Issued: May 8, 2026
Intent.
It is the intent of the Middletown Area School District (the "District") to secure proposals for Supplemental
Certified Athletic Trainer services for the Middletown Area High School and the Middletown Area Middle
School, located in Middletown, Pennsylvania
Contract Term.
The Contract shall begin on July 1, 2026, and run for a 36-month term, expiring June 30, 2029.
Due Date and Submission of Proposals.
All proposals are due by 1:00 p.m., on Thursday, May 28, 2026. Proposals must be mailed to:

Proposals shall have "Supplemental Certified Athletic Trainer Services Proposal" on the outside of the
envelope. The District reserves the right to reject any and/or all proposals and to waive, at its discretion,
any irregularities, mistakes, omissions, or informalities.

Prospective vendors will find all questions and answers posted on our website. Go to
www.raiderweb.org, Our District, Business Office, RFP, Bids, & Tabulations. The final day for questions
will be the close of business on May 20, 2026 , all questions and answers will be posted on our website
on May 22, 2026.
Agreement.
Prospective Providers shall include a copy of their proposed agreement with their proposal submission.
Final agreement shall be as mutually agreed, and shall incorporate the scope of services and conditions
as herein described.
Selection Criteria.

The selection criteria shall include, but not be limited to, cost, Athletic Trainer experience, references,
agreement language, and insurance coverage. The District reserves the right to select the Provider who
best meets its needs.
Notice.
As this Request for Proposal is not a competitive bid, the District retains the right to negotiate the price
and other terms of the contract with the respondents identified and chosen by the District.
Insurance Requirements.
Please see attached addendum.
Independent Contractor.
It is hereby understood and agreed that the Provider, in performing this Agreement, is acting in the capacity
of an independent contractor and that the Contractor is not an agent, servant, partner, nor employee of
the District. The Contractor will have control over the work to be performed, provided same is consistent
with the requirements of the Agreement, and shall be solely responsible to pay its own federal, state, and
local taxes, salaries, Social Security payments, and any and all other payments incurred by the Contractor
in the performance of this Agreement, as well as perform all necessary legal requirements pertaining to
employment. None of the benefits provided by the District to its employees including, but not limited to,
workers' compensation insurance, disability insurance, medical insurance, and employment insurance are
available from the District to the Contractor and/or any and all of the Contractor's agents, servants, and
employees. The Contractor has no authority hereunder to assume or create any obligation or responsibility,
express or implied, on behalf or in the name of the District or to bind the District in any way whatsoever.
SCOPE OF SERVICE & REQUIREMENTS
The Provider shall provide an Athletic Trainer who is certified by NATA BOC AND possesses a valid Athletic
Training License in the Commonwealth of Pennsylvania. The School District shall have the right to consent
to assignment of the Athletic Trainer. All Athletic Training Services provided under this Agreement shall be
performed exclusively for and on behalf of the School District. The Provider, as per availability of Provider's
Staff, will:
a. Part Time (approximately 800 hours per year) or Full Time (approximately 1400 hours per year) training
services
b. Assist the team physician(s) in maintaining an appropriate medical records system.
c. Monitor athletic injuries and develop injury prevention programs with the advice and consent of the
team physician(s).
d. Coordinate injury evaluation and provide injury follow-up with the team physician(s) on a regular basis.
e. Operate in accordance with rules and regulations of the Commonwealth of Pennsylvania

