I.Project Purpose & Scope of Work
The City of Buffalo is currently preparing redevelopment strategies for vacant, city-owned
properties in various neighborhoods. As part of this initial redevelopment strategy, the City is
proposing to construct forty (40) single family houses on multiple parcels located in and around
the Masten Park neighborhood. Most sites will be assembled from multiple parcels, with some sites
splitting parcels between one another. Attachment A includes a map of the 40 proposed parcels
overlaying the previous parcels. Attachment B details the proposed parcel dimensions for each of
the forty (40) parcels. The City of Buffalo, Division of Real Estate is requesting bid proposals to
perform Surveys for the forty proposed lots listed in Attachment B and summarized below:

The Scope of Work to be included in this project:
1. Property Boundary, legal description, and easements.
2. The Property must be accurately and properly staked to identify all boundary lines.
3. Names of adjacent Property Owners within 200 feet of the project parcel.
4. Topographic features including spot elevations and one-foot interval contours from a
benchmark relating to (Town/City/State/USGS) datum. Grades shall extend 25 feet
beyond property where possible. Include full width of Right-of-Way(s).
5. Pipe sizes and inverts of utility improvements including, but not limited to, storm
sewer, sanitary sewer, manhole rims and sumps, vent risers, waterlines, meter pits,
valve boxes, electrical lines, gas limes, telephone lines, etc.
6. Location of all structures, monuments, roadways and other paved surfaces, ponds or
other watercourses, poles, fencing, guardrails, curb cuts, etc. Include curb cuts of
adjacent property owners and opposite of Right-of-Way(s).
7. Tree survey identifying all plantings 4-inch diameter and larger by measurement 2 feet
above grade, including species. Approximate limits of brush and/or overgrown
(inaccessible) areas.
8. One (1) stamped/sealed PDF of both the topographic and boundary survey on 24"x36"
sheets.
9. A schedule of when each drawing will be delivered.
II.Submission Requirements
Submissions must include the following information in a brief and concise format. Submissions
should not exceed 4 pages, excluding resumes of key personnel. The City of Buffalo reserves the
right to request additional information during the review of qualifications and to reject any and all
submissions.
A. Contact Information
Name, address, federal tax ID number, telephone number and email address of the firm as well as
the name and title of the individual authorized to negotiate contracts.

B. Approach to Project
All proposals must state how the consultant or consultant team will approach the project. The
proposal should not only restate the Scope of Work but should state any specific tasks that will be
undertaken to accomplish the Project goals. The consultant should also propose any tasks or
subtasks that they believe are required. Each task and subtask (if appropriate) must include the
staff that will be assigned to that task.
C. Project Schedule
A description of the timeframe needed to complete surveys for each of the forty (40) sites. The
City of Buffalo is interested in attaining surveys as soon as possible to meet an expedited project
timeline and would therefore accept surveys upon completion in an ongoing manner. Please
include a project schedule that incorporates the expected start and completion timeframes for
each lot.
D. Experience
A description of similar projects completed by the firm. Please list three examples and include a
contact person for the project who may be contacted as a reference.
E. Fee Proposal
The proposal should include a proposed fee for all services delineated by task as outlined in the
consultant's proposed scope of work. Each proposal shall include a delineation of all costs
attributed to each site's specific requirements. The cost proposal should include the hourly rate of
each staff member who will work on a task and their number of hours by task. Any optional
components or features recommended by the Consultant must be separately referenced and include
any and all costs attributed to such features. Reimbursable expenses should also be listed such as
equipment costs, deliverables, consultant travel, and any printing cost.
F. Additional Required Information
Are there any current legal proceedings involving (and or judgments against) the
o
Consultant and or members of the Consultant team or any of the affiliated individuals
whether listed or not? If so, please explain.
Has the Consultant and or members of the Consultant team or any of the affiliated
o
individuals ever been debarred or prohibited from bidding on work by any state or federal
agencies such as but not limited to the U.S. Department of Housing and Urban
Development, U.S. Small Business Administration, Erie County, and or the Dormitory
Authority of the State of New York? If so, please explain.
III.Instructions for Submissions
Each consultant must submit a full response as detailed in Section 2 Submission Requirements. All
submissions must include three (3) hard copies in an 8 12"x11" document format.
Submissions must be received by registered mail, email or hand delivered and registered at the
reception desk at the address below by 4:00 p.m., Tuesday, June 30th, 2026.

