SECTION A: INSTRUCTIONS TO BIDDERS
INVITATION TO BID
In accordance with competitive bid requirements set forth under RCW 39.04.155, Small Works
Contract Procedures, the City of Port Townsend invites interested bidders to submit a bid for
this solicitation. Contractors who bid on this project must be registered on the Small Works
Roster by the time bids are due, for San Juan Avenue Rehabilitation up to the hour of 2:00
p.m., Pacific Local Time, Wednesday, May 27, 2026, and will be publicly opened and read aloud
at that time on the same day in the Port Townsend City Hall, 250 Madison St, Suite 1, Port
Townsend, Washington in the second-floor conference room.
The Contract includes, but is not limited to, the following work: traffic control; roadway
surveying; pulverizing existing asphalt pavement and existing base material; mixing and
stabilizing the pulverized material with, cement to construct cement-treated base (CTB);
roadway excavation, grading, shaping, and compacting subgrade; placing crushed surfacing;
additional grading in preparation for chip seal; protection of existing utilities; removal and
replacement of water valve boxes; final site cleanup; and other work, all in accordance with
the Contract Plans, these Special Provisions, and the Standard Specifications.
The Engineer's Estimate is $310,000
Plans, specifications, addenda, and plan holders list for this project will be available on-line
through City of Port Townsend's website at www.cityofpt.us/rfps. Please contact City of Port
Townsend Front Desk (360)-385-3000 should you require assistance accessing documents
electronically.
The Contract Work shall be Physically Complete within 7 Working Days from the Notice to
Proceed.
The City of Port Townsend, in accordance with the provisions of Title VI of the Civil Rights Act
of 1964 (78 Stat. 252, 42 U.S.C. 2000d to 2000d-4) and associated Regulations, hereby notifies
all bidders that it will affirmatively ensure that in any contract entered into pursuant to this
advertisement, disadvantaged business enterprises will be afforded full and fair opportunity
to submit bids in response to this invitation and will not be discriminated against on the
grounds of race, color, or national origin in consideration for an award.
CONTRACT DOCUMENT ORGANIZATION AND ORDER OF PRECEDENCE
The City of Port Townsend thanks you for your interest in this project. The Contract Documents
are based on the 2026 Washington State Department of Transportation ("WSDOT") Standard
Specifications. The Special Provisions provided in Section 1 in this document include WSDOT
and APWA general special provisions (GSP) as well as project specific specifications required
by the City of Port Townsend as needed to detail the work. Refer to Special Provision 1-04.2
for the order of precedence of the components of the Contract Documents.

SUBMITTAL INSTRUCTIONS
Bids shall be in accordance with the Plans, Specifications, General Conditions, Special
Provisions and all other contract documents prepared for the above referenced project, on
file.
Bids must be submitted in the form and at the location and time as identified in the invitation
to bid and on the bid forms provided for this purpose. The outside of envelope(s) or
package(s) must clearly state the project name, bidder's name and return address, and the
date and time of the Bid opening.
All Bids must be accompanied by a bid deposit in cashier's check or surety bond in an amount
equal to five percent (5%) of the amount of such bid in accordance with special provision 1-
02.7.
Bids delivered late will not be accepted in accordance with Special Provision 1-02.9.
Bids submitted via EMAIL will be accepted.
Bids will be opened publicly and read in person at the Port Townsend City Hall, 250 Madison
Street, Suite 1, Port Townsend, WA 98368 at the time and date specified. Contractors are
invited to join in person.
No bidder may withdraw their bid after the hour set for the opening in accordance with Special
Provision 1-02.10
The City of Port Townsend, at its sole discretion, reserves the right to cancel this invitation or
reject any and all bids submitted or to waive any minor irregularities and formalities in any
bid if the City determines such action is in the best interests of the City or public.
ADDENDA
All project-specific questions, requests for clarification, and request for substitutions must be
submitted in writing, via email, or by phone in accordance with special provision 1-02.4(1) to
Michael Connelly at mconnelly@cityofpt.us, Phone: 360-531-2761
Addenda (if issued) shall be emailed by the City to all contractors on the solicitation list.
Receipt of addenda shall be acknowledged on the Bid Proposal.
RESPONSIBILITY CRITERIA
It is the intent of the City to award a contract to the lowest responsive and responsible bidder.
In accordance with RCW 39.04.350, before award, the bidder must meet bidder responsibility
criteria outlined below to be considered a responsible bidder.
The bidder may be required to provide the City documentation demonstrating compliance
with the criteria.
Before contract award, the apparent low bidder must meet the mandatory bidder
responsibility criteria per RCW 39.04.350, including but not limited to:

1. Certificate of Registration in compliance with RCW 18.27.
2. Current UBI Number issued by the Washington State Department of Revenue.
3. Not disqualified from bidding under RCW 39.06.010 or RCW 39.12.065(3).
4. If applicable:
1. Industrial insurance coverage under Title 51 RCW,
2. Employment security registration under Title 50 RCW,
3. Excise tax registration under Title 82 RCW.
5. Not out of compliance with apprenticeship requirements under RCW 39.04.320 (if
applicable).
6. Received training on public works and prevailing wage requirements (RCW 39.04 and
RCW 39.12).
7. No willful wage law violations within the past 3 years under RCW 49.46, 49.48, or
49.52.

requirements.
If the City determines the bidder does not meet the bidder responsibility criteria and is
therefore not a responsible bidder, the City shall notify the bidder and follow procedures in
accordance with Special Provision 1-02.14.

