INFORMATION FOR BIDDERS
RECEIPT AND OPENING OF BIDS
The City of Sevierville, Tennessee (herein called the "Owner") invites bids on the form(s)
attached hereto for STREET PAVING AND MAINTENANCE. The Owner will RECEIVE BIDS UNTIL 3:00PM,
JUNE 3, 2026, at Sevierville City Hall, 120 Gary Wade Boulevard, Sevierville, Tennessee, 37862, (Mailing
address: P.O. Box 5500, Sevierville, Tennessee, 37864-5500). Bids will then be publicly opened and read
aloud at Sevierville City Hall, 120 Gary Wade Boulevard, Sevierville, Tennessee. The envelope containing
the bid must be sealed, addressed to Tracy Baker, Assistant City Administrator, and must bear the
following information:

Each bidder shall submit three (3) copies of the completed bid packet.
The Owner may consider informal any bid not prepared and submitted in accordance with the
provisions hereof and may waive any informality or reject any and all bids. Any bid received after the
time and date specified shall not be considered.
QUALIFICATIONS OF BIDDERS
The Owner may make such investigations as he/she deems necessary to determine the ability of
the Bidder to supply the necessary equipment, and the Bidder shall furnish to the Owner all such
information and data for the purpose as the Owner may request. The Owner reserves the right to reject
any bid if the evidence submitted by, or investigation of, such Bidder fails to satisfy the Owner that such
Bidder is properly qualified to carry out the obligation of the contract. Conditional bids will not be
accepted.
METHOD OF AWARD - LOWEST QUALIFIED BIDDER
If at the time this contract is to be awarded the lowest base bid submitted by a responsible
Bidder does not exceed the amount of funds, then estimated by the Owner as available to finance the
contract; the contract will be awarded on the bid. If such bid exceeds such amount, the Owner may
reject all bids or may award the contract with the lowest bid with such deductible alternatives to
produce a net amount, which is within the available funds.
Multiple awards may be made from this contract. Awards will be based on the low evaluated
Bidder per schedule.
The Owner reserves the right to determine the low Bidder by durability and maintenance costs
over the life of the product. This may be done by means of experience or research. Initial cost may not
determine low bid. In case of error or discrepancy in the mathematics of the bid price, the unit prices
shall prevail.

QUANTITIES AND LENGTH OF CONTRACT
This is a yearly contract at unit prices. Exact quantities may vary-estimated quantities
contained in the bid form are for evaluation purposes only.
This contract is for an approximate one (1) year period from the date of award to June 30, 2027,
and may be renewed on an annual basis for two (2) additional years if all terms, conditions, and prices
remain unchanged and both parties are in written agreement. Prices contained herein are to be firm for
the term of the contract except for any changes in the TDOT Liquid Asphalt index that would result in a
price adjustment. The Owner reserves the right to re-bid anytime during the term of the contract.
OBLIGATION OF BIDDERS
At the time of the opening of bids, each Bidder will be presumed to have read and to be
thoroughly familiar with the specifications. The failure or omission of any Bidder to examine all the
forms, instruments, and documents shall in no way relieve the Bidder from any obligation in respect to
his/her bid.
Each bidder is requested to fill out and return the attached Title VI Information sheet, Affidavit
Regarding Drug-Free Workplace Program, vendor sheet, and W-9 form as a part of the bid package.
VENDOR INFORMATION
Adequate vendor information shall be included with the bid for determination of meeting the
specifications. Any exceptions shall be explained in writing and submitted as a part of the bid package.
SHIPPING/DELIVERY
Delivery shall be FOB Sevierville. Materials to be delivered to any designated street and/or City-
owned facility within the Sevierville City Corporate Limits. Any and all shipping and/or handling charges
to be included in lump sum total bid price.
PAST EXPERIENCE
Unless a current contract holder with the Owner, Bidders shall supply a list of all customers for
which they have done similar work within the past twelve (12) months. The list shall include the name of
a contact person and his/her telephone number. Other more specific information may be required
under each Schedule.
STORAGE OF EQUIPMENT
The successful Bidder will be responsible for providing a storage area for materials and
equipment. City of Sevierville property or street rights-of-way shall not be used unless approved by
Owner's representative prior to storage.
TIME LIMITS FOR STARTING AND COMPLETING WORK
As individual projects are determined the Owner will submit them to the contractor and work
duration will be mutually established. Once duration is established and the contractor is authorized to
begin, there will be a three (3) week maximum time limit for the contractor to begin and the pre-
established duration to be completed. If the beginning of work is delayed beyond the three (3) week
limit, the Owner has the right to seek another qualified contractor to complete the work and any cost
exceeding the bid prices will be the responsibility of the successful Bidder.
Some streets to be resurfaced may require coordination with utilities and/or other construction
projects, etc. Forty-eight (48) hour notification by the contractor to the City is required to allow for
proper scheduling of these streets.

