DO NOT CALL THE WOLCOTT TOWN HALL REGARDING THIS NOTICE

The Town of Wolcott requests bids from qualified contractors for Road Resurfacing. Work to include
labor, equipment and materials for up to 5 miles of Town roadways. The work will be performed in
accordance with CT Statutes governing Prevailing Wage Rates as applicable. Bid packages, containing
submission instructions and other information are available by email request to bids@wolcottct.org.

line of email requests. Sealed bids, including mailing envelopes and/or shipping containers, will be clearly

INVITATION TO BID
TOWN OF WOLCOTT, CT

26-10 ROAD RESURFACING with LABOR, EQUIPMENT and MATERIALS

I. PROJECT SPECIFICATIONS

1.1 INTRODUCTION

The Town of Wolcott, hereinafter referred to as the Town, is seeking sealed bids from qualified contractors for
Road Resurfacing of up to 5 miles of Town roadways as part of the Town's Road Preservation Project. Work to
include labor, equipment and materials.

1.2 INFORMATION, INSTRUCTIONS, DOCUMENTS
The work will be performed in accordance with CT Statutes governing Prevailing Wage Rate as
applicable (attached). It is the responsibility of the Contractor to absorb any increase in Prevailing
Wages.

e The award of a purchase order and/or contract to a specific contractor does not give that contractor the
exclusive right to provide labor, equipment and materials to perform road resurfacing of all roads included
in the Town's Road Preservation Project. The Town reserves the right to employ additional contractors.

1.3 SCOPE OF SERVICES
The Town of Wolcott, CT (the "Town") requests bids from qualified contractors to provide labor,
equipment and materials to resurface up to 5 miles of the Town's secondary roads.

The successful contractor will supply the labor, equipment and materials necessary to reclaim and
resurface specific roads at the direction of Wolcott's Public Works Director. The Town will be responsible
for the removal of the existing bituminous curbing prior to contractor pulverizing. The Town will assist
the contractor in removing any excess pulverized base material to make room for the new pavement. The
Town will supply traffic contro! where necessary.

The work will be performed in the 2026 construction period and will begin on or about July 1, 2026 and
will be in effect until the Town determines that, because of weather conditions, it is no longer practical to
continue.

The work herein specified is located on various roads within the Town of Wolcott.

Il. SUBMISSION REQUIREMENTS
Do not call the Wolcott Town Hall Finance Office with questions regarding this notice and/or
information provided in this Bid package.

The Town will not be responsible for and hereby disclaims any alleged oral instructions of
contract interpretations.

No firm may contact any other employee or elected or appointed official of the Town of Wolcott

with respect to this ITB or the submission of a Bid.

I.1 SUBMISSION DUE DATE, DELIVERY INSTRUCTIONS & BID OPENING

Bids prepared in accordance with the submission criteria, will be submitted in sealed envelopes, including
mailing envelopes, will be clearly marked "26-10 Road Resurfacing with Labor, Equipment and Materials", and
will be delivered to the Finance Office, Wolcott Town Hall, 10 Kenea Ave., Wolcott, CT 06716, by 1:30 pm, May
27, 2026. Proposals received after this time or delivered to other locations will be disqualified. Bids will be
opened and read publicly immediately following the closing time in the Council Chambers at Wolcott Town
Hall.

Interested firms are required to submit one printed original and four (4) printed copies.
Bids sent by email or fax are not acceptable.

Unless otherwise indicated, qualifications that are submitted are assumed to be valid for one hundred eighty
(180) days from the date that qualifications are due.

Questions and answers will be provided to all firms who have requested ITB packages. Questions may be
presented until 3:00 P.M., May 21, 2026.

To ensure the integrity of the public procurement process, all questions must be emailed. Phoned or verbal
questions will not be addressed. Should a firm require clarification or interpretation of any item in the submittal
and selection process, conditions, specifications, etc., the question should be e-mailed to bids@wolcottct.org.

The normal hours of operation of the Wolcott Town Hall are: Monday 8:00 A.M. to 5:30 P.M., Tuesday through
Thursday 8:00 A.M. to 4:30 P.M., Friday 8:00 A.M. to 12:00 noon. The Town reserves the right to change the
final due date and time for the bids. In the event Town Hall is unexpectedly closed (ie. weather related, etc.)
the bid opening will take place on the next business day, in the same location at the same time as originally
stated. ***Wolcott Town Hall will be closed May 25, 2026 in observance of Memorial Day***

I.2 DIRECTIONS FOR SUBMISSION
1. All forms must be filled out in their entirety.

An authorized principal or agent of the bidder must sign all forms.

3. Any modifications or exceptions, which a bidder submits, must be on a separate attachment, identified
properly as such, and signed by an authorized principal or agent of the bidder.

4. The Town may make any investigations, as it deems necessary to determine the ability, qualifications
and experience of the bidder to perform.

5. The bidder shall furnish to the Town all such information and data for this purpose as the Town may
request.

6. Bidders using delivery services are cautioned to allow sufficient time to ensure the timely receipt and
correct delivery location of their bids. The Town is not responsible for the failure of delivery services to
deliver the bids to the correct location by the specified date and time.

