2 Bidder Understanding
The bidder hereby declares understanding, agreement, and certification of compliance to provide the items and/or
services at the prices quoted, in accordance with all terms and conditions, requirements, and specifications of this
original invitation to bid.
The bidder further agrees that upon receipt of an authorized purchase order from the Lincoln County Commission
or when a Notice of Award is signed and issued by the Commission, a binding contract shall exist between the
bidder and Lincoln County.
EXCEPTIONS:
The Commission has made some exception to the regulations of this bid project. They are as follows:
Rock/aggregate suppliers will not be required to submit any bonding.
Rock/aggregate suppliers are permitted to attach an additional sheet to their bid if they
have more than one location or additional products that are not listed in the bid form
supplied.
If bidders wish for their contract to be valid or not valid for a shorter or longer
period of time than stated in this bid packet, the bidder must state that on the additional charges/conditions section
on every bid form.
All bids must be valid for all of Lincoln County including any Special Road Districts that
choose to participate. If any road district participates in this bid, all bidders will be notified at a minimum of 10 days
prior to bid letting.
Rock/aggregate supply portion of this bid will be awarded to multiple suppliers to best
serve the whole county.
NOTE: Lincoln County, at its own expense, reserves the right to sample any material for the purpose of having a
laboratory test for conformity to specifications. Product that does not meet specifications will be rejected and
may result in the suspension of hauling from that facility for all products.

3 Insurance Requirements for Contractors and Sub Contractors
Minimum insurance requirements are listed below. A certificate of insurance naming Lincoln County as additional
insured must be in place prior to the commencement of work and a current certificate must remain on file
throughout the duration of the contract.
Contractors’ insurance shall name Lincoln County as an additional insured on a primary and non-contributory basis
for Commercial General Liability and Auto Liability and shall include a waiver of subrogation in favor of Lincoln
County where permissible by law.
Commercial General Liability (occurrence form), including: premises and completed operations, broad form
property damage and contractual liability, products liability, employees as insureds, explosion, collapse and
underground and independent contractors with minimum limits of:
$2,000,000 General aggregate (Subject to a per project general aggregate provision applicable to the project)
$2,000,000 Products-completed operations aggregate
$1,000,000 Personal & advertising injury
$1,000,000 Each occurrence
$100,000 Fire damage
$10,000 Medical payments
Contractual Liability coverage may not contain restrictions for assumption of the others sole negligence, or deletion
of coverage for contractual liability. Coverage may have punitive damages exclusion.
Commercial Automobile Liability:
$1,000,000 Combined Single Limit (per accident) including all owned autos, hired autos & non-owned autos.
Contractual liability coverage may not contain restrictions for assumption of others sole negligence, nor any
deletion of coverage for contractual liability.
Workers’ Compensation: as per the statutory requirements of the State in which the work is performed, including
Employer’s Liability with minimum limits of:
$500,000 per accident
$500,000 per disease each employee
$500,000 disease policy limit
Any subcontractor or employee leasing company used by the contractor must maintain Workers’ Compensation
coverage equal to these limits. Any employee leasing company must also name Contractor as Alternate Employer.
All personnel on Contractor’s job sites must be covered under a Workers' Compensation policy within the statutory
limits as provided under the laws of the state in which the work is performed. If contractor is a sole proprietor
and has no other employees, contractor MUST still purchase a Workers' Compensation Policy. When
contractor purchases Workers' Compensation Insurance, the certificate must indicate whether coverage has been
waived for Officers, Partners, Shareholders, LLC Members and/or Sole Proprietors.
Excess Liability Coverage or Umbrella: minimum limits of $1,000,000 overlaying the underlying limits for
Commercial General Liability, Auto Liability and Employers liability
Subcontractor Requirements
Subcontractors must comply with all Lincoln County requirements regarding prevailing wage, certified payroll,
Affidavit of Compliance (PW-4), lien waivers, insurance, OSHSA 10 training, and E-Verify.