LICENSING AND CERTIFICATIONS
The successful Bidder must be a licensed contractor as required by the "CONTRACTOR'S
LICENSING ACT OF 1976", and as passed by the 89th General Assembly of the State of Tennessee and as
amended in succeeding Assemblies. The Contractor shall have the proper classifications of license as
listed in the Rules of Tennessee Board for Licensing General Contractors-Chapter 0680-1.
Bidders must submit proof of licensing as part of the bid and must demonstrate sufficient
qualifications and experience in the type of work specified and will be required to meet all federal, state,
and local requirements for construction.
IRAN DIVESTMENT ACT
By submission of this bid, each bidder and each person signing on behalf of any bidder certifies,
and in the case of a joint bid each party thereto certifies as to its own organization, under penalty of
perjury, that to the best of its knowledge and belief that each bidder is not on the list created pursuant
to Tennessee Code Annotated 12-12-106.
INSURANCE COVERAGE REQUIREMENTS
These coverage requirements apply to the Contractor and any Sub-Contractors who may
perform services on this project.
Commercial General Liability Insurance with policy limits of not less than one million dollars
($1,000,000) per occurrence for property damage and bodily injury, including product liability,
contractual liability, and completed operations liability.
Automobile Liability Insurance with policy limits of not less than one million dollars ($1,000,000)
per occurrence for bodily injury and property damage, including owned, hired and non-owned
vehicle coverage.
Workers' Compensation at statutory limits as required by Tennessee law.
Employers' Liability Insurance with policy limits of no less than ($1,000,000) per occurrence.
CONDITIONS FOR ALL COVERAGES
Additional Insured: The City of Sevierville, its Board of Mayor and Aldermen, officers, employees,
agents, representatives, boards, commissions, committees, and volunteers (hereinafter referred to as
Owner) are to be covered as additional insured with respect to liability arising out of activities
performed by or on behalf of the Contractor; products and completed operations of the Contractor;
premises owned, leased or used by the Contractor or premises on which Contractor is performing
services on behalf of the Owner. The coverage shall contain no special limitations on the scope of
protection afforded to the Owner.
Notice of Cancellation or Non-renewal: Each insurance policy required by this clause shall be
endorsed to state that coverage shall not be suspended, voided, cancelled, reduced in coverage or in
limits except after thirty (30) days prior written notice has been given to the Department Head granting
this bid and/or to the Risk Manager for the Owner.
Acceptability of Insurers: Insurance is to be placed with financially sound Tennessee admitted
insurers (Best's rating of A or better) or approved by Owner's Risk Manager. City of Sevierville Risk

