Section 1 GENERAL INFORMATION
1.01 Description
The Confederated Tribes of the Colville Reservation (Colville Tribes) Facilities Construction
Department is seeking Professional Services firm (Contractor) registered in the state of Washington
to provide Asbestos (ACM), Mold and Lead-Based Paint (LBP) Risk Assessment/Inspection and
Testing Services of the St. Mary's Mission located in Omak, Washington. The services provided
must meet objectives as described herein.
Our business hours are Monday thru Thursday 7:00 a.m. and 5:30 p.m. excluding Saturdays,
Sundays, Tribal and Federal holidays.
1.02 Introduction
The Confederated Tribes of the Colville Reservation is a Sovereign Nation. Presidential Executive
Order established the Colville Indian Reservation in 1872, with a land base of 1.4 million acres
located in north central Washington State. The Administrative Headquarters are located at the
Colville Indian Agency Campus, approximately 2 miles south of Nespelem, WA with offices located
throughout our reservation.
1.03 Purpose of Sealed Bid
The purpose of this RFP is to solicit proposals from qualified Professional Services Firms and
establish a Contract for Asbestos (ACM), Mold and Lead-Based Paint (LBP) Risk Assessment
/Inspection and Testing Services to comply with National Emissions Standard for Hazardous Air
Pollutants (NESHAP) 40 CFR Part 61, Occupational Safety and health Administration 29 CFR
1926.1101 and applicable portions of AHERA. These regulations require the owner to inspect a
building for the presence of any asbestos-containing material (ACM) prior to undertaking
construction, remodel, renovation, maintenance, or demolition to the building, and to provide
inspection results to affected contractors or employees. The instructions on proposal preparation,

required documents, eligibility requirements and evaluation criteria are provided herein.
1.04 General Scope of Work
The Contractor shall provide all permits; meet all regulatory requirements and all activities necessary
to perform a complete job of Asbestos, Mold and Lead survey of the St. Mary's Mission structures.
Interior and exterior accessible spaces of the buildings shall be inspected for the presence of friable
and non-friable Asbestos-Containing Materials (ACM). ACM activities shall conform to or exceed
requirements of the Environmental Protection Agency (EPA) Asbestos Hazard Emergency Response
Act (AHERA) (40 CFR Part 763). In addition, interior and exterior painted surfaces of each building
shall be inspected for LBP using field portable XRF methods. A LBP Risk Assessment will be
performed on each building where LBP is documented by inspection. LBP Inspection and Risk
Assessment activities shall conform to or exceed requirements of the 1999 Housing and Urban
Development (HUD) regulations of the Housing and Community Development Act (24 CFR Part
35). A separate report is to be provided for each building. Each inspection report will include
findings from the asbestos, lead-based paint and mold inspection. Summaries listing ACM's as well
as components testing positive for LBP are to be provided. At a Minimum, personnel utilized in the
performance of the work shall meet training and certification requirements of 24 CFR Part 35 and 40
CFR Part 736. Proof of current certification as EPA AHERA Building Inspector and EPA LBP Risk
Assessor/Inspector is mandatory.
Tribal Employment Rights Ordinance, TOSHA and Tribal Solid Waste Disposal requirements apply.
Before proceeding with the work, Contractor will have in place all required permits from each
applicable regulating authority.
1.05 Response Format
Contractor proposals must be submitted in the format specified below. Contractors that deviate from
this format may be deemed non-responsive.
1.06 Completeness of Proposal
The Contractor must submit a completed Bid form signed by a Contractor representative authorized
to bind the proposing firm contractually. The Contractor must identify on the form any exceptions
the Contractor takes to the Tribes Sealed Bid Proposal, or declare that there are no exceptions taken.
1.07 Proposal Response Date and Location
Proposals must be submitted electronically to the Confederated Tribes Facility Construction Manager
no later than 02:00 pm, Tuesday, June 30, 2026. A virtual public bid opening will be conducted on
Tuesday, June 30 * 3:00 - 4:00pm

