BID NOTICE
Notice is hereby given that sealed bids will be received by the Purchasing Agent of the Borough of Edgewater, Bergen County, New Jersey, for the 2025 Road Improvements toHudson Avenue and Beverly Place (NJDOT Funded) and Adelaide Place (CDBG Funded) at the Borough of Edgewater Municipal Building, 55 River Road, Edgewater, New Jersey, 07020 on Wednesday, May 14, 2025 @ 11 A.M., Local Prevailing Time.
Drawings, specifications and forms of bids, contract and bond for proposed work, prepared by the Neglia Group, will be on file at the office of said Engineer, 34 Park Avenue, Lyndhurst, N.J., on April 21, 2025, Noon and may be examined at no expense by prospective bidders during business hours with an appointment. Bidders, upon request, will be furnished with a copy of the specifications and plans by the Engineer upon proper notice and a non-refundable payment cost of $10.00 for a DIGITAL thumb drive or $200.00 for a hard copy the cost of reproduction. (Checks made payable to: Neglia Group.) Bids must be made on Standard Proposal Forms in the manner designated herein and required by the Specifications, must be enclosed in sealed envelopes, bearing the name and address of bidder and the words: BID FOR “2025 Road Improvement to Hudson Avenue and Beverly Place (NJDOT Funded) and Adelaide Place (CDBG Funded)”Road Improvements clearly written on the outside of the envelope addressed to Deborah Reilly, QPA. Facsimiles or e-mails will not be accepted. All Bids must be accompanied by a non-collusion affidavit and a certified check or bid bond for not less than ten (10%) percent of the amount bid, provided said check need not be more than $20,000.00, nor shall not be less than $500.00, and a consent of surety from a surety company authorized to transact business in the State of New Jersey in a sum equal to one hundred (100%) percent of the amount bid, and be delivered at the place on or before the hour named above.
Signatures shall be in ink and in longhand. Bids should be either mailed directly to or hand delivered directly to the Purchasing Agent, Borough of Edgewater, 55 River Road, Edgewater New Jersey, 07020. All bids sent via regular mail or any other carrier shall be at the sole risk of the Bidder.
The Standard Proposal Form and the non-collusion affidavit are attached to the Specifications, copies of which will be furnished on the application to the Engineer.
Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27, regarding Affirmative Action and Executive Order 11246 regarding Equal Opportunity, and with all provisions of the Local Public Contracts Law, NJSA 40A:11-1 et. seq. and all rules and regulations promulgated thereunder, the provisions of which are incorporated herein by reference.
New Jersey Business Registration Requirements: NJSA 40A:11-23.2 requires all contractors and subcontractors with public contracting agencies to provide proof of registration with the Department of Treasury, Division of Revenue.
The contractor shall provide written notice to its subcontractors of the responsibility to submit proof of business registration to the contractor. The requirement of proof of business registration extends down through all levels (tiers) of the project. Before final payment on the contract is made by the contracting agency, the contractor shall submit an accurate list and the proof of business registration of each subcontractor or supplier used in the fulfillment of the contract or shall attest that no subcontractors were used.
For the term of the contract, the contractor and each of its affiliates and a subcontractor and each of its affiliates [N.J.S.A. 52:32-44(g) (3)] shall collect and remit to the Director, New Jersey Division of Taxation, the use tax due pursuant to the Sales and Use Tax Act on all sales of tangible personal property delivered into this State, regardless of whether the tangible personal property is intended for a contract with a contracting agency. The Contractor is required to comply with all rules and regulations and orders promulgated by the State Treasurer pursuant to N.J.S.A. 10:5-31 et. seq. and N.J.A.C. 17:27, P.L.1975, c 127., regarding Affirmative Action, Executive Order 11246 regarding Equal Employment Opportunity, and Chapter 33, Laws of 1977 regarding disclosure of Partners & Stockholders, and all rules and regulations promulgated thereunder, the provisions of which are incorporated herein by reference, and with all provisions of the Local Public Contracts Law, N.J.S.A. 40A:11-1 et. seq. and all rules and regulations promulgated thereunder, the provisions of which are incorporated herein by reference. All bidders must be registered with the New Jersey Department of Labor.
All contracts and subcontracts for construction or purchase of materials are subject to Section 3 of the Housing and Community Development Act of 1968 where to the greatest extent possible, opportunities for training & employment shall be given to lower income residents of the project area, and when possible, contracts shall be awarded to business concerns owned by area residents.
All bids shall be irrevocable, not subject to withdrawal and shall stand available for a period of sixty (60) days. The Borough of Edgewater reserves the right to reject any or all bids, or to waive any informalities in the bidding.
Contractors shall also be advised that this project is being funded by the Bergen County Community Development Block Grant Program (CDBG) and New Jersey Department of Transportation (NJDOT). Federal Prevailing Wage Rates shall prevail in this contract. As such, there are several requirements of the Bergen County Community Development Block Grant Program (CDBG) and of the New Jersey Department of Transportation (NJDOT) must be followed by the contractor in the performance of this contract.
Small, Minority and Women’s Business Enterprises are encouraged to obtain specifications and compete for the contracts assisted with Community Development Block Grant funding.