Certificates of Insurance: Contractor shall furnish the Owner with certificates of insurance with
original endorsements affecting coverage required by this clause. The certificates and endorsements for
each policy are to be signed by a person authorized by that insurer to bind coverage on its behalf. The
certificates and endorsements are to be received and approved by the Owner before work commences.
Defense, Indemnification and Hold Harmless Agreement: Contractor hereby agrees to
indemnify, defend and hold harmless the Owner from any and all loss, damage, cost, expense, liability,
claims, demands, suits, attorney's fees and judgments arising directly or indirectly from or in any
manner related to the work, project, event or other purposes in connection with the Contractor's
performance or failure to perform under the terms of this contract, regardless of the active or passive
nature of any negligence by the Owner, except as otherwise expressly stated herein. Contractor shall
not be responsible when such liability arises from the sole negligence of the Owner. Contractor shall
pay Owner for any costs incurred in enforcing this provision.
Utility Location: Contractor shall be responsible for performing utility location requirements by
calling Tennessee One-Call service and any other applicable utility services. Contractor shall be
responsible for all damage to any and all utilities.
TENNESSEE DRUG POLICY REQUIREMENTS FOR CONSTRUCTION CONTRACTS
The following requirement applies to all construction contract bidders having 5 or more
employees. Bidder is required to include in bid an affidavit attesting that effective no later than bid date,
bidder operates a drug-free workplace program that complies with the requirements of Tennessee Code
Annotated Section 50-9-101 through 50-9-114 OR a program at least as stringent as the program
operated by the City of Sevierville.
The following requirement applies to all construction contract bidders having 5 or more
employees. Bidder is required to include in bid an affidavit attesting that effective no later than bid date,
bidder operates a drug-free workplace program that complies with the requirements of Tennessee Code
Annotated Section 50-9-101 through 50-9-114 OR a program at least as stringent as the program
operated by the City of Sevierville.
The City of Sevierville operates a drug-free workplace that complies with the above-referenced
law. The City of Sevierville performs drug or alcohol tests at the following times: a. Job Application b.
Reasonable Suspicion c. post-accident d. Routine Fitness for Duty e. Follow-up f. Random. All testing
and specimen-handling procedures conform to the standards of the U.S. Department of Transportation
guidelines. A Medical Review Officer (MRO) provides medical oversight to assure appropriate
processing and accurate interpretation of the results. Failure to submit to substance abuse testing or
testing positive for prohibited drugs and/or alcohol may result in discipline up to and including
termination.

GENERAL SPECIFICATIONS (FOR ALL SCHEDULES)
The unit prices bid for the items listed in each schedule shall include all associated costs,
including but not limited to preparation work, clean-up, and traffic control in accordance with
appropriate sections of the Tennessee Department of Transportation Standard Specifications for Road
and Bridge Construction (2021) or latest edition, and traffic control in accordance with the Part VI of the
Manual on Uniform Traffic Control Devices (2009) or latest edition as directed by the Owner. The
Successful Bidder shall be responsible for ensuring a safe work zone for the travelling public. It would be
preferable that work on or adjoining Major and Minor Arterials as well as Major Collector Roads be
performed during nighttime hours if possible. If it is not performed during nighttime hours, working
hours on these streets may be limited to non-rush hour times. At least 48 hours' advanced notice shall
be submitted for approval to the owner's representative. Failure to maintain MUTCD compliant traffic
control shall be caused to stop the work until acceptable traffic control is installed and verified by the
owner's on-site representative. If the contractor is unable to install acceptable traffic control, the owner
may find it necessary to employ traffic control outside of this contract to ensure the safety of the
motoring public. Any costs associated with this will be deducted from monies due to the contractor on
the next pay request. Failure to supply the job with sufficient equipment to perform work in an
expeditious manner, in the opinion of the owner's representative, shall be caused to suspend work until
a time that sufficient equipment is supplied. Any equipment necessary to be supplied by the city will be
charged against monies due to the contractor and will be deducted on the next pay request.
CONTRACT SECTIONS
This contract will be subdivided into sections, or schedules, to differentiate work types.
Schedule I will be awarded as a whole to one contractor based on lowest total price. All other schedules
may be awarded by item. Contractors do not have to bid on all items to be considered, except for
schedule 1, which must have bids for all items to be considered. The schedules shall be as follows:
Schedule I - Asphaltic Concrete Paving
Schedule II - Asphaltic Concrete Purchase
Schedule III - Pavement Preservation
Schedule IV - Street Reconstruction
Schedule V - Street Repair
Schedule VI - Safety Items
SCHEDULE I - PAVING SPECIFICATIONS
Schedule I of this contract will include work performed by the successful Bidder in accordance
with the specifications herein on any or all city streets, parking lots, walking trails, or golf cart paths.
Asphalt paving will consist of the placing of asphaltic concrete pavement in accordance with Sections
407 and 411 of the Tennessee Department of Transportation Standard Specifications for Road and
Bridge Construction (2021) or latest edition.
Asphalt pavement placed on walking trails and golf cart paths will be placed in two (2) inch lift
and eight (8) feet wide (minimum) on base prepared by the Owner. Trails/paths may require finish
grading to be included in bid price. Tandem dump trucks used in hauling asphalt to the trails/paths shall
be loaded with no more than fifteen (15) tons of asphalt.
Lap joints shall not be permitted on any streets. The contractor shall furnish the necessary
equipment on the project to eliminate lap jointing of the pavement.

