1. Address bids to City of Garden City, Public Works, P.O. Box 998, Garden City, Kansas 67846 on or before 10:00 a.m., Tuesday, January 13, 2026. Mark on the outside of envelope: CRACK SEALING BID.
2. Bids will be opened publicly by the City Manager or his official representative. All bids must be submitted prior to the bid opening time to qualify.
3. After the bids are opened, each will be carefully reviewed. Generally, a decision as to who the best bidder is will be made within 24 hours after the bids are opened.
4. The City of Garden City reserves the right to reject any and all bids.
5. A responsible officer or employee of the company must sign all bids. Obligations assumed by such signature must be fulfilled.
6. Starting time is part of the consideration and must be stated.
7. Verify your bids before submitting them. Bids cannot be withdrawn or corrected after being opened.
8. The City is exempt from applicable state and local tax.
9. All bids are to be F.O.B. Garden City, Kansas, unless otherwise stated.
10. All bids must meet the MINIMUM SPECIFICATIONS. Any bid, which fails to do so, will not be subject to acceptance.
11. Materials shall be of good commercial quality for the intended service and shall be produced by use of current manufacturing processes.
12. The bidder shall list on a separate sheet of paper any variations from, or exceptions to, the conditions and specifications of this bid. This sheet is labeled "Exception(s) to Bid Conditions and Specifications", and shall be attached to the BID.

14. Awards will be made to the lowest responsible bidder.
15. Notwithstanding any references in the specifications to any article, device, product or material by name or make, such references shall be interpreted as establishing a standard of quality and shall not be construed as limiting competition.
16. Included in the bid package is a map, which shows the designated streets to be crack-sealed for this project unless otherwise stated.
