I. INTRODUCTION
PURPOSE OF THIS REQUEST FOR PROPOSALS
Eddy County ("COUNTY"), on behalf of the Eddy County Detention Center ("ECDC"), hereby
solicits sealed proposals from qualified, licensed, and experienced prisoner transport service
providers to furnish secure ground and air extradition services for adult detainees.
The transportation of prisoners is a mission-critical public safety function involving heightened
operational risk, constitutional obligations, medical considerations, and potential civil liability
exposure. The COUNTY requires a professional transport provider capable of executing custody
transfers in strict compliance with federal and state law, industry best practices, and documented
correctional standards.
The COUNTY's objective in issuing this Request for Proposals (RFP) is to:
* Establish a contractual relationship with a provider that demonstrates operational maturity,
documented compliance, and proven experience in secure prisoner transport
* Ensure safe, secure, and humane treatment of detainees during all phases of transport
* Maintain continuous custody control and clear chain-of-custody documentation
* Minimize risk of escape, injury, civil rights violations, or litigation
* Ensure transparency and fairness in pricing across varying transport categories
* Establish enforceable performance standards and accountability mechanisms
The selected CONTRACTOR shall act as an independent contractor and shall assume full
responsibility for the custody, care, supervision, and security of prisoners from the moment
custody is formally accepted until lawful transfer is completed and documented.
SCOPE OF WORK
The CONTRACTOR shall provide all personnel, supervision, vehicles, restraints,
communications equipment, tracking systems, documentation processes, compliance oversight,
and logistical coordination necessary to safely and lawfully transport prisoners as directed by the
COUNTY.
The CONTRACTOR shall be solely responsible for the custody, care, control, and supervision of
detainees during the entire period of transport.
REGULATORY COMPLIANCE
The CONTRACTOR must comply with the Interstate Transportation of Dangerous Criminals
Act of 2000 (hereinafter "the Act') codified at 34 U.S.C., subsection 60101, and regulations
issued thereunder, including, but not limited to, 28 C.F.R. Part 97, as may be amended from time
to time, which are fully incorporated herein by reference. If CONTRACTOR is found in
violation of the regulations established under the "Act", CONTRACTOR shall be liable for the
penalties and expenses imposed by the applicable laws.

SECURE GROUND TRANSPORTATION SERVICES
The CONTRACTOR shall furnish vehicles specifically designed or modified for secure prisoner
transport. Vehicles shall:
* Be currently licensed, registered, and insured
* Be maintained in safe mechanical condition
* Include secure prisoner compartments
* Provide physical separation between:
* Male and female detainees
* Juveniles are to be transported separately
* Transport officers and detainees
* Include communication systems capable of maintaining contact with dispatch
* Include GPS tracking capability for real-time location monitoring.
Vehicles shall not be used if they present mechanical deficiencies that may compromise safety.
During transport, prisoners shall remain secured using standard law enforcement restraints unless
medically contraindicated.
AIR EXTRADITION SERVICES
When air transport is required, the CONTRACTOR shall:
* Arrange commercial coach airfare for security personnel and detainee
* Maintain continuous custody control during airport processing
* Comply with Transportation Security Administration (TSA) and airline requirements
* Securely transport prisoner documentation and property
* Coordinate ground transfers to and from airports
Airfare shall be billed at actual cost unless otherwise agreed.
EN ROUTE HOUSING & LODGING
For transports requiring overnight lodging:
* Detainees shall be housed only in secure jail or detention facilities
* Detainees shall not be lodged in unsecured commercial accommodations
* Separation from the facility's general population shall be implemented when feasible
* Facility staff shall be notified of any escape risks, gang affiliations, or special concerns
* Prisoners shall not be permitted access to telephones while en route
Vehicles equipped with restroom facilities must maintain sanitary conditions. If no restroom is
available, adequate restroom stops must be provided.
CONTINUOUS CUSTODY & SECURITY CONTROL
Custody shall be continuous and uninterrupted at all times. The CONTRACTOR shall maintain
physical control, visual supervision, and direct accountability for each detainee throughout
transport.