IV.Evaluation Criteria
All submissions received in response to this Request for Proposals will be reviewed by an
evaluation committee consisting of representatives from the Office of Strategic Planning Division
of Real Estate and the Division of Environmental Affairs, and such other City personnel at the
City's sole discretion.
The City will evaluate proposals based on the following selection criteria:
1. Completeness of the Submittal (10%): All required documents have been submitted and
the submission presented in a clear and concise manner;
2. Proposed Scope of Work (30%): The proposed scope of work meets the parameters of this
RFP (including timeliness) and the consultant clearly explains how to accomplish each
work task;
3. Experience and Qualifications (20%): Experience of the team on projects of similar scope
and size, as well as the experience of the staff assigned to each task; and
4. Cost Proposal (20%): Proposed total cost and the reasonableness of costs assigned to each
task.
5. Contracting with Minority and Women Business Enterprises (20%): Per the Mayor's
Executive Order 16-04, all City Departments must incorporate into their Requests for
Proposals (RFPs) or Requests for Qualifications (RFQs) for professional services,
including but not limited to legal, architectural, accounting and engineering services, the
following:
- A minimum of fifteen percent (15%) of the total score of the professional services
response to an RFP or RFQ issued by the City of Buffalo is to be based on the
bidder's minority workforce development, community involvement and vendor
policies;
- A minimum of five percent (5%) of the total score of the professional services
response to an RFP or RFQ issued by the City of Buffalo is to be based on the
bidder's women workforce development, community involvement and vendor
policies.
- The factors to be considered include, but are not limited to, the following:
Workforce Development: Respondents should describe any programs or
o
actions they undertake to attract, recruit, train, retain and promote minority

and female employees, partners and associates and current representation
of minorities and women.
Community Involvement: Respondents should describe any programs or
o
initiatives they sponsor or support that further the development of minority
or women-owned business enterprises in the City of Buffalo.
Vendor Policies: Respondents should describe any procurement policies
o
or practices they have adopted that provide M/WBE suppliers or services
business opportunities.
V.Contracting with Women and Minority Business Enterprises
In accordance with Mayor Sean M. Ryan's commitment to inclusive economic development, and
Governor Hochul's Executive Order No. 8 establishing a policy to promote equal opportunity in
contracting for all persons, without discrimination for minority group members and women and
business enterprises owned by them, and to eradicate the barriers that have impaired access by
minority and women-owned business enterprises to State contracting opportunities, the City of
Buffalo seeks to encourage meaningful partnerships with and participation from certified Minority
and Women-Owned Business Enterprises (M/WBE) at all project levels.
For purposes of this solicitation, the City of Buffalo hereby establishes Minority Business
Enterprise (MBE) and minority workforce utilization goals of 25% and Women Business
Enterprise (WBE) and women workforce utilization goals of 5% during the complete development
of the project, which includes the pre-construction, construction and operation-maintenance phases.
The Consultant as well as sub-consultants must document good faith efforts to provide meaningful
participation by M/WBEs as subcontractors or suppliers in the performance of the contract.
VI.Reservations
1. The City reserves the right to stop the selection process at any time with or without cause. The
City also reserves the right to reject any or all submittals.
2. The City reserves the right to seek additional information from respondents and related entities.
3. The City reserves the right to reject members of a development team.
4. All decisions related to this RFP are subject to all applicable federal, state and local laws and
regulations, and the policies and procedures of the City of Buffalo.
5. All costs associated with the preparation of the submittal, as well as any other related materials,
shall be borne by the respondent.
VII. INDEMNIFICATION/HOLD HARMLESS
For any contract awarded pursuant to the issuance of this RFP, the successful
Offeror shall defend, indemnify and save harmless the City and its officers
and employees from all claims, suits, actions, damages, losses, and costs of
every name, nature, and description to which the City may be subjected or
put by reason of any injury to the person or property of another, or the
property of the City, resulting from the negligence or carelessness, active or
passive, of the Offeror, its employees, agents or subcontractors, in the