f. Coordinate all Athletic Training Services on an as needed basis at the direction of the School District's
Athletic Director to supplement the services provided by School District's athletic trainer as per availability
of Provider's Staff.
g. Provide home and away Athletic Training services during playoffs on an as needed basis.
h. Create documentation of the Athletic Training Services provided to any injured student-athlete. In
providing Athletic Training Services to injured student-athletes, the Athletic Trainer(s) shall act solely and
exclusively on behalf of the School District. All documentation and treatment notes shall be subject to The Family
Educational Rights and Privacy Act and privacy regulations promulgated thereunder ("FERPA") and may be
disclosed to the School District, school officials, coaches, athletic directors, team physicians, nurses
and other school employees without authorization. The School District shall retain full control and ownership of
the records created under this Section.
Coverage.
Part Time Athletic training coverage is estimated to be 800 total hours for each year. Full Time Athletic
Coverage is estimated to be 1400 total hours for each year. Not to exceed 40 hours per week.
Provide athletic training coverage for students in grades 7-12 participating in PIAA sports at Middletown Area
School District. Traditional athletic training hours to include afternoons and evenings with occasional weekend
coverage and full day coverage during preseason or school breaks as needed. Schedule to be determined by the
district's athletic director and athletic trainer and may include preseason, regular season, and post-season play by
district teams. Travel may be required for varsity football games and playoff competitions in all sports as
necessary
* Fall Season - Coverage by Athletic Trainer during pre-season football camp; coverage of all home and
away Varsity football games; coverage of all Junior Varsity and freshman home games only; on-site
for all home Varsity sports contests; on-site for weekday afternoon practices and weekend practice
availability as determined and set forth by the Athletic Director. Attendance at scheduled night
games shall take precedence over attendance at afternoon practices.
* Winter Season - Coverage of all home basketball games and wrestling matches; on-site for weekday
afternoon practices and weekend practices as determined and set forth by the Athletic Director.
* Spring Season - Coverage of all home Varsity sports contests; on-site for weekday afternoon
practices and weekend practices as determined and set forth by the Athletic Director.
* Summer - Coverage from the first day of football heat acclimatization and practices.
Actual schedule shall be confirmed and administered by the District Athletic Director.

and, if accepted by the agency, will become part of the contract.
Deviations must not conflict with the basic nature of the solicitation, requirements, or applicable state or federal
laws. Middletown Area School District reserves the right to accept or reject any deviation.
Bidders must submit all deviations in writing below. Failure to do so will be interpreted as agreement to all terms
as outlined in the RFP without exception.

DEVIATIONS
The requirements contained in the solicitation become part of the terms and conditions of the contract resulting
from this solicitation. Any deviations from the solicitation in must be clearly defined by the vendor in its proposal
and, if accepted by the agency, will become part of the contract.

laws. Middletown Area School District reserves the right to accept or reject any deviation.

Addendum A
This Addendum is part of the Supplemental Athletic Training Agreement
None of these requirements may be modified, without the written approval of MIDDLETOWN AREA SCHOOL
DISTRICT's Risk Manager and/or General Counsel.
1. INDEMNIFICATION
(a) To the fullest extent permitted by law, PROVIDER shall defend, indemnify and hold harmless
MIDDLETOWN AREA SCHOOL DISTRICT and its agents, employees and representatives from and against
all liabilities, claims, damages, losses and expenses, including, but not limited to: (i) claims of property
damage; (ii) claims of personal injury to PROVIDER's employee or agents, (iii) claims of personal injury to
other parties; and (iv) reasonable attorney's fees, whether incurred as a result of a third party claim or
to enforce this Contract; arising out of or resulting directly or indiretly from transportation and/or the
performance of the Work or the enforcement of this Contract, irrespective of whether there is a breach
of a statutory obligation or rule of apportioned liability; provided, however, that PROVIDER's
indemnification obligation shall not apply to the extent it is caused by the negligence of a person
indemnified hereunder and indemnification of such person is precluded by statute.
(b) The above indemnification obligations shall not be limited in any way by the provision of insurance by
any party or by any limitation on the amount or type of damages, compensation or benefits payable by
or for PROVIDER under workers' compensation or other employee benefits act.
2. INSURANCE
(a) PROVIDER shall purchase and maintain insurance as outlined in following section (3), which will provide
primary liability coverage to PROVIDER and MIDDLETOWN AREA SCHOOL DISTRICT for claims which may
arise out of or result from PROVIDER's operations under the Agreement, including without limitation (i)
claims because of bodily injury, occupational sickness or disease, or death, whether to PROVIDER's
employees or others and whether or not under a worker's compensation or similar act or law for the
benefit of employees; and (ii) claims because of injury to or destruction of tangible property, including
loss of use resulting therefrom.
(b) Certificates of insurance from the insurance carrier, or their authorized agent, with the appropriate additional
named insured endoresement attached showing MIDDLETOWN AREA SCHOOL DISTRICT as an additional
named insured for primary liability coverage and stating the limits of liability and expiration date which
are reasonably acceptable to MIDDLETOWN AREA SCHOOL DISTRICT shall be filed with and accepted by
MIDDLETOWN AREA SCHOOL DISTRICT before operations are begun.