Handwork associated with leveling the asphalt around the manholes, valve boxes, or catch
basins shall be included with the Utility Riser line item and not included with asphalt unit price.
Tack Coat for Pavement Overlay shall be Asphalt Cement or Emulsified Asphalt meeting the
requirements of Section 403 of the Tennessee Department of Transportation Standard Specifications for
Road and Bridge Construction (2021) or latest edition.
Payment will be placed on a tonnage basis and weigh tickets will be turned over to and accepted
by the Owner's representative on the site. No work will be performed unless a representative of the
Owner is present. All asphaltic concrete shall be grade PG-64-22, minimum.
PRICE ADJUSTMENT FOR BITUMINOUS PAVING MATERIAL
This section covers the method of price adjustment for bituminous materials. The "Basic
Bituminous Material Index" as established by the Tennessee Department of Transportation will be used
to compensate for increases and decreases in the contractor's bituminous material cost. This index may
be found at the following website:

The "Basic Bituminous Material Index" for this contract will be the Index established by TDOT for the
month of May 2026.
The "Monthly Bituminous Adjustment Factor" shall be applied to the contract unit price bid
provided the increase or decrease differs five (5) percent or more from the "Basic Bituminous Material
Index." The Owner reserves the right to alter the quantities of material or modify the design if the
change in prices warrants material or design substitution. If adjustments are made in quantities or
design, the contractor shall accept the unit price bid or the applicable monthly-adjusted unit prices as
full compensation for all work performed in accordance with this contract.
The adjustment will be calculated in accordance with the following formula only when the
percent change of price indexes is five (5) or greater:

Where: PA= Price Adjustment for Adjustment Month (July 2017, etc.)
Ib = Base Bituminous Material Index (June 2017)
Ic = Monthly Bituminous Material Index (July 2017, etc.)
T* = Tons of bituminous material for Adjustment Month (July 2017, etc.)
* This number will be calculated by using the assumptions below of percent of bituminous
material times the number of tons purchased during the month.
Grading D = 6.0% (six percent)
Grading E = 6.0% (six percent)
Grading B = 4.3% (four. three percent)
Grading B Mod. = 5.0 (five percent)
SCHEDULE I - FIBER ADDITIVE FOR FIBER ENTRAINED ASPHALTIC CONCRETE SPECIFICATIONS
PART 1 - GENERAL
1.1 SECTION REQUIREMENTS
A. Related Documents: Drawings and general provisions of the Contract, including Division 1
Specification Sections and the Geotechnical Engineering Report, apply to this Section.

