SECTION 1 – REQUIREMENTS

1.1 INTRODUCTION

This Invitation for Bid (IFB) is issued by the Arkansas Department of Parks, Heritage and Tourism

(ADPHT or Department) for Division of Petit Jean State Park to obtain pricing and a contract for a rock

house cave.

1.3 CLARIFICATION OF BID SOLICITATION

A. Submit any questions requesting clarification of information contained in this Bid Solicitation in writing

to adpht.procurement@arkansas.gov by 2:00 p.m., Central Time on or before December 1, 2023.

The subject line must include the IFB number and “Questions.”

1. For each question submitted, Prospective Contractor should reference the specific solicitation

item number to which the question refers.

2. Prospective Contractors’ written questions will be consolidated and answered by the Department

as deemed appropriate. The Department’s consolidated written response is anticipated to be

posted to the website listed on page 1 of this IFB by the close of business on December 6, 2023.

If Prospective Contractor questions are unclear or non-substantive in nature, the ADPHT buyer

may request clarification of a question(s) or decline to answer.

B. The Prospective Contractor should notify the ADPHT buyer of any term, condition, or any other

language in the bid document that precludes the Prospective Contractor from submitting a compliant,

responsive bid. Prospective Contractors should note that it is the responsibility of the Prospective

Contractor to seek resolution of all such issues, including those relating to the terms and conditions of

the contract, prior to the submission of a bid.

C. Prospective Contractors may contact the ADPHT buyer with non-substantive questions at any time

prior to the bid opening.

D. An oral statement by the ADPHT buyer or any other ADPHT staff member will not be part of any

contract resulting from this solicitation and may not reasonably be relied on by any Prospective

Contractor as an aid to interpretation unless it is reduced to writing and expressly adopted by the

Department.

1.4 TERMS USED IN SOLICITATION

Unless otherwise defined herein, all terms defined in Arkansas Procurement Law and used herein

have the same definitions herein as specified therein.

A. “Department” means any agency, division, entity, museum, or State Park that is under the

direction of the Arkansas Department of Parks, Heritage and Tourism.

B. The terms “Invitation For Bid”, “IFB,” “Bid Solicitation,” and “Solicitation” are used synonymously

in this document.

C. “Prospective Contractor” means a responsible bidder who submits a responsive bid in response

to this solicitation.

D. “Requirement” means a specification that a Contractor is obligated to complete when submitting

a bid response to this IFB is designated by the terms “must” and “shall” in the requirement.

1.5 GENERAL REQUIREMENTS

A. Prospective Contractor shall perform work at Petit Jean State Park located at 1285 Petit Jean

Mountain Road in Morrilton, Arkansas.

B. Prospective Contractor shall perform all work during normal park visiting hours, Monday

through Friday, 8:00 a.m. through 5:00 p.m., excluding State Holidays.

C. Prospective Contractor shall create safety barriers to keep bystanders out of the work area and

at a safe distance.

D. Prospective Contractor shall be responsible for all permits required to perform and complete the

work stated in this IFB.

E. Prospective Contractor shall remove all debris, including nails, metals, and disposable

materials from the project site and the park each day.

F. Prospective Contractor shall be responsible for all materials, deliveries, and their protection

during construction.

G. Prospective Contractor shall protect buildings from elements during construction and take

precautions to prevent damage to landscaping.

H. Prospective Contractor shall report in writing any damage discovered to the State Park

Superintendent and shall report the damage discovered to the ADPHT Central Office

Procurement buyer listed on page one (1) of this IFB, prior to any repair work being completed,

for approval, and for any adjustment(s) to the purchase order. Information regarding the repair

should include the cost for all labor and materials.

I. The Department and Petit Jean State Park will not be responsible for equipment and materials

left at the project site.

J. Upon completion of each project, the Prospective Contractor shall contact Zack McGill to

complete the final inspection and approval of the work.

K. Prospective Contractor shall submit photographs during the project to Zack McGill at

501.682.0813 or his designee, and when requested by the Department.