1.08 Proposal Submission
Contractor must provide one (1) electronic copy of their response by emailing
theresa.desautel.adm@colvilletribes.com no later than 02:00 pm, Tuesday, June 30, 2026. Please
use the subject line "St. Mary's Mission Asbestos and Lead Survey".
Contractor must also provide the original copy and (5) hard copies to: Theresa Desautel, Facilities
Construction Manager, for the Colville Tribes. The FedEx delivery address is Theresa Desautel,
Project COR, Colville Tribes, 21 Colville Street, Nespelem, WA 99155. Hard copies of the bids are
to be delivered no later than Thursday, July 2, 2026. All Bids and accompanying documentation will
become the property of the Colville Tribes and will not be returned. Contractors accept all risk of
late delivery of mailed proposal regardless of fault. By submitting his/her proposal, the Contractor
acknowledges that he/she has satisfied him/herself as to the nature and locations of the work
1.09 Site Visitation
A site visit is not required, but is highly recommended. The non-mandatory site visit will be
conducted on Tuesday, June 16, 2026 at 2:00 p.m. at the St. Mary's Mission at 25 Mission Rd,
Omak, WA 98841.
1.10 Contractor's Cost to Develop Proposals
Costs for developing proposals in response to the Bid Notice are entirely the obligation of the
Contractor and shall not be chargeable in any manner to the Colville Tribes.
1.11 Indian Preference
Notice is hereby given that the Confederated Tribes of the Colville Reservation has in force Title 10
Employment and Contracting; Chapter 10-1 Tribal Employment Rights Ordinance (TERO), and
Chapter 10-3 Indian Preference in Contracting, covering but not limited to Indian employment,
Training, contracting and subcontracting. Bidders are directed to contact the Colville Tribal TERO
department to obtain complete information regarding compliance requirements and responsibilities
under the law. It is also incumbent on the contractor and/or subcontractor to insure all compliance
requirements are met prior to commencing work. It is also advisable for covered entities to be aware
of the TERO requirements for certification as an Indian firm, sanctions for non-compliance and the
appeal process.

Section 2 TERMS AND CONDITIONS
2.01 Questions Regarding the Bid Notice
Requests for interpretation/clarification of the Bid Notice document must be made in writing and
submitted to Theresa Desautel, the Facilities Construction Manager, by e-mail
theresa.desautel.adm@colvilletribes.com. Unauthorized contact with other tribal employees
regarding this Bid Notice may result in disqualification. All oral communications will be considered
unofficial and non-binding on the Colville Tribes. Allow seven (7) days for processing written
questions received. All questions must be submitted no later than 10 days from the Bid Notice
Closing Date.

2,02 Bid Notice Amendments
The Colville Tribes reserves the right to request any respondent clarify its proposal or to supply any
additional material deemed necessary to assist in the evaluation of the Bid.
The Colville Tribes reserves the right to change the Bid Notice schedule or issue amendments to the
Bid Notice at any time. The Colville Tribes also reserves the right to cancel or reissue the Bid
Notice. All such addenda must be acknowledged and will become part of the Bid Notice.
2.03 Withdrawal of Proposal
Provided notification is received in writing, proposals may be withdrawn at any time prior to the
proposal response due date and time specified. Proposals cannot be changed or withdrawn after the
time designated for receipt.
2.04 Rejection of Proposals
The Colville Tribes reserves the right to reject any or all proposals, to waive any minor informalities
or irregularities contained in any proposal, and to accept any proposal deemed to be in the best
interest of the Colville Tribes.
2.05 Proposal Validity Period
Submission of a proposal will signify the Contractor's agreement that its proposal and the content
thereof are valid for 90 days following the proposal response deadline unless otherwise agreed to in
writing by both parties. The proposal will become part of the Contract negotiated between the
Colville Tribes and the successful Contractor.
2.06 Proposal Signatures
A representative authorized to obligate the firm must sign the proposal, with the Contractor's address
and telephone information provided. Unsigned proposals will not be considered.
2.07 Insurance Requirements
The Colville Tribes will require the selected Contractor to comply with the insurance requirements as
listed in the Bid Notice; see Attachment "A". Questions regarding insurance requirements can be
discussed with the Tribes Risk Management Office, (509) 634-2447.
2.08 Equal Opportunity Requirements
The Colville Tribes is an equal opportunity employer and requires all Contractors to comply with
policies and regulations concerning equal opportunity. The contractor, in the performance of the
Contract, agrees not to discriminate in its employment because of the employees or applicant's race,
religion, national origin, ancestry, sex, age, or physical handicap.
2.09 Other Compliance Requirements
In addition to the nondiscrimination and affirmative action compliance requirements previously
listed, the Contractor awarded a Contract shall comply with Tribal, Federal, State and local laws,

