Contractor awarded this work will be responsible for complying with all local, state, and
federal regulations pertaining to this project including the State of Illinois requirements
relating to prevailing wage and preference to citizens on public works. Project is also
subject to IMPACT Agreement Conditions.
The City of Rock Island reserves the right to determine the lowest responsive and
responsible bidder; to waive irregularities, and to reject any or all bids. Neither Owner
nor Engineer will be responsible for full or partial sets of Bidding Documents, including
Addenda if any, obtained from sources other than the issuing office. Bids received from
bidders not on the Plan Holders List may not be considered.

SPECIAL PROVISIONS
SP-1. GENERAL
The following Special Provisions supplement: the "Standard Specifications for Road &
Bridge Construction," adopted April 1, 2022; the "Supplemental Specifications &
Recurring Special Provisions," adopted January 1, 2026 (as indicated on the check
sheet included herein); the "City of Rock Island Construction Standards", adopted
January 2023, and "Standard Specifications for Water and Sewer Main
Construction in Illinois", adopted July, 2020; and the last revision of the "City of
Rock Island Plumbing Code". The special provisions included herein apply to and
govern the proposed improvement designated as:
40th Street West
Road Construction
City Job No. 2887- Phase 2
In case of conflict with any part or parts of said specifications, said special provisions
shall take precedent and shall govern.
Construction of the sanitary sewer and water main extension shall be completed by
November 25, 2026. Liquidated damages shall be assessed to the Contractor in
accordance with Article 108 of the Standard Specifications for any construction work
that remains uncompleted after the above stated deadline.
All related paper work (including change orders, time and materials force accounts and
final quantities) should be completed and submitted to the Engineer no later than
March 1, 2027 with the completion of all construction. Liquidated damages shall be
assessed to the Contractor in accordance with Article 108 of the Standard
Specifications for any work or related paper work that remains uncompleted after the
above stated deadline.
SP-2. EQUAL EMPLOYMENT OPPORTUNITY POLICY
Federal and State laws prohibit discrimination against any employee or applicant for
employment because of race, creed, color, national origin, sex, political affiliation, age
and physical or mental handicap unrelated to ability. They further require elimination of
discrimination in employment with regards to upgrading, demotion, transfer, recruitment,
advertising, layoff, termination, rates of pay, forms of compensation, selection for
training (including apprenticeship) of employees, as well as any other personnel actions.
A. The Contractor agrees to post Equal Employment Opportunity notices in
conspicuous places (e.g. at company headquarters, around time clocks, at
work sites, on company bulletin boards, in lunchrooms) available to
employees and applicants for employment.

B. The Contractor shall in all solicitation or advertisements for employees to
be hired under this contract state that all qualified applicants will receive
consideration for employment without regard to race, color, creed, religion,
sex, national origin, political affiliation, or age.
SP-3. IL LAWS RELATING TO PREVAILING WAGE, CERTIFIED MONTHLY PAYROLL &
PREFERENCE TO ILLINOIS CITIZENS
A. Illinois Prevailing Wage Act: This contract calls for the construction of a
"public work," within the meaning of the Illinois Prevailing Wage Act, 820 ILCS
130/.01 et seq. ("the Act"); and as amended, except where a prevailing wage
violates a federal law, order, or ruling, the rate conforming to the federal law,
order, or ruling shall govern. The Act requires contractors and subcontractors
to pay laborers, workers and mechanics performing services on public works
projects no less than the "prevailing rate of wages" (hourly cash wages plus
fringe benefits) in the county where the work is performed. For information
regarding current prevailing wage rates, please refer to the Illinois
Department of Labor's website at:

All contractors and subcontractors rendering services under this contract
must comply with all requirements of the Act, including but not limited to, all
wage, notice and record keeping duties. The scale of wages shall be posted
by the Contractor in prominent and easily accessible places at the site of
work. If the Department of Labor revises the wage rates, the revised rate
shall apply to this contract and the contractor or subcontractor will not be
allowed additional compensation on account of said revisions. Contractor
shall continually check the scale of wages during the work and update the
posted documents as needed. The monitoring and posting of rates by
contractor and subcontractors shall be included in the contract and not
measured or paid separately.
B. The Contractor and each subcontractor shall "Make and keep, for a period of
not less than 5 years from the date of the last payment on a contract or
subcontract for public works, records of all laborers, mechanics, and other
workers employed by them on the project; the records shall include each
worker's name, address, telephone number when available, last four digits of
the worker's social security number, gender, race, ethnicity, veteran status,
classification or classifications, skill level (such as apprentice or journeyman),
the worker's gross and net wages paid in each pay period, the number of
hours worked each day, and the starting and ending times of work each day,
the worker's hourly wage rate, the worker's hourly overtime wage rate, the
worker's hourly fringe benefit rates, the name and address of each fringe