1.6 ROCK HOUSE CAVE SPECIFICATIONS

A. Prospective Contractor shall provide all materials, equipment, and labor necessary to

remove dirt and barrier cloth as shown in Attachment A, Rock House Cave Layout

Drawing PJSP, attached with the solicitation documents on the website referenced on

page one (1) of this IFB.

B. Prospective Contractor shall be responsible for verifying the measurements for this

project.

C. The Rock House Cave is located at 35° 7’19.03N, 92° 56’11.32W.

1. The intent of this project is to remove a layer of unconsolidated sand and dirt

from the ground in the Rock House Cave.

a. Once this layer has been removed, a layer of erosion control cloth must

be exposed.

b. Prospective Contractor shall remove cloth.

2. Due to the remote location and difficult terrain, accessing the site by foot will be

necessary. Machinery must not be used.

3. Prospective Contractor shall complete the work using hand tools and buckets.

4. Prospective Contractor shall access the cave from the Rock House Cave

Trailhead.

5. Prospective Contractor may stage vehicles at the Rock House Cave Trailhead.

6. All work in the cave must be observed by Arkansas State Park representatives

to ensure all archeological artifacts, if found, are catalogued and preserved, if

necessary.

7. Prospective Contractor shall not remove any rocks of any size and shall not

remove any artifacts.

1.7 REQUIRED SITE VISIT

A. The Prospective Contractor shall schedule an appointment with Joe Buckley,

Superintendent, by calling 501.727.5441 or 501.208.7067.

1. The purpose of the required site visit is to verify project details, such as but not

limited to exact project location, dimensions, materials that will be needed, and

any other information required to complete the project.

B. The Prospective Contractor shall make the appointment with a minimum of two (2)

working days’ notice.

1. The Prospective Contractor shall not contact the park for anything else that

pertains the bid.

2. The Prospective Contractor shall contact the buyer listed on page one (1) of this

document for all other information and questions related to the bid solicitation.

C. The Prospective Contractor shall meet at the park location mutually agreed upon

between the Prospective Contractor and Park Superintendent.

D. The Prospective Contractor may have a maximum of two (2) employees attend the site

visit.

E. The Prospective Contractor shall take the Site Verification Form attached with the bid

solicitation documents to the park for signature after completion of the site visit.

F. The Prospective Contractor and/or their representative(s) present and participating in the

required site visit will be given the opportunity to ask questions to the park personnel.

Although answer will be provided as a courtesy to all Prospective Contractors in

attendance, no oral responses provided by any ADPHT personnel to any question posed

at the required site visit will become part of a resulting contract unless the oral response

is reduced to writing and attached as an addendum to this solicitation.

1.8 PRICING

A. The Prospective Contractor shall enter the price at the bottom of the Bid Signature page

located in the Response Packet attached with the bid documents on the OSP website.

B. The Prospective Contractor shall include in the price, all requirements specified in this

document including but not limited to materials, project management, travel expenses, site

supervisor, general conditions of the proposal and any other expense related to the

requirements in this IFB.

C. All costs must be entered without tax. Tax, if applicable, will be added to a resulting purchase

order to the awarded Contractor.

1.9 INSURANCE

A. The Prospective Contractor shall provide a Certificate of Insurance for the following:

1. General Contractor’s Liability

2. Proof of vehicle insurance

3. Worker’s Compensation Certificate of Insurance

a. Should the Prospective Contractor have too few employees to carry Worker’s

Compensation insurance, then he shall provide a statement on his company letterhead

that his company does not qualify for Worker’s Compensation because of having too few

employees.

4. The Prospective Contractor shall list the Agency’s name and address as the certificate

holder.

1.10 BRAND NAMES OR MANUFACTURER MODEL NUMBERS

1.11 DISCOVERY OF HIDDEN DAMAGE

A. Any discovered damage or additional repair needed must be reported to the park

superintendent in writing.

B. The park superintendent will submit the information to the ADPHT Central Office buyer prior to

any repair work being performed, for approval and adjustment of the purchase order.
