agreement within thirty (30) days of this agreement, City will
pay a twenty-five (25)% cancellation fee. For City cancellation within two (2) days of the
installation date, City is responsible for 100% of the fee.
Exclusivity: This Agreement does not create an exclusive relationship between the parties. City
is free to engage others to perform services of a similar nature to those provided by Artist, and
Artist shall be entitled to offer and provide services to others, solicit other Citys and otherwise
advertise the services offered by Artist.
Territory: Artist may not create the same mural using the Images specified in this Agreement
within 100 miles of the assigned mural location in the City of Centerville, Ohio.
Transfer and Assignment: City may not assign or transfer this agreement or any rights granted
under it. No amendment or waiver of any terms is binding unless in writing and signed by the
parties. However, the invoice may reflect, and City is bound by authorizations that could not be
confirmed in writing because of insufficient time or other practical considerations.
Indemnification: Artist will indemnify and defend City against all claims, liability, damages,
costs, and expenses, including reasonable legal fees and expenses, arising out of the creation or
any use of the Images or materials furnished by Artist. It is the City's responsibility to obtain the
necessary model or property releases and to ensured that any such releases are in full effect
and force.
General Law: This Agreement sets forth the entire understanding of the parties and supersedes
all prior agreements between the parties. This Agreement shall be governed, interpreted and
enforced in accordance with the laws of the State of Ohio. Any claim or litigation arising out of
this Agreement or its performance may be commenced only in courts physically located in
Montgomery County, Ohio, and the parties hereby consent to the personal jurisdiction of such
courts. In the event of any litigation arising out of or relating to this Agreement, the prevailing
party shall be entitled to recover its attorneys' fees incurred in the litigation.
Severability: If one or more of the provisions in the Agreement is found invalid, illegal or
unenforceable in any respect, the validity and enforceability of the remaining provisions shall
not be affected. Any such provisions will be revised as required to make them enforceable.
Waiver: No action of either party, other than in writing agreed to by the parties, may be
construed to waive any provision of this Agreement and a single or partial exercise by either
party of any such action will not preclude further exercise of other rights or remedies in this
Agreement.

executed as of the dates written below.