statutes and ordinances relatively to the execution of the work. This requirement includes, but is not
limited to, protection of public and employee safety and health; environmental protection; waste
reduction and recycling; the protection of natural resources; permits; fees; taxes; and similar subject.
2.10 Ownership of Documents
Any reports, studies, conclusions and summaries prepared by the Contractor shall become the
property of the Colville Tribes.
2.11 Confidentiality of Information
All information and data furnished to the Contractor by the Colville Tribes and all other documents
to which the Contractor's employees have access during the term of the Contract, shall be treated as
confidential to the Colville Tribes. Any oral or written disclosure to unauthorized individuals is
prohibited.
2.12 Hold Harmless
The Contractor shall hold harmless, defend, and indemnify the Colville Tribes and the Tribes
officers, agents, and employees against any liability that may be imposed upon them by reason of the
Contractor's failure to provide worker's compensation coverage or liability coverage.
2.13 Safety
All applicable regulations pertaining to safety, the Contractor shall strictly adhere to; including
Tribal Occupational Safety and Health Act (TOSHA) standards and regulations and OSHA 29CFR
1910.1001 & 1926.1101. Particular care shall be exercised in connection with the operation of
vehicles and other equipment on the site.
2.14 TERO
The Colville Tribal Employment Rights Ordinance (TERO), including the 5% TERO fee shall apply
to the Contract to the extent any of the work to be performed under the Contract is on or near the
Colville Indian Reservation. No work will take place until a TERO Utilization Plan has been signed,
approved, and filed with the TERO office. The 5% TERO fee applies to all contracts over $5,000.00
where the contractor is not a preference-certified entity.
2.15 Bonds are not required for this Project-Disregard the following Section
Bid proposals shall be accompanied by security in the amount of 5% of the total Bid amount on
forms provided by the Contractor surety. The successful Contractor will furnish Performance
Security and Labor and Material Security Bonds in the amount of 100% of the contract and will be
required before start of work.
The bonds will be from an AA rated surety acceptable to the Colville Tribes. If allowable and the
Colville Tribes chooses to select a Contractor that cannot provide bonding, then the Colville Tribes
will retain 20% of the contract price until verified that the Contractor has satisfied all obligations in
relation to the contract.
2.16 Liquidated Damages
For failure to complete the specified work in the identified contract time a penalty of $100.00 per day

will be assessed.
2.17 Davis Bacon Wages are not required for this Project-Disregard the following Section
As this project is not federally funded the Davis Bacon Act does not apply. Contractor will not be
required to submit certified payrolls.
Section 3 REQUESTED SERVICES
3.01 Duration of Services
The Colville Tribes anticipates the service period for this work to be from approximately July 27,
2026 through September 25, 2026. The total duration of the Contract shall not exceed 60 days.
3.02 Information
The forms and required documentation referenced below must be submitted with the Contractor's
proposal. Do not leave any space blank.
Financial and Credit Reference: Provide credit references that can verify the financial
standing of your company; or the most recently audited financial statement for your
company.
Contracting License: Provide a copy of your current Washington State Department of L&I
Contractor Registration.
TERO Certification: Provide a copy of the TERO certification of your firm if applicable.
Company Information: Complete Form # 1.
Client References: Complete Form # 2.
Certification Regarding Debarment: Complete Form #3.
3.03 Previous Contract Performance
If the Contractor had a contract terminated for default during the past five years, all such incidents
must be described. Termination for default is defined as notice to stop performance due to the
Contractor's non-performance or poor performance, and was either (a) not litigated; or (b) litigated
and such litigation determined the Contractor to be in default.
Submit full details of all termination for default experienced by the Contractor during the past five
years; including the other party's name, address, and telephone number.
Present the Contractor's position on the incident. The Colville Tribes will evaluate the facts and
may, at its sole discretion, reject the Contractor's proposal if the facts discovered indicate that
completion of a Contract resulting from this Bid Notice may be jeopardized by selection of the
Contractor. If the contractor has experienced no such termination for default in the past five years, so
declare.