1.3. VENDOR INFORMATION

VENDOR OVERVIEW

Please provide the following:

The name and location of your company, including the office location that will be serving the Town.

e Abrief general description of your business and your firm's particular abilities and qualifications related to
this project.

The number of years your company has been in business.

Is your company a subsidiary of another corporation? If so, what is the name of the parent company?

The number of personnel employed by your company (please include the number of staff dedicated
to provide requested services).

1.4 EVALUATION CRITERIA
The Town may make such investigations as it deems necessary to determine the ability of the bidder to
perform the work, and the bidder shall furnish to the Town all such information and data for this purpose
as the Town may request.

The bidder must hold a current appropriate license from the State of Connecticut.
No award will be made to any bidder who cannot meet all of the following requirements. The bidder shall:

1. Not have defaulted on any contract within three (3) years prior to the Bid date

2. Maintain a permanent place of business

3. Have adequate personnel and equipment to perform the work expeditiously

4. Have suitable financial status to meet obligation incident to the work

5. Have appropriate technical experience in the class of the work involved

6. Have completed previous contracts on time

7. Have a minimum of five (5) years of experience as a business

8. Provide evidence of having the required insurance coverages

9. Have successfully completed a minimum of three (3) similar projects

10. Have equipment meeting the required specifications

11. Have qualified, experienced, licensed equipment operators

12. State whether during the past five years your firm has been suspended from bidding or entering into any
government contract.

11.5 BID AWARD
Award ofa contract will be made following a study of all bids. The Town of Wolcott Ordinances #75 & #92
will be in force for the purposes of bid evaluation. (Section V.)

The Town of Wolcott reserves the right to reject any and all bids, waive any irregularities, omissions, excess
verbiage or technical defects in the bids, and the Town need not necessarily award the contract to the firm
submitting the lowest bid, if, in the opinion of the Town, it would be in the best interests of the Town of Wolcott
to accept other than the lowest bid because of another firm's greater expertise and/or experience. No Bidder
may withdraw his bid for a period of 180 days from the date of the bid opening. The Town will accept the bid
that, all things considered, the Town determines is in its best interests. Although price will be an important
factor, it will not be the only basis for award. Due consideration may also be given to a bidder's experience,
references, service, ability to respond promptly to requests, past performance, staffing, the abilities and
availability of equipment and other criteria relevant to the Town's interests, including compliance with the
procedural! requirements stated in this ITB.

Important: An award letter will be provided to the successful bidder signed by the Municipal Finance Officer
of the Town of Wolcott followed by a contract (provided by the vendor and reviewed by the Town Attorney)
signed by the Mayor of the Town of Wolcott. The insurance certificate must be updated annually during the
time of the contract.

11.6 DISQUALIFICATION OF BIDDERS

More than one proposal from an individual, a firm or partnership, a corporation or an association under the
same or different names, will not be considered. Reasonable grounds for believing that any bidder is interested
in more than one proposal for the work contemplated will cause the rejection of all proposals in which such
bidder is interested. All proposals will be rejected if there is a reason for believing that collusion exists among
the bidders, and all participants in such collusion will not be considered in future proposals for the same work.

1.7 ADDENDA

Revisions or addenda to the ITB: In the event it becomes necessary to revise or supplement any part of the
ITB, the revision or supplement will bed on the State of CT DAS website as well as provided to all prospective
firms that have requested an ITB package via e-mail.

Ill. CONTRACT CONSIDERATIONS

M1.1 EQUAL OPPORTUNITY - AFFIRMATIVE ACTION

The successful firm shall comply in all aspects with the Equal Employment Opportunity Act. A firm with 15
or more employees shall be required to have an Affirmative Action Plan which declares that the contractor
does not discriminate on the basis of race, color, religion, gender, national origin or age, and which specifies
goals and target dates to assure the implementation of equal employment. A firm with fewer than 15
employees shall be required to have a written equal opportunity policy statement declaring that it does not
discriminate on the basis of race, color, religion, gender, national origin or age.

Findings of noncompliance with applicable State and/or Federal equal opportunity laws and regulations
could be sufficient reason for revocation or cancellation of this contract.

I.2 INDEMNIFICATION

The awarded firm agrees to indemnify, defend, and save harmless, the Town of Wolcott, as well as its
officers, agents and employees from any and all claims and losses to the extent caused by the negligent act,
error or omission of the awarded firm resulting from the performance of this contract, except to the extent
caused by the negligent acts of the Town of Wolcott or its officers, agents or employees.

The Town, as a sovereign government, cannot indemnify businesses or individuals.

1.3 INVOICING AND PAYMENT
Invoices should be forwarded directly to the Accounts Payable, Finance Office, Wolcott Town Hall, 10 Kenea
Avenue, Wolcott, Connecticut, 06716 or emailed to ap@wolcottct.org.

Important: A purchase order for the items/service identified in this Invitation to Bid will not be awarded
until copies of all of the required insurance certificates are submitted to the Town of Wolcott Finance
Office.