B. Provide hot-mix asphalt (HMA) paving materials according to Geotechnical Engineering Report
and standard specifications of department of transportation of state or local agency where
project is located.
C. Provide pavement marking prior to Substantial Completion and subsequent reapplication of
pavement marking six (6) months after store opening date.
D. Comply with Asphalt Institute publication MS-22, "Construction of Hot Mix Asphalt Pavements"
unless more stringent requirements are indicated.
E. As required by the Engineer of Record or if indicated on approved plans or specifications,
Contractor shall retain a qualified testing firm for the purpose of providing Quality Control to
evaluate that actual products incorporated into the Work and completed construction
substantially comply with construction documents.
1.2 SUBMITTALS
A. Provide product data and hot-mix asphalt design mixes for all pavement materials proposed for
use on the project for review by the Architect, Civil Engineer and the Geotechnical Engineer of
Record at least 30 days prior to beginning asphalt paving operations.
B. Provided the following information for hot-mix asphalt:
1. Design method; Superpave mixed based on ___ gyrations; Marshall method by 50
or 75 blows per side. Mix design compaction effort shall be determined by pavement
traffic level and local specifications.
2. Name of supplier, identification name/number for mix.
3. Source and grade of asphalt cement binder and any modifiers
4. Source and description of aggregates and mineral fillers
5. Gradation and bulk specific gravity of each aggregate bin size
6. Percentage of each bin size used in the mix; combined aggregate gradation; and
combined bulk specific gravity.
7. Aggregate quality test results for all aggregates used in the mix.
8. Plotted mix property curves showing the following mix properties for at least four
(4) levels of asphalt cement content: unit weight; percent air voids; percent voids filled
(VFA); and percent voids in mineral aggregates (VMA).
9. Recommended asphalt cement content for the mix.

C. Provide the following information for aramid fiber reinforcement:
1. Identify the mixing plant and type (batch or continuous drum).
2. Material data sheet for the treated aramid fiber describing aramid fiber and treatment
properties, including the type, weight, and flash point of treatment material.
3. A certified QA/QC mixing plan including procedures for continuously feeding the aramid
fiber into the asphalt. The aramid fiber supplier must approve the QA/QC mixing plan of
the asphalt plant producing the mix. In addition, the fiber supplier shall provide training to
the asphalt producing plant personnel who are responsible for the continuous feeding of
the aramid fiber into the HMA. Feeding can be accomplished by using either manual or
machine operated equipment for the entire fiber mixing process but shall be done in a
continuous flow-like manner.

1.3 QUALITY ASSURANCE
A. Owner will retain an independent testing firm for the purpose of providing Quality Assurance
testing and inspection of paving materials, placement and compaction.
B. Pre-Paving Meeting: Convene a meeting at the site at least two weeks prior to commencing
work of this Section. Require attendance of parties directly affecting work of this Section,
including, but not limited to, the Owner's representative, Contractor, paving sub-contractor and
job foreman, and independent testing firm.

1. Contact Field Construction Manager three weeks prior to pre installation conference to
confirm schedule.
2. Record discussions of meetings and decisions and agreements (or disagreements)
reached and furnish copies of record to each party attending. Review foreseeable
methods and procedures related to paving work, including the following:
a. Review preparation and installation procedures and coordinating and scheduling
required with related work.
b. Review proposed sources of paving materials, including capabilities and location
of plant that will manufacture hot-mix asphalt.
c. Tour, inspect and discuss condition of subgrade, drainage structures, and other
preparatory work.
d. Review requirements for protecting paving work, including restriction of traffic
during installation period and for remainder of construction period.
e. Review and finalize construction schedule and verify availability of materials,
installer's personnel, equipment, and facilities needed to make progress and
avoid delays.
f. Review paving requirements (drawings, specifications and other contract
documents).
g. Review required submittals, both completed and yet to be completed.
h. Review required inspections, testing procedures.
i. Review weather and forecasted weather conditions, and procedures for coping
with unfavorable conditions.
j. Review safety precautions relating to placement of paving
1.4 WEATHER LIMITATIONS
A. Comply with department of transportation specifications weather condition limitations for
placement of paving materials including tack coats.
B. When weather conditions are not met, do not proceed without prior approval of Field
Construction Manager.
