The City will receive sealed bids, each unit with a set minimum bid, until 1:30
p.m. May 29th, 2026. At 1:30 p.m. bids will be opened publicly and read aloud
in the Council Chambers. No verbal offers will be accepted. Bid packets may
be obtained from the Community Development Department of City Hall, 111
East Fourth Street, Okmulgee, Oklahoma, beginning May 8, 2026. The City
reserves the right to reject any and all bids. Payment terms are contained in
the bid packet. Sale is not final until approved by the City Council at a future
meeting after May 29th, 2026. If the City offices are closed May 29th, 2026 for
any reason, the bid deadline and opening shall be 1:30 p.m. on the next
business day.

THE PROPERTY
The City of Okmulgee is offering for sale the following real property:
UNIT 7
A vacant parcel located at 820 W 2nd in the City of Okmulgee, Oklahoma.

Minimum Bid: $5000
The Council of the City of Okmulgee has declared this real property to be
surplus and no longer needed for public purposes. Interested parties are
invited to bid on the described property.
The City of Okmulgee reserves the right to reject any and all bids or portions of
any bids. Payment of an amount equal to ten percent (10%) of the bid price in
the form of a cashier's check, money order or other certified funds shall
accompany each bid, as an earnest money deposit. Approval of a successful
bidder will be made at the regular meeting of the City Council on June 16,
2026. The successful bidder will be notified within three (3) business days
following the decision. The City shall convey the property by quitclaim deed
with no abstract, survey, nor warranty as to ownership or adverse interests.
Payment of the balance of the purchase price shall be made prior to the transfer
of ownership of the property, and shall be in the form of a Cashier's Check,
Check, Money Order, or Cash within five (5) business days of notification. If the
successful bidder does not make payment of the funds in the time specified, the
next bidder will be contacted and offered the opportunity to purchase said
property. Earnest money deposits of the unsuccessful bidder shall be returned
to those bidders, upon completion of the sale to the successful bidder. Any
Earnest money by a successful bidder that does not complete transaction with
time of payment specified, will be forfeited to the City of Okmulgee and the next
highest bidder will be contacted for an opportunity to purchase the unit.

INSTRUCTIONS TO BIDDERS
1.01 GENERAL:
No bids will be accepted after 1:30 p.m., May 29, 2026. No verbal offers will be
accepted. To be considered, Bids must be made in accordance with these Bid
Documents. All Bids must be placed in a sealed opaque envelope and labeled
as follows:

In the event that the City is closed on May 29, 2026, the bid deadline and opening shall
be the following business day at 1:30 p.m.
1.02 EXAMINATION:
It is the Bidder's sole responsibility to carefully examine and familiarize him/herself with
all of the requirements of the Bid Documents.
1.03 QUESTIONS:
Should a Bidder find discrepancies in or omissions from the Bid Documents, or be in
doubt as to their meaning, (s)he must notify and request a clarification from the City in
writing. Significant clarification shall be issued to all Bidders of record as Addenda to
the Bid Documents and shall become part of the Contract. The City shall not be
responsible for oral clarification. All Addenda items issued during the time of bidding
shall be covered in the Bid and acknowledged on the Bid Form.
1.04 IDENTIFICATION:
The Bid shall identify the name of the Bidder, the contact person responsible for the Bid,
the address of the Bidder, and the full telephone number.
1.05 MODIFICATION AND WITHDRAWAL:
A. Bids may not be modified after submittal. Bidders may withdraw Bids at any time before
bid opening date upon receipt of written request of the Bidder. No Bid may be withdrawn
or modified after the Bid Opening except where the City has delayed the award of the
Bid/Contract for more than 60 days.
B. Bids shall be made only on the form provided in the Bid Documents. All blank spaces on
the form shall be completed (fully filled out), bids stated both in writing (words) and
numerically, signatures signed in longhand, and form completed without interlineations,
alteration or erasure. Oral, telegraphic or telephonic proposals or modifications shall not
be accepted.
C. Bids shall be delivered to the place designated above, on or before the day and hour set
for the opening of Bids. It is the sole responsibility of the Bidder to deliver the Bids
before the scheduled closing time. Bids received after the scheduled closing time shall be
refused and returned unopened.

D. In the event of a discrepancy between prices quoted in writing (words) and those
quoted numerically, writing shall govern.
1.06 AWARD OF BID:
The City reserves the right to accept any Bid or portion of any Bid, or to reject
any and all Bids or portions of any and all Bids, when such is deemed by the
City to be in its best interests.
1.07 NONCOLLUSIONS AFFIDAVIT:
The Bidder shall be required to execute and submit as a part of his/her Bid,
the Non-Collusion Affidavit. Refer to the enclosed from.
1.08 NONDISCRIMINATION CERTIFICATE:
The Bidder shall be required to execute and submit as a part of his/her Bid,
the Nondiscrimination Affidavit. Refer to the enclosed form.
1.09 ANTI-KICKBACK AFFIDAVIT FORM:
The Bidder shall be required to execute and submit as a part of his/her Bid,
the Anti-Kickback Affidavit Form. Refer to the enclosed form.
1.10 AFFIDAVIT OF LAND OWNERSHIP FORM:
The Bidder shall be required to execute and submit as a part of his/her Bid,
the Affidavit of Land Ownership Form. Refer to the appropriate enclosed form.
1.11 CLAWBACK AFFIDAVIT FORM (If a dwelling is on the property):
The Bidder shall be required to execute and submit as a part of his/her Bid,
the Claw Back Affidavit Form, if a dwelling is on the property. Refer to the
appropriate enclosed form.
1.12 PAYMENT:
Upon acceptance of the bid by the Okmulgee City Council, the successful
Bidder shall submit payment and an added $22.00 filing fee by Cashier's
Check, Money Order, or Cash within five (5) business days. The City will then
file the Quit Claim deeds with the Okmulgee County Clerk's office and then
convey the deeds to the successful bidder. In the event the successful Bidder
does not comply with the payment as stated, the next high Bidder will be
contacted and offered the opportunity to purchase the property at their stated
Bid so long as it meets the stated acceptable minimum (if applicable).