3. INSURANCE REQUIREMENTS
(a) Commercial General Liability
(i) Minimum acceptable limit of coverage is $1,000,000 per occurrence, $2,000,000 aggregate,
$2,000,000 products and completed operations.
(ii) Coverage must be written on a Standard ISO General Liability Form (CG000l) and must not
contain any specific exclusions relating to contractual, products/completed operations liability,
PROVIDER's protective liability, and explosion, collapse, and underground (XCU) property damage
hazard.
(iii) Depending on the nature and scope of work, higher limits may be required.
(b) Abuse and Molestation Liability
(i) Applicable to organizations whose activities directly relate to children.
(ii) Coverage requirement can be satisfied through the general liability insurance modified to include
abuse and molestation coverage or through a stand alone abuse/molestation form.
(iii) Limits must be equal to or greater than the general liability limits.
(c) Business Auto Liability Insurance
(i) Minimum acceptable limit of coverage is $1,000,000 per occurrence combined single limit for
bodily injury and property damage.
(ii) Coverage must include owned, hired, and non-owned vehicles.
(d) Workers' Compensation
(i) Must provide benefits as mandated by the state workers' compensation statute.
(ii) Minimum acceptable employers' liability limit is $500,000 for bodily injury by accident and
$500,000 for bodily injury by disease.
(e) Excess Liability Insurance with a minimum acceptable limit of coverage of $1,000,000 (or the final limit
decided to be appropriate) per occurrence and aggregate. Such coverage shall be excess of the general
liability insurance, business auto liability insurance, and employers liability as required by this
Addendum. MIDDLETOWN AREA SCHOOL DISTRICT must be named as additional insured.
4. OTHER INSURANCE REQUIREMENTS
(a) PROVIDER shall purchase insurance from companies with an A.M. Best rating of "A" or better and
lawfully authorized to do business in the jurisdiction in which the work is located.
(b) Coverage must be written on a "claims made" basis and shall be maintained without interruption from
date of commencement of the rental and/or completion of work.
(c) The PROVIDER shall continuously provide up-dated and current certificate(s) of insurance throughout
the term of the project as coverage expires.
(d) MIDDLETOWN AREA SCHOOL DISTRICT must be named as "additional insured" with regards to general
liability, abuse/molestation liability (if applicable), auto liability and employers' liability.
(e) Cancellation clause: The certificate of insurance must provide thirty (30) day notice of cancellation.
(f) PROVIDER's coverage naming MIDDLETOWN AREA SCHOOL DISTRICT as additional insured shall include
an Endorsement specifying that the PROVIDER's coverage is primary to any other coverage available to
MIDDLETOWN AREA SCHOOL DISTRICT, including, without limitation, coverage maintained by
MIDDLETOWN AREA SCHOOL DISTRICT wherein MIDDLETOWN AREA SCHOOL DISTRICT is the named
insured, and that no act or omission shall invalidate the coverage.

(g) PROVIDER is responsible to pay any and all deductibles and/or self-insured retentions that may apply to the
required insurance.
(h) Failur of PROVIDER to obtain and maintain the required insurance shall constitute a breach of contract
and PROVIDER will be liable to MIDDLETOWN AREA SCHOOL DISTRICT for any and all cost, liabilities,
damages, and penalties (including attorney's fees, court, and settlement expenses) resulting from such
breach, unless MIDDLETOWN AREA SCHOOL DISTRICT provides PROVIDER with a written waiver of the
specific insurance requirement.
(i) None of the requirements contained herein as to the types, limits, or MIDDLETOWN AREA SCHOOL
DISTRICT's approval of insurance coverage to be maintained by PROVIDER are intended to and shall not
in any manner, limit, qualify, or quantify the liabilities and obligations assumed by PROVIDER under the
Contract Documents, any other agreement with MIDDLETOWN AREA SCHOOL DISTRICT, or otherwise
provided by law.
(j) Failure of PROVIDER to provide insurance as herein required or failure of MIDDLETOWN AREA SCHOOL
DISTRICT to require evidence of insurance or to notify PROVIDER of any breach by PROVIDER of the
requirements of this Section shall not be deemed to be a waiver of any of the terms of the Contract
Documents, nor shall they be deemed to be a waiver of the obligation of the PROVIDER to defend,
indemnify, and hold harmless the indemnified parties as required herein. The obligation to procure and
maintain any insurance required is a separate responsibility of PROVIDER and independent of the duty
to furnish a copy or certificate of insurance policies.