If the Contractor has had a contract terminated for convenience, non-performance, non-allocation of
funds or any other reason, which termination occurred before completion of the contract, during the
past five years, describe fully all such terminations, including the name, address and telephone
number of the other contracting party.
A Contractor response that indicates the requested information will only be provided if and when the
Contractor is selected, as the apparent successful Contractor is not acceptable. Restricting the
Contractor's response to include only legal actions resulting from terminations for default is also not
acceptable.
3.04 Cost Proposal
The Contractor's proposal shall be a Lump Sum Price for each building to include all direct and
indirect costs and inclusive of all applicable taxes and fees to include TERO fees if applicable, to
complete all tasks identified in Section 3.05 Scope of Work and other requirements as provided for
in this Bid Notice.
3.05 Scope of Work
It is agreed upon between the Colville Tribes (Owner) and responding Professional Services Firm
(Contractor) that the intent of this Sealed Bid Notice is to include required insurance, all permits and
regulatory requirements, to provide for Asbestos (ACM), Mold and Lead-Based Paint (LBP) Risk
Assessment/Inspection and Testing Services for ten (10) buildings on the St. Mary's Mission campus
located at 25 Mission Rd, Omak, WA 98841. A map of the St. Mary's Mission campus is shown in
Attachment "B" of this Sealed Bid Notice and in accordance with the following scope of work.
This Sealed Bid Notice includes, but is not limited to all supervision, labor, mobilization, freight,
materials, testing, and equipment to perform and complete the work. In addition, all safety
requirements to include worker and public notification / protection and clean-up as required by and
/or for your work.
The interior and exterior accessible spaces of each building shall be inspected for the presence of
Mold and friable and non-friable Asbestos-Containing Materials (ACM). ACM Inspection activities
shall conform to or exceed requirements of the Environmental Protection Agency (EPA) Asbestos
Hazard Emergency Response Act (AHERA) (40 CFR Part 763).
Interior and exterior painted surfaces of each building shall be inspected in accordance with Chapter
7 of the HUD Guidelines for the Evaluation and Control of Lead Hazards in Housing. An X-ray
Fluorescence (XRF) instrument is to be utilized to directly analyze the concentration of lead in
painted or coated surfaces that are still adhered to the substrate. By using the portable XRF
technology which provides real time data, the need for a LBP Risk Assessment can be determined
immediately and assessment performed before leaving the site. A LBP Risk Assessment is only
required for residences, and where lead-based paint above HUD guidelines is identified. Based on
requirements outlined in Chapter 5 of the HUD Guidelines of the Evaluation and Control of Lead
Hazards in Housing, the risk assessment shall investigate the age, history, management and
maintenance of the dwelling and a visual assessment of condition and potential for damage of
painted surfaces. Limited environmental sampling is to be performed including the collection of 3 to