performance of any work under the contract. This provision shall include,
but not be limited to, all losses, costs, and damages, which the City may
suffer as a result of any negligent supervision of services or by reason of
injury to the person or property of another, or the property of the City,
resulting from the negligence or carelessness, active or passive, of the
Offeror its or their employees, agents, or subcontractors, or the joint
negligence, active or passive, of the Offeror and others, in the performance
under the contract.
In addition to and in furtherance of the foregoing indemnity, the insurance
coverage described herein must include language that states that the
insurance carrier will defend the City for any and all claims arising or
resulting from the contract. Furthermore, the whole, or so much of the
money to become due under the contract as shall be considered necessary by
the City, may be retained by it until all suits or claims for damages shall
have been settled or otherwise disposed of, and evidence to that effect
furnished to the satisfaction of the City.
VIII. - INSURANCE COVERAGE REQUIREMENTS
The City of Buffalo requires insurance coverage as listed below for this
work. Note: The term "Offeror" shall also include their respective agents,
representatives, employees or subcontractors; and the term "City of
Buffalo" or "City" shall include their respective officers, agents, officials,
employees, volunteers, boards and commissions. The insurance required
shall be written for not less than the scope and limits of insurance specified
hereunder, or required by applicable federal, state and/or municipal law,
regulation or requirement, whichever coverage requirement is greater. It is
agreed and understood that the scope and limits of insurance specified
hereunder are minimum requirements and shall in no way limit or exclude
the City from additional limits and coverage provided. Coverage shall be
primary and non-contributory.
Minimum Scope and Limits of Insurance
1. Worker's Compensation Insurance and Disability Insurance:
With respect to all operations the Offeror performs, the Offeror shall
carry Worker's Compensation Insurance and Disability Insurance in
accordance with the requirements of the laws of the State of New York.
Evidence of Worker's Compensation Insurance and Disability
Insurance must be provided on the New York State approved form. The
Acord form is not acceptable. Each certificate of insurance evidencing
such coverages shall be submitted by the Offeror and must name the
City of Buffalo as certificate holder.

2. Commercial General Liability:
With respect to all operations the Offeror performs, the Offeror shall
carry Commercial General Liability insurance providing for a total limit
of not less than two million dollars ($2,000,000) per occurrence for each
job site or location for all damages arising out of bodily injury, personal
injury, property damage, products/completed operations, and
contractual liability coverage for the indemnification provided under the
contract. Each annual aggregate limit shall not be less than four million
dollars ($4,000,000). A certificate of insurance evidencing such
coverage shall be submitted by the Offeror and must name the City of
Buffalo as additional insured and certificate holder under said policy of
insurance. The City shall also be named as additional insured and
certificate holder under Offeror's excess and umbrella policies.

shall carry Automobile Liability insurance providing at least one million
dollars ($1,000,000) per accident for bodily injury and property damage.
A certificate of insurance evidencing such coverage shall be submitted
by the Offeror and must name the City of Buffalo as additional insured
and certificate holder under said policy of insurance.