All invoices shall include:

Contractor F.E.I.N. or Social Security number.

Complete Contractor name and billing address.

Project number, if applicable.

e Invoice number and date.

e Purchase order number.

e Itemized description of services and/or material supplied.

* Adjustments, if applicable.

Quantity, unit price, and extended amount.

Ticket numbers corresponding to each invoice shall be listed or attached to the company invoice as a
separate sheet, if applicable.

Work periods and traffic control prices shall be itemized, if applicable.

Payment Terms and Billing: Payment shall be made only after the Town receives and accepts the Goods or
Services and after it receives a properly completed invoice. Unless otherwise specified in the Contract, payment
for all accepted goods or services shall be due within forty-five (45) days after acceptance of the goods or
services.

II4 TAXES, LICENSES, PERMITS & CERTIFICATES

The Contractor shall pay all sales, use, property, income and other taxes that are lawfully assessed against
the Contractor in connection with the Contractor and the work included in the contract. By law, the Town of
Wolcott is exempt from paying Federal Excise Tax, State and Local taxes.

The Contractor shall secure, at its own expense, all necessary permits, licenses and certificates of authority
required to complete the work, and shall comply with all requirements of such permits, licenses and certificates
of authority to operate. The Contractor shall keep and maintain all such licenses, permits and certificates of
authority in full force and effect throughout the term of this contract.

Any documents/reports/data generated as a result of work under this contract shall become the property
of the Town of Wolcott.

I.5 TERMINATION

Subject to the provisions below, the contract may be terminated by either party, upon thirty (30) days'
advance notice to the other party, but if any work or services hereunder are in progress, but not completed,
as of the dated of termination, then this contract may be extended upon written approval by the Town until
said work or services are completed and accepted.

A. Termination For Convenience
In the event that the contract is terminated or canceled upon request and for the convenience of
the Town, without the required thirty (30) Days' advance written notice, then the Town shall

negotiate reasonable termination costs, if applicable.

B. Termination For Cause
Termination by the Town for cause, default or negligence on the part of the Bidder shall be
excluded from the foregoing provision; termination costs, if any, shall not apply. The thirty (30)
days' advance notice requirement is waived in the event of termination by cause.

111.6 NON-APPROPRIATION OF FUNDS
Please note that any contract executed by the Town of Wolcott is subject to the appropriation of
funds on an annual basis.

11.7 ADDITONAL INFORMATION OR DOCUMENTATION

1. QUANTIY OF WORK: There are no exact estimates of the quantities of work to be performed under this
contract, and any variation in quantities shall not be valid grounds for any claim for damages or loss of
profits or change orders. The Town reserves the right to reduce the amount of work originally projected
due to fund limitations.

2. START OF WORK: The Contractor shall be required to start the project within five (5) days after
notification of a purchase order number from the Wolcott Director of Public Works. The five (5) day
limit may be extended by the Director of Public Works.

3. EQUIPMENT REGULATIONS: Contractor's equipment and/or vehicles shall be in good operating
condition and shall be equipped with all required devices. Equipment and/or vehicles are to be in
compliance with all of the applicable Federal, State and municipal laws, ordinances and regulations in
force at the time of the contract.

4. CONDITIONS OF WORK: Each bidder must inform himself fully of the conditions relating to the
construction and labor under which the work will be performed. Failure to do so will not relieve a
successful bidder of his obligation to furnish all equipment and labor necessary to carry out the
provisions of the contract documents and to complete the contemplated work for the construction
activities set forth in his bid. Insofar as possible, the contractor, in the carrying out of his work, must
employ such methods or means as will not cause any interruption of or interference with the work of
any other contractor. The contractor shall keep himself fully informed and comply with all the laws,
ordinances and regulations of the Federal, State and Municipal Governments in any manner affecting
his employees, or the conduct of the work, the materials used or equipment employed in the work.

5. SUPERINTENDENCY BY CONTRACTOR: Except where the contractor is an individual and gives his
personal superintendence to the work, the contractor shall have a competent superintendent,
satisfactory to the Town, on the work at all times during working hours, with full authority to act for
him. The contractor shall also provide an adequate staff for the proper coordination and expedition of
his work.

6. CONTRACTOR RESPONSIBILITY: The Contractor shall be responsible for the entire performance under
the contract regardless of whether the Contractor itself performs. The Contractor shall be the sole point
of contact concerning the management of the contract, including performance and payment issues.
The Contractor is solely and completely responsible for adherence by the Contractor Parties to all
applicable provisions of the Contract.

ORDINANCES #75 AND #92: The Town of Wolcott Ordinances #75 "Ordinance Establishing Uniform
Standards Applicable to the Public Bidding Process" and #92 "Ordinance Concerning Delinquent Taxes
and Denial of Permits, Town Contracts and Vendor Payments" will be in force for the purposes of the
proposal evaluation. (Section V)

PERFORMANCE BOND REQUIREMENTS: The Contractor will be required to provide a Performance
Bond in an amount not less than 100% of the Contract Price.