4 dust wipe samples for lead on residence interior surfaces, and collection of 1 to 3 soil samples for
lead analysis. The work will be performed consistent with the regulations and guidance HUD Section
1017 of the Residential Lead-Based Paint Hazard Reduction Act of 1992, typically referred to as
Title X, Washington State regulations Washington Administrative Code (WAC) 365-230, and
Environmental Protection Agency (EPA) 40 Code of Federal Regulations (CFR) 745.227.
At a minimum, personnel utilized in the performance of the work shall meet training and
certification requirements of 24 CFR Part 35 and 40 CFR Part 763. Proof of current certification as
EPA LBP Risk Assessor/Inspector and EPA AHERA Building Inspector is mandatory.
A separate report is to be provided for each building, and each inspection report will shall include
findings from the asbestos, Mold and lead-based paint inspection, and if conducted, the lead-based
paint risk assessment. Summaries listing ACM's as well as components testing positive for LBP are
to be provided.
The report shall include a table showing approximate quantity of ACMs by category and a
preliminary estimate of abatement cost for all ACMs subject to the federal requirement for removal
prior to renovation or demolition. Appendices shall accompany each report with AHERA and EPA
certificates for the onsite inspectors, detailed tables identifying all suspect asbestos containing
materials tested, all painted components tested, supplemental inspection methodology information,
asbestos results, XRF lead results, photographs of LBP in poor condition and friable asbestos
containing materials and drawings identifying sample locations and room layout. Provide an
electronic copy of the required reports.
Laboratories analyzing asbestos samples shall be NVLAP certified, and laboratories analyzing lead
wipe and soil samples shall be Environmental Lead Laboratory Accreditation Program (ELLAP), and
National Lead Laboratory Accreditation Program (NLLAP) certified.
Contractor will remove and dispose of at an offsite licensed facility or landfill any debris generated
by your work. Contractor shall provide the Colville Tribes the location of all disposal sites to be used
with copies of permits and approvals to include but not limited to the Colville Tribes Chapter 4.13
Solid Waste Compliance and Utilization Disposal Plan for such disposal sites before any waste is
removed from the project or property and after disposal provide disposal tickets from the approved
site or facility.
Section 4 PROPOSAL EVALUATION
4.01 Evaluation Procedures
The Selection will be considered on how well the Contractor's proposal meets the needs of the
Colville Tribes as described in the Contractor 's response to each requirement.
Any proposal that does not contain each element described in this Bid Notice, fully completed,
initialed or executed, as appropriate, may be judged to be incomplete and may not be considered
further.
4.02 Final Selection

If applicable, the Recommendation of Award will be forwarded to the Tribal Council for formal
acceptance.
4.03 Contract Award and Execution
The Colville Tribes reserves the right to make an award without further discussion of the proposal
submitted. Therefore, the proposal should be initially submitted on the most favorable terms the
Contractor can offer. The foregoing should not be interpreted to prohibit either party from proposing
additional Contract terms and conditions during negotiations of the final document.
The Bid Notice document and the successful Contractor's proposal response, as amended by
agreement between the Colville Tribes and the Contractor, including e-mail or written
correspondence relative to the Bid Notice, will become part of the Contract document. Additionally,
the Colville Tribes may verify Contractor representation that appears in the proposal. Failure of the
Contractor to perform as represented may result in elimination of the Contractor from competition or
in Contract cancellation or termination.
The Contractor selected, as the apparent successful Contractor will be expected to enter into a
Contract with the Colville Tribes. If the selected Contractor fails to sign the Contract within five (5)
business days of delivery of the final Contract, the Colville Tribes may elect to cancel the award or
award the Contract to the next highest ranked Contractor. The Colville tribes shall not be bound or
in any way obligated until both parties have executed a Contract. No party may incur any chargeable
costs prior to the execution of a final Contract.
After opening and ranking, an award may be made on the basis of the proposals initially submitted,
without discussion, clarification or modification, or, the Colville Confederated Tribes may discuss
with the selected Contractor offers for cost reduction and other elements of the Contractor proposal.
If the Colville Confederated Tribes determines that it is unable to reach a contract satisfactory to the
Colville Confederated Tribes with the selected Contractor, then the Colville Tribe will terminate
discussions with the selected Contractor and proceed to the next Contractor in order of selection
ranking until a contract is reached or The Colville Tribe has rejected all proposals.
The Colville Tribes may not disclose any information derived from the proposals submitted from
competing offers in conducting such discussions.
The Colville Tribes reserves the right to award a Contract for all or any portion of the requirements
proposed by reason of this request, award multiple Contracts, or to reject any and all proposals if
deemed to be in the best interests of the Colville Tribes and to re-solicit for proposals, or to reject
any and all proposals if deemed to be in the best interests of the Colville Tribes and to temporarily or
permanently abandon the procurement. If the Colville Tribes award a contract, it will award the
contract to the offeror or offerors whose proposal is the most advantageous to the Colville Tribes and
offers the best value, considering price and the evaluation factors set forth in the Bid Notice. The
contract file must state in writing the basis upon which the award is made.