Under no circumstances shall a detainee be left unattended in a vehicle, unsecured location, or
non-controlled environment.
The CONTRACTOR shall implement layered security protocols designed to prevent:
* Escape or attempted escape
* Assault between detainees
* Assault on transport personnel
* Assault on members of the public
* Collusion or communication between incompatible detainees
Enhanced supervision and staffing adjustments shall be implemented whenever risk indicators
warrant heightened control measures.
PERSONAL & SUPERVISION
The CONTRACTOR shall provide qualified personnel who:
* Possess valid driver's licenses
* Wear professional uniforms displaying company insignia
* Carry company-issued photo identification
* Have completed documented training in use of force, restraint application, defensive driving,
CPR, firearms proficiency, and crisis intervention.
A minimum of two (2) certified officers shall be assigned to each transport. Staffing levels must
increase when required by risk assessment, detainee classification, or number of prisoners
transported.
Prisoners shall never be left unattended in a vehicle.
SEARCHES & RESTRAINTS
Prior to departure, detainees shall be searched in accordance with lawful correctional procedures.
* Restraints including handcuffs, waist chains, and leg irons shall be applied unless
medically contraindicated. Any removal of restraints shall be documented and justified.
* The County prefers that the prisoners wear brightly colored clothing (provided by the
CONTRACTOR) that clearly identifies them as prisoners.
PROPERTY & DOCUMENTATION
Prior to departure, the CONTRACTOR shall:
* Inventory prisoner property
* Obtain signatures from prisoner and transport officer
* Secure property in a manner preventing detainee access during transport
Electronic devices shall not be transported unless authorized.
The CONTRACTOR shall deliver prisoner records and authorized property to the receiving
agency at the time of custody transfer.

RURAL vs. URBAN PRICING
If pricing varies between rural and urban areas, the CONTRACTOR shall:
* Clearly define the criteria used to distinguish rural from urban locations
* Identify geographic areas where services are not provided
* Provide a clear explanation of pricing differentials
The COUNTY reserves the right to evaluate reasonableness of such distinctions
MANDATORY REQUIREMENTS
The following requirements are mandatory. Failure to meet any requirement may result in
disqualification.
The CONTRACTOR shall demonstrate:
* A minimum of three (3) years of documented experience in adult prisoner transport and
extradition services
* All transport personnel must carry firearms and must be re-qualified annually
* A fully operational dispatch center functioning twenty-four (24) hours per day, seven (7) days
per week, three hundred sixty-five (365) days per year
* A comprehensive drug-testing and criminal background screening program for all transport
personnel
* Written policies and procedures compliant with the Interstate Transportation of Dangerous
Criminals Act and associated regulations
* A fleet of vehicles compliant with U.S. Department of Transportation regulations and
designed for secure prisoner transport. Vehicles used in transport services shall at all times be
currently licensed, in good and safe operating condition, and designed and equipped with
appropriate security devices, including a barrier between males and females, between the
transport agent and the prisoner(s), and a communication system.
* An online tracking or monitoring system available to the County
* A policy prohibiting subcontracting of transport services without prior written approval of the
County.
The CONTRACTOR must affirm compliance in writing and provide supporting documentation
upon request.
MINIMUM OPERATIONAL REQUIREMENTS
CONTRACTOR shall make a positive statement such as whether it meets requirements, per
requirements, or complies with requirements, for items below. The CONTRACTOR may provide
written documentation to demonstrate responsiveness in meeting the items below:
* Upon request by the Eddy County Detention Center CONTRATOR shall provide an
estimated price quote for service. The quote will contain, but not be limited to, information
relating to the CONTRACTOR's availability for the transport, the method of travel, the total
estimated cost of the transport, a schedule of the date and time frame of prisoner pick-up, and

the estimated date, time frame, and place of delivery. CONTRACTOR shall provide the
service upon approval of the quote by the County. The County shall make every effort to
provide the CONTRACTOR with as much as twenty (20) days' notice, when possible.
However, the agency having custody may not provide the County with adequate notice. In
such instances, the CONTRACTOR shall respond and provide transport services if given at
least forty-eight (48) hours' notice. (please review as this conflicts with #13)
* The County will provide the CONTRACTOR with all pertinent information concerning the
prisoner, including the prisoner's identity and departure/destination information. If possible,
a female transport agent must transport all female prisoners.
* The County shall have the right to cancel its pickup order within twenty-four (24) hours of
placing the order, at no cost. Any other cancellation may be made without penalty, provided
the CONTRACTOR's consent is obtained. If CONTRACTOR is en route or attempts to pick
up a prisoner and that pickup order is then cancelled, the requesting party, at the option of the
CONTRACTOR, shall be subject to a cancellation charge equal to the amount set forth in the
Pricing.
* CONTRACTOR shall adhere to any and all detention center and holding facilities policies
and procedures for booking prisoners who have detainers from other jurisdictions. Transport
Orders and Writs must accompany the prisoner when booked into the County Detention
Center.
* CONTRACTOR shall assume custody of such prisoners from authorized agents at the
location of incarceration determined by the parties to be suitable for such purpose and
transport such prisoners to and from locations designated by the County.
* When transporting violent prisoners, CONTRACTOR shall notify local law enforcement
officials in advance of any scheduled stops in their jurisdiction.
* In the event of unusual incidents, emergencies, and/or controversial situations that arise in the
performance of services, CONTRACTOR shall immediately report such incidents to the
appropriate designated authority. These situations include, but are not limited to, any act of
violence by a prisoner or other passengers, any escape or attempted escape, any breach of
security, any use of force, excessive delay in transportation, medical emergencies,
mechanical failure, or refusal of law enforcement agencies to release a prisoner as
authorized.
* Upon arrival at the place of delivery, CONTRACTOR shall surrender custody of such
prisoners to the designated receiving agency. To ensure proper transfer, corroborative
identification of personnel at the place and time of surrender shall be presented.
CONTRACTOR shall not surrender custody of prisoners without first verifying the
identification of the receiving party.
* CONTRACTOR shall have the right to refuse transport of any individual whose condition or
behavior, in the opinion of the driver, would be detrimental or dangerous to the safety of the
vehicle or its passengers. In such cases, notification shall be made immediately before
leaving the pick-up location, and no charge shall be assessed

