Description:

The City of Bismarck is seeking cost proposals for the removal of twenty (20) ash trees and stumps in the right-of-way. A list of trees to be removed will be provided by the City Forester.

Sealed bids will be received in the office of the City Administrator, until 3:00 p.m. CT, on Monday, March 30, 2026. Bids will be publicly opened and reviewed at 4:00 p.m. CT, on Monday, March 30, 2026, in the Mayor’s Conference Room (4th Floor), 221 N 5th Street, Bismarck, ND 58501.

The proposals must be mailed to the City Administrator (PO Box 5503, Bismarck, ND 58506-5503) or otherwise deposited with the City Administrator (221 N 5th Street, Bismarck, ND 58501, 4th Floor) and shall be sealed and endorsed: “Proposal for Ash Tree and Stump Removal” - Name of the person, Company Name, and phone number of person submitting the bid.

In accordance with North Dakota state law, a separate envelope containing a current North Dakota contractor’s license and a bid bond or certified check* in the amount of five (5) percent of the total amount bid must be attached to the outside of the proposal envelope and labeled “Bid Bond.” Checks or bonds of the unsuccessful bidders will be returned to them after the contract has been signed.
*A certified check may be submitted in lieu of a bid bond if amount of check is less than $10,000.

TREE REMOVAL SPECIFICATIONS
1. GENERAL CONDITIONS
1.1 This project will consist of removing 20 street trees in the ROW as part of an EAB Mitigation Grant
the City was awarded. These removals are also part of the City's Emerald Ash Borer Preparedness
Plan. All 20 trees being removed are Ash. No work will be permitted on Saturday and Sunday,
unless specifically requested or approved by the City Forester.
1.2 The Contractor shall furnish equipment, tools, materials, and labor for this project. It may also
include other city owned properties and private property trees. Methods and manner used in removal
and cleanup shall be subject to the approval of the City Forester .
1.3 The Contractor shall make every attempt to protect all public and private property adjacent to the
work site and along all hauling routes. Any damage to public or private property shall be the sole
responsibility of the contractor and shall be repaired to the satisfaction of the owner of the property
involved.
1.4 Contractor must be a Licensed Arborist with the City of Bismarck. Submit a copy of their current and
valid certificate with the proposal.
1.5 Contractor must provide a Certificate of Workers Compensation Coverage and possess a current ND
Contractors License.
1.6 Certificate of Insurance: The City shall be named as an additional insured with waiver of
subrogation written or marked on the policy (general & auto liability) for the duration of this contract.

1.7 Each firm submitting a proposal must provide a list of all equipment the Contractor proposes to use on
this project.
1.8 The Contractor is responsible for any and all damage incurred during the tree removal process,
including damage to underground irrigation systems. Damaged underground irrigation systems not
satisfactorily repaired within seventy-two (72) hours of damage will be repaired by the City Forester
and the cost will be deducted from the amount due the contractor.
1.9 Contractor will be responsible for providing all traffic control devices such as cones, flashers, and
barricades. No street shall be closed unless approved by the City Forester.

1.10 All safety requirements of the Contractor shall be in accordance with the latest revision of the American
National Safety Standards, ANSI Z133.1 and OSHA standards. When work is performed in a tree,
either by climbing or from an aerial basket, a qualified roundsman shall be within visual or voice
communication.
1.11 The term of the agreement shall be for the duration of the project.
1.12 The successful Contractor is required to provide Delegation of Authority documentation showing who
can sign on behalf of the company when submitting the signed contract.
1.13 The Contractor will protect, defend and indemnify the City, its officers, agents, servants, volunteers and
employees for any and all liabilities, claims, liens, fines, demands and costs including legal fees, of
whatsoever kind and nature which may result in injury or death to any persons, including the contractor's
own employees, and for loss or damage to any property, including property owned or in the care, custody
or control of the city in connection with or in any way incident to or arising out of the occupancy, use,
service, operations, performance or non-performance of work in connection with this contract resulting
in whole or in part from negligent acts or omissions of Contractor, any sub-contractor, or any employee,
agent or representative of the Contractor.
2. COMMENCEMENT AND COMPLETION OF WORK
2.1 Prompt removal of trees and stumps is important. Completion of tree removals is required
by July 15, 2026. Completion of stump removal is required by August 15, 2026.
3. SPECIFICATIONS
3.1 All trees to be removed are marked with a white dot on the street side of the tree and shall be removed
as close to ground line as possible, with no jagged edges remaining on hinge.
3.2 Driveways shall only be blocked when necessary and for as short a period as possible. Whenever
possible, trucks may not be driven on boulevards. If off the roadway access is necessary, either via
driveway or onto private property, attempt to contact adjacent property owner in advance.

STUMP REMOVAL SPECIFICATIONS
1. GENERAL CONDITIONS
The stump removal list will be generated as a result of the trees being removed through this project.
This project will consist of removing stumps, cleanup of grindings, and back filling with a quality
screened topsoil. The Contractor shall furnish equipment, tools, materials, and labor for this project.
Methods and manner used in removal and cleanup shall be subject to the approval of the City
Forester. No work will be permitted on Saturday and Sunday, unless specifically requested or
approved by the City Forester.
1.1 The Contractor shall make every attempt to protect all public and private property adjacent
to the work site and along all hauling routes. Any damage to public or private property shall
be the sole responsibility of the contractor and shall be repaired to the satisfaction of the
owner of the property involved.
1.2 Contractor must be a licensed arborist with the City of Bismarck. Submit a copy of their
current and valid certificate with the proposal. For stump grinding only, contractors that do
not possess a valid Commercial Arborist License with the City of Bismarck must provide,
along with their quote, a Certificate of Insurance from their insurance provider

2. COMMENCEMENT AND COMPLETION OF WORK
2.1 The contractor shall be required to commence work within five (5) days of receiving stump
removal list.
2.2 Start date - approximately July 16, 2026 and completion by approximately August 15, 2026.
Start date is subject to change upon the removal of the trees.
3. SPECIFICATIONS
3.1 Stumps, including all roots > 3" diameter as well as exposed flare roots, shall be ground to a
minimum depth of 16 inches; backfilled with a quality screened topsoil to approximately 6 inches
above grade at center of stump hole to allow for settling.
3.2 Grindings shall be swept off sidewalk and driveway areas immediately. Any location
where grindings have been left longer than five (5) working days will result in non-payment
for that location.
4. DESCRIPTION OF WORK AREA
4.1 Stump listing provided by City Forester. Stump list will be generated from the Tree Removal list
of this proposal. Refer to pages 5 of this proposal.

* By submission of a proposal, the proposer agrees to be bound by all of the terms and
conditions of the Stump Removal Specifications.
* By submitting a proposal for this RFP, you acknowledge that the city reserves the right to
cancel the contract at any time, for any reason, and seek additional or other assistance as
necessary.
* A contract will be awarded to the lowest or best quote for tree and stump removal and
each job may be awarded separately. The City reserves the right to reject any or all bids,
and to waive irregularities whenever it is for the best interest of the City of Bismarck. Other
criteria include past performance, quality, and reliability.