benefit fund, the plan sponsor of each fringe benefit, if applicable, and the
plan administrator of each fringe benefit, if applicable."
The Illinois Department of Labor maintains a database for certified payrolls as
created under Section 5.1 of the Act. All Contractor and Subcontractor
certified payrolls shall be submitted to the Illinois Department of Labor, except
for projects done by State agencies that opt to have contractors submit
certified payrolls directly to that State agency. A State agency that opts to
directly receive certified payrolls must submit the required information in a
specified electronic format to the Department of Labor no later than 10 days
after the certified payroll was filed with the State agency.
Per Section 5.1 of the Act, the Department of Labor rather than the public
body in charge of the project shall keep the records and maintain the
database. The records submitted for workers shall be considered public
records, except an employee's address, telephone number, social security
number, race, ethnicity, and gender, and made available in accordance with
the Freedom of Information Act. The public body shall accept any reasonable
submissions by the contractor that meet the requirements of the Act in the
interim period. A contractor, subcontractor, or public body may retain records
required under the Act in paper or electronic format.
Per Section 5.1 of the Act, and prior to the City making payment, "all
contractors and subcontractors rendering services under this contract shall no
later than the fifteenth day of each calendar month" file the required certified
payroll using Illinois Department of Labor (IDOL) Forms IL452CM01 and
IL452CM02 for the work completed in the immediately preceding month with
the public body in charge of the project. Certified payroll using IDOL forms
must be filed for only those calendar months during which construction has
occurred. The certified payroll shall consist of a complete copy of the records
identified above, but may exclude the starting and ending times of work each
day.
The certified payroll shall be accompanied by a statement signed by the
Contractor or subcontractor or an officer, employee, or agent of the
Contractor or subcontractor which avers that: (i) he or she has examined the
certified payroll records required to be submitted by the Act and such records
are true and accurate; (ii) the hourly rate paid to each worker is not less than
the general prevailing rate of hourly wages required by this Act; and (iii) the
contractor or subcontractor is aware that filing a certified payroll that he or she
knows to be false is a Class A misdemeanor. The submittal of and all
additional requests for a certified payroll shall be included in the contract and
not measured or paid separately.
C. Illinois Preference Act: Whenever there is a period of excessive
unemployment in Illinois, which is defined herein as any month immediately

following two (2) consecutive calendar months during which the level on
unemployment in the State of Illinois has exceeded 5% as measured by the
United States Bureau of Labor Statistics in its monthly publication of
employment and unemployment figures, the Contractor shall employ at least
90% Illinois laborers. "Illinois laborer" means any person who has resided in
Illinois for at least thirty-days (30) and intends to remain an Illinois resident.
Other laborers may be used when Illinois laborers as defined herein are not
available, or are incapable of performing the particular type of work involved,
if so certified by the Contractor and approved by the Engineer. The
Contractor may place no more than three (3) of his regularly employed non-
resident executives and technical experts, who do not qualify as Illinois
laborers, to do work encompassed by the Contract during periods of
excessive unemployment.
SP-4. INSURANCE
The Contractor shall obtain and keep in force the insurance coverage specified in Article
107.27 of the Standard Specifications. Insurance coverage shall name the City of Rock
Island, its officers and employees as additional insured with respect to the liability
coverage. Certified copies of the original policies, or certificate(s) of insurance, by the
insurer(s) issuing the policies and endorsements shall be submitted to the City prior to
the beginning of the work. No additional compensation shall be measured or paid for
the insurance described. All costs for insurance specified in Article 107.27 shall be
included in the contract and not measured or paid separately.
SP-5. CITY OF ROCK ISLAND ORDINANCE CONCERNING RESPONSIBLE BIDDERS
In addition to all other labor requirements set forth in these Special Provisions, and the
Standard Specification for Road and Bridge Construction during the performance of this
contract, the Contractor for itself, its assignees, and successors in interest (hereinafter
referred to as the "Contractor") will provide all attachments and certifications required.
Information, attachments, and notarized signatures shall be provided by the Contractor
and be on-file at the Office of the City Engineer prior to bid proposal submission on the
application form titled: "Contractor Application For Responsible Bidder Requirements
(City Code Chapter 13)". The information, attachments, and applicable expiration dates
for items in the application should be current and provided such that a common
application might generally be used on multiple Rock Island public works projects within
a calendar year.
The choice and use of subcontractors is at the discretion of the Contractor. City of Rock
Island cannot dictate who a subcontractor might be or when to use one. Legal
restrictions may exist for specific subcontractors as being banned or barred from public