* The County shall approve of the CONTRACTOR's safest and most effective method of
travel for prisoners with medical conditions. Prisoners requiring medication shall be provided
with their medication at required time intervals while en route, and self-medication shall be
appropriately documented.
* CONTRACTOR shall maintain all records and transport plans in a confidential manner.
* CONTRACTOR shall provide, upon demand, a status report and checklist for each prisoner
transported while in custody. Follow-up communication via phone call or email shall specify
the estimated drop-off time. CONTRACTOR assumes full responsibility for the safety of
prisoners in its care.
* CONTRACTOR shall contact the designated Detention Center representative when
requesting an extension for pick-up or delivery. The request shall be submitted via email
detailing the reason. A response will be provided within 24 hours granting or denying the
request.
* In the event air extradition services are required, CONTRACTOR shall charge the current
commercial coach airfare rate at the time service is provided. The rate shall consist of a
round-trip for security personnel and a one-way trip for the inmate/prisoner(s). If additional
security personnel are required, the airfare will increase by the number of personnel.
* All medical costs arising from illness or disease not caused by the CONTRACTOR shall be
borne by the County.
* If additional services are required, the Eddy County Detention Administrator will negotiate
the cost with the CONTRACTOR.
* CONTRACTOR shall maintain a transit log of each transport under the contract and submit
individual invoices for payment.
* Invoices shall include the following information:
a) Date Ordered
b) Pick-up Date
c) Delivered Date
d) Detailed Invoice with a breakdown of charges (distance in miles, cost per mile,
additional costs)
e) An Invoice number
f) Customer Number
g) Payment Terms
h) Order Type
i) Destination From: Where the prisoner was picked up from.
j) Destination To: Where the prisoner will be transported.
k) Description of prisoner information (name, aka if any, inmate number, social security
number, booking number, age, race, sex, dob, height, weight, eye and hair color)
l) The CONTRACTOR must provide an online portal to facilitate efficient communication,
scheduling, and reporting for transportation services. The portal must be accessible 24/7
and should offer user-friendly navigation to ensure ease of use for our staff.

The online portal must include the following features and capabilities:
* User Accounts and Permissions:
Secure login with unique user accounts for our staff members.
o
Role-based access control ensures appropriate permissions for different users'
o
roles.
* Scheduling and Tracking:
Real-time scheduling of transportation services with the ability to view and
o
modify upcoming transport assignments.
Live tracking of transport vehicles, providing updates on current location and
o
estimated arrival times.
* Communication Tools:
Integrated messaging system for direct communication between our staff and the
o
transport company's dispatch team.
Notification system for alerts on schedule changes, delays, or other important
o
updates.
* Reporting and Documentation:
Access to historical data and transport logs, including details on each transport
o
completed.
Ability to generate and export custom reports on transport activities, including
o
metrics such as response times, distances traveled, and service usage.
* Support and Maintenance:
Dedicated technical support to address any issues with the online portal.
o
Regular updates and maintenance to ensure the portal remains secure and
o
functional.
CONTRACT TERM
It is anticipated that the initial term of this contract will be for one (1) year, commencing upon
full execution of the agreement(s). The County reserves the right to renew or extend any contract
on an annual basis (or any portion thereof) for up to three (3) additional one-year terms and shall
be subject to the same terms and conditions as set forth in the original agreement. Any such
renewal or extension shall be subject to mutual written agreement by both parties. Under no
circumstances will the total term of this contract exceed four (4) years. This procurement will
result in a multi-source award.
INSURANCE
The CONTRACTOR shall maintain, at its sole expense, the following minimum insurance
coverage:
* Commercial General Liability Insurance with limits not less than One Million Dollars
($1,000,000) per occurrence and Two Million Dollars ($2,000,000) aggregate
* Automobile Liability Insurance covering all owned, non-owned, and hired vehicles with
limits not less than One Million Dollars ($1,000,000) combined single limit