SECTION B: TERMS AND CONDITIONS
PREVAILING WAGE REQUIREMENTS
The Work under this Contract shall be paid for by public funds; therefore, the Contractor shall
comply with the Washington State prevailing wage laws (Chapters 39.04, 39.12, 43.19, and 49.38
RCW).
The State of Washington prevailing wage rates applicable for this public works project, which
is located in Jefferson County, may be found at the following website address of the
Department of Labor and Industries: https://secure.lni.wa.gov/wagelookup/rates/journey-
level-rates. Based on the bid submittal deadline for this project, the applicable effective date
for prevailing wages for this project is Friday, May 29, 2026.
The City of Port Townsend does not guarantee that labor can be procured for the minimum
wages shown on the referenced schedules. The rates of wages listed are minimum only, below
which the Contractor cannot pay, and they do not constitute a representation that labor can
be procured for the minimum listed.
RETAINAGE
Payment of the retained percentage shall be withheld, by the City, for a period of 45 days
following the completion of all Contract work, as defined by WSDOT Standard Specs Section 1-
01.3 and Special Provision 1-09.9(1).
CITY BUSINESS AND OCCUPATIONAL LICENSE
The Contractor, at no expense to the City, is responsible for obtaining all necessary licenses,
permits, and similar legal authorizations required to perform the work associated with this
Agreement. The Contractor must hold or obtain a City business license as required by Port
Townsend Municipal Code. The Contractor shall apply for city license via the State of
Washington Department of Revenue (DOR), Business Licensing Services website. For
application assistance, contact DOR BLS at 360-705-6741.
BID AWARD
Once bids are received and reviewed and the City determines the apparent successful bidder,
City staff will prepare a Staff Report for the Contract to be presented to Council for
consideration. Only when Council has voted to formally award this contract will an Award
email be sent as acceptance of the bid. No other act of the City or its staff or agents shall
constitute acceptance of a bid.
Bidders may not alter their bid prices after the hour set for the public Bid Opening, unless the
award of contract is delayed for more than 45 days in accordance with WSDOT Section 1-03.2.
The City reserves the right to request an extension of time for firm bid prices during any such
delay to allow for the review process.

SECTION C: BID SUBMITTAL REQUIREMENTS & PROCEDURES
PHASE 1: BID SUBMITTAL CHECKLIST
The bidder's attention is especially called to the following form, which must be executed in
full as part of the bidder's submittal to be considered a responsive bid. This checklist is
intended as a guide to aid the bidder in including all necessary supporting information in
submitting a bid. It is not guaranteed to be complete or accurate, and the responsibility for
compliance with all bidding requirements remains with the bidder. Items in bold MUST be
submitted with your bid. Failure to do so shall make your bid non-responsive.
BID PROPOSAL FORM
Bids shall be completed and submitted on the bid forms provided. Ensure the bid
proposal form and tabulation (if applicable) is fully filled out and signed.
ADDENDA ACKNOWLEDGEMENT FORM
The bidder must sign, where indicated on the last page of the bid documents,
acknowledgement of any addenda prior to the bid opening. Failure to comply with this
provision will render the bid non-responsive and therefore void.
NON-DISCRIMINATION
Bidder has reviewed and acknowledged the Title VI Non-Discrimination Assurances
included in the Bid Documents.
CERTIFICATION OF COMPLIANCE WITH WAGE PAYMENT STATUSES
Bidders are required to submit a statement verifying that within the three-year period
immediately preceding the date of the bid solicitation, they not have been determined
by a final and binding citation and notice of assessment issued by the Department of
Labor and Industries or through a civil judgement entered by a court of limited or
general jurisdiction to have willfully violated, as defined in RCW 49.48.082, any
provision of Chapters 49.46, 49.48, or 49.52 RCW.
PROPOSAL BOND
Submit a bid bond (executed by bidder and WA-licensed surety) or a cashier's check
for 5% of total bid. The proposal bond form is attached to bid documents. Proposal
bonds are subject to forfeiture if the bidder fails to enter into a contract with the City
to complete the Work.
MRSC SMALL WORKS ROSTER VERIFICATION
Bidder confirms they are currently registered and active on the MRSC Small Works
Roster at the time of bid submittal, in accordance with RCW 39.04.155.
(Failure to be registered at the time bids are due shall render the bid non-responsive.)

BIDDER RESPONSIBILITY CRITERIA DOCUMENTATION
Bidder Responsibility Criteria information may be required of the apparent successful bidder
(lowest responsive, responsible bidder) and must be provided to the City no later than two (2)
days after receipt of the request for such information by the City.
Note: If, during the bidding period prior to the time and date bids are due to the City, a
prospective bidder believes that the Supplemental Bidder Responsibility Criteria will exclude
them from bidding, the bidder may request the City to consider modifying the Criteria. The
request for modifications must be submitted by the question deadline. Such modification, if
accepted by the City, will be communicated via the issuance of an Addendum to the Bidding
Documents.
PHASE 2: CONTRACT AWARD
The following must be signed and/or delivered by the awarded Contractor to the City within
(14) fourteen days after the Award Date.
CONTRACT
This agreement is to be signed by the successful bidder.
PERFORMANCE BOND
This shall be submitted by the successful bidder and a surety company, licensed to do
business within the State of Washington on the approved City of Port Townsend form.
PAYMENT BOND
This shall be submitted by the successful bidder and a surety company, licensed to do
business within the State of Washington on the approved City of Port Townsend form.
INSURANCE CERTIFICATE
The City shall be named as an additional named insured on all insurance policies.
These policies shall comply with the requirements as stated in the Contract.
RETAINAGE BOND (OPTIONAL)
This may be submitted by the successful bidder in accordance with Special Provision
1-09.9 (1).
