Sole Source - Mitigation Bank Credit - LD 25

The U.S. Army Corps of Engineers, St. Louis District, intends to solicit and negotiate with only one source for the procurement of Mitigation Bank Credits in the area of Lock & Dam 25 in support of the construction of the NESP Lock & Dam 25 New 1,200 ft Chamber, under the authority of FAR 6.302-1.

Section 1163 of WRDA 2016 and subsequent USACE Implementation Guidance provides guidance on the use of mitigation banks and in-lieu fee programs for mitigation for water resource development projects. As outlined in the Implementation Guidance, USACE shall consider the use of available and potential in-kind credits from mitigation banks and in­lieu fee programs as compensatory mitigation for unavoidable impacts to wetlands and other habitats resulting from the construction of a water resources development project.