negligent acts of the Offeror performed under the contract the Offeror
shall carry Professional Liability insurance providing at least one
million dollars ($1,000,000) per occurrence, three million
($3,000,000) in the aggregate for any wrongful act. A certificate of
insurance evidencing such coverage shall be submitted by the
Contractor and must name the City of Buffalo as certificate holder.
5. "Tail" Coverage:
If any of the required liability insurance is on a "claims made" basis,
"tail" coverage will be required at the completion of this contract for a
duration of 24 months, or the maximum time period reasonably available
in the marketplace. Offeror shall furnish certification of "tail" coverage
as described or continuous "claims made" liability coverage for 24
months following Contract completion. Continuous "claims made"
coverage will be acceptable in lieu of "tail" coverage provided its
retroactive date is on or before the effective date of the pertinent
Contract. If continuous "claims made" coverage is used, Offeror shall be

required to keep the coverage in effect for a duration of not less than 24
months from the end of the Contract.
6. Acceptability of Insurers:
All of Offeror's insurance policies shall be written by insurance
companies admitted in New York and licensed to do business in the State
of New York or otherwise acceptable to the City's Corporation Counsel
in their sole discretion.
7.
TSuhbe cOofnfterraocrt sohrasl:l require subcontractors to provide the same "minimum
scope and limits of insurance" as required herein, with the exception of
Errors and Omissions/Professional Liability Insurance unless Errors and
Omissions/Professional Liability insurance is applicable to the work
performed by the subcontractor. All Certificates of Insurance shall be
provided to Corporation Counsel's office as required herein and are
subject to approval as to form by the Corporation Counsel and are
subject to approval as to sufficiency by the City Comptroller.
8. Aggregate Limits:
Any aggregate limits must be declared to and approved by the City. It
is agreed that the Offeror shall notify the City when fifty percent (50%)
of the aggregate limits are eroded during the contract term. If the
aggregate limit is eroded for the full limit, the Offeror agrees to reinstate
or purchase additional limits to meet the minimum limit requirements
stated herein. The premium shall be paid for by the Contractor/Offeror.
Deductibles and Self-Insured Retentions: Any deductible or self-insured
retentions must be declared to and approved by the City. All deductibles
or self-insured retentions are the sole responsibility of the Offeror to pay
and/or to indemnify.
9. Notice of Cancellation or Nonrenewal:
Each insurance policy required shall be endorsed to state that coverage
shall not be suspended, voided, cancelled, or reduced in coverage or in
limits except upon 30 days prior written notice by certified mail, return
receipt requested, given to the City.
10. Waiver of Governmental Immunity:
Unless requested otherwise by the City, the Offeror and his insurer shall
waive governmental immunity as a defense and shall not use the defense
of governmental immunity in the adjustment of claims or in the defense
of any suit brought against the City.

11. Additional Insured:
The liability insurance coverage, except for Workers Compensation and
Disability Insurance, required for the performance of the Contract shall
include the City of Buffalo as additional insured and certificate holder
but only with respect to the Offeror's activities to be performed under
the contract. Coverage shall be primary and non-contributory with any
other insurance.
12. Certificate of Insurance:
As evidence of the required insurance coverage, the Offeror shall
furnish Certificate(s) of Insurance to the City of Buffalo prior to the
award of the Contract and prior to the Offeror's commencement of work
under the awarded contract. The Certificate(s) will specify all parties
who are endorsed on the policy as Additional Insureds (or Loss Payees).
The certificates and endorsements for each insurance policy are to be
signed by a person authorized by the insurer to bind coverage on its
behalf. Renewals of expiring certificates shall be filed thirty (30) days
prior to expiration. The City reserves the right to require complete,
certified copies of all required policies at any time.

IX.General Requirements
1. Non-Discrimination
The successful Consultant (s) shall not discriminate against any employee or applicant for
employment because of race, color, creed, religion, ancestry, sex, national origin, affection
preference, disability, age, marital status or status with regard to public assistance or as a
disabled veteran or veteran of the Vietnam era. Such prohibition against discrimination shall
include, but not be limited to, the following: employment, upgrading, demotion or transfer,
recruitment or recruitment advertising, layoff or termination, rates of pay or other forms of
compensation and selection for training, including apprenticeship.
The successful Consultant (s) shall agree to post in conspicuous places, available to employees
and applicants for employment, notices to be provided by the City, setting forth this
nondiscrimination clause. In addition, the Consultant (s) shall, in all solicitations or
advertisements for employees placed by or on behalf of the Consultant (s), state that all
