General Notice
The City of Lowell, MA (Owner) is requesting Bids for the construction of the following Project:
Phase 3A Sewer System Separation Project - Lower Saunders
Bid Number: IFB 26-48
Sealed bids will be received at the Office of the Lowell City Hall Purchasing Department, 375 Merrimack
Street, Room 60, Lowell, MA 01852, until April 22, 2026 at 11:00 AM local time. At that time the Bids
received will be publicly opened and read.
The Project includes the following Work:
The scope of this project is generally referred to as the Lowell Phase 3A Sewer System
Separation Project - Lower Saunders. The Project consists of the construction of new storm
drain pipe for the purpose of sewer system separation within the catchment area referred to as
Lower Saunders as shown on the Contract Drawings, the removal and replacement of water
mains and portions of water service laterals within the Lower Saunders area, the removal and
installation of new catch basins, the redirection of select catch basins, sewer cured-in-place
pipeline (CIPP) rehabilitation, rehabilitation of sewer manholes, and spray-in-place pipelining
(SIPP) of the Marginal Interceptor as shown on the Contract Drawings. This project will involve
utility coordination for utility supports and replacements/relocations. This project requires
paving and restoration of the project area to original condition.
Bids are requested for the following Contract: Phase 3A Sewer System Separation Project - Lower
Saunders Bid Number: IFB 26-48
The Project has an expected duration of 732 days.

Prospective Bidders are urged to register with the designated website as a plan holder, even if Bidding
Documents are obtained from a plan room or source other than the designated website in either
electronic or paper format. The designated website will be updated periodically with addenda, lists of
registered plan holders, reports, and other information relevant to submitting a Bid for the Project. All
official notifications, addenda, and other Bidding Documents will be offered only through the designated
website. Neither Owner nor Engineer will be responsible for Bidding Documents, including addenda, if
any, obtained from sources other than the designated website.

Pre-bid Conference
A non-mandatory pre-bid conference for the Project will be held on April 1, 2026 at 11:00 AM at the
Owner's office, 451 First St Blvd, Lowell, MA 01850. A site walk will follow at Washington Park, 803
Middlesex St, Lowell, MA 01851. Attendance at the pre-bid conference is encouraged but not required.
Instructions to Bidders
For all further requirements regarding bid submittal, qualifications, procedures, and contract award,
refer to the Instructions to Bidders that are included in the Bidding Documents.
Build American, Buy American Requirements
This project is subject to the Build American, Buy America (BABA) requirements. This project is subject to
the American Iron and Steel requirements of P.L. 113- 76, the Consolidated Appropriations Act of 2014."
BABA and AIS.
Bid Deposit
Each bid proposal must be secured by an accompanying deposit of five percent (5%) of the total bid
amount and submitted in a sealed envelope clearly marked, "PHASE 3A SEWER SYSTEM SEPARATION
PROJECT - LOWER SAUNDERS". The deposit shall be in the form of a Bid Bond, Certified Check, Cashier's
or Treasurer's Check, made payable to the City of Lowell, or cash.
Payment and Performance Bonds
The successful bidder must furnish a Payment Bond and a Performance Bond of an amount equal to One
Hundred (100%) percent of the total Contract Price, issued by a Surety Company, satisfactory to the
Commissioner of Public Works.
Attention to Bidders
Attention of the Bidders is particularly called to the "Equal Opportunity Clause" and the "Standard
Federal Equal Employment Opportunity Construction Contract Specifications" set forth herein.
Attention of the Bidders is particularly called to the requirements of the conditions of employment to be
observed and the prevailing wage rates to be paid on this project, as determined by the State
Department of Labor Division of Occupational Safety.
Note: Bidders must also comply with Certification of Compliance G.L.C. 30 & 39S Public Construction
More Than $10,000.00. See page BP-11.
The City of Lowell, acting through its Chief Procurement Officer, reserves the right to waive any
informality in, to reject any or all bids or to accept the one which appears in the best interest of the City
of Lowell.
The Project is to be funded in part by the Massachusetts Clean Water Trust (the "Trust"). The bidding
and award of this Contract will be under the provisions of M.G.L. 30, Section 39M of the General Laws of
the Commonwealth of Massachusetts as last revised.
The Project requires compliance with the Department of Environmental Protection's Diesel Retrofit
Program.

Procurement Considerations
Procurement Considerations - Six Good Faith Efforts. 40 CFR, Part 33, Subpart C: Pursuant to 40 CFR
Section 33.301, the sub-recipient agrees to make good faith efforts whenever procuring construction,
equipment, services, and supplies under an EPA financial assistance agreement, and to require that sub-
recipients, loan recipients, and prime contractors also comply. Records documenting compliance with
the six good faith efforts shall be retained. The specific six good faith efforts can be found at: 40 CFR
Section 33.301 (a)-(f)."
Minimum Wage Rate Requirements
Minimum Wage Rates as determined by the Executive Office of Labor and Workforce Development
under the provision of the Massachusetts General Laws, Chapter 149, Sections 26 to 27D, as amended,
apply to this project. It is the responsibility of the contractor, before bid opening, to request, if
necessary, any additional information on Minimum Wage Rates for those trades people who may be
employed for the proposed work under this contract. Federal Minimum Wage Rates as determined by
the United States Department of Labor under the Davis-Bacon Act also apply to this project.
