Re-Bid 2026 TREE PLANTING AT VARIOUS LOCATIONS

Notice is hereby given that sealed bids will be received, opened and read in public by a Township Committee at 66 Main Street, West Orange, New Jersey on April  9, 2026 in the Council Chambers Room 116 at 11:00 A.M. Local Prevailing Time for Re-Bid2026 Tree Planting at Various Locations in the Township of West Orange, County of Essex. All work in this bid shall be completed within 60 calendar days after the date of “Notice to Proceed” in accordance with the contract. However, the Township reserves the right to suspend the planting period during the months of December, January, February and March. Sealed proposals will also be accepted by certified mail if they are addressed to the Purchasing Agent of the Township of West Orange, 66 Main Street, West Orange, New Jersey 07052 and clearly indicate that a bid is enclosed for the particular project, the time and date of receipt of bids and bear the name and address of the party submitting the proposal. All proposals by mail must be received by 11:00 A.M. on April 9, 2026

Specifications and forms of bids for the proposed work, prepared by Walt Kipp, Forester, have been filed in the office of the Purchasing Agent, Room 111, 66 Main Street, West Orange, New Jersey 07052 and may be inspected by prospective bidders during business hours of 8:30 A.M. to 4:30 P.M.

Bids must be enclosed in sealed envelopes, bearing the name and address of the bidder, the name of the job, the time and date designated for the receipt of bids, addressed to the Purchasing Agent of the Township of West Orange, and must be accompanied by a Non-Collusion Affidavit and Certified Check or Bid Bond for not less than ten percent (10%) of the amount bid, provided said check need not be more than $20,000.00 or nor shall be less than $500.00 and delivered at the place on the hour named above. The standard Proposal Form and Non-Collusion Affidavit are attached to the specification and bid documents, copies of which will be furnished on application to the Purchasing Agent.

The owner reserves the right to reject any or all Bids, or to waive any Bid Defect where such effect is not determined to the best interest of the Township of West Orange and fairness of the bidding process. The right is also reserved to increase quantities specified in the manner designated in the Contract documents. Contractors and Sub-contractors are required to be registered by the New Jersey Department of Labor at the time Bids will be received by the Project Owner pursuant to the Public Works Contractor Registration Act (P.L. 2003, c.91, N.J.S.A. 34:11-56-51). Effective September 1, 2004, Contractors and Sub-Contractors are also required to be registered by the New Jersey Department of Treasury, Division of Revenue at the time Bids will be received by the Project owner to the Business Registration Act (P.L. 2004, c.57, N.J.S.A. 52-32-44). The contractor and their sub-

contractor(s) shall provide the above certificates with the bid being submitted.

Bidders are required to comply with the requirements of P.L. 1975, C. 127, and N.J.A.C. 17:27 &

N.J.S.A. 10:5-31 et seq., (Affirmative Action), and P.L. 1977, C.33 (Disclosure Statement).

As of March 1, 2026, pursuant to the provisions of P.L. 2025, c.72, all Township of West Orange

current legal notices will be published on the Township’s official website for at least one week, or

other time period as required by law, before transferring the publication to the Legal Notice Archive.

INSTRUCTIONS TO BIDDERS
B-1 INVITATION TO BID
In accordance with the advertisement (Notice to Bidders), Proposals will be received for the
performance of the Project, the designation of which is stated in the advertisement.
Bids are required on the items requested in the Proposal Form for the Project. The prices
bid shall cover all costs of any nature, incident to or growing out of the work including the
cost of all work, labor, materials, equipment, transportation, and all else necessary to
perform and complete the Project in the manner and within the time required, all incidental
expenses in connection therewith, all costs for loss by damage or destruction of the Project,
for any additional expenses on account of unforeseen difficulties encountered, for
settlement of damages and for replacement of damages and for replacement of defective
work and materials.
Before submitting a Proposal, the Bidder shall be familiar with the Specifications, and other
documents that will form parts of the Contract.
B-2 CONTRACT DOCUMENTS
Copies of the Specifications and other proposed Contract Documents are on file and open
to public inspection at the office of the Purchasing Agent, Room 111, 66 Main Street, West
Orange, New Jersey and may be examined and obtained by properly qualified Contractors
at this address between the hours of 8:30 am and 4:30 pm, Monday through Friday,
excluding legal holidays.
B-3 WHERE TO SUBMIT BIDS
Sealed Proposals for the Re-bid 2026 Tree Planting at Various Locations project will be received
by the Township of West Orange, New Jersey at the Municipal Building, 66 Main Street, West
Orange, New Jersey until 11:00 am Prevailing Time, April 9, 2026 in the Council Chambers and
then publicly opened and read aloud. If bids are mailed or delivered prior to bid opening, the bid
shall be addressed exactly as follows:

B-4 INFORMAL PROPOSALS
The Township may consider informal any Proposal not prepared and submitted in accordance
with the provisions hereof and may waive any informalities or reject any and/or all Proposals.

B-5 WITHDRAWING PROPOSALS
Proposals forwarded to the Township before the time of opening of Proposals may be
withdrawn upon written application of the Bidder who shall be required to produce evidence
showing that he is or represents the principal or principals involved in the Proposal.
Proposals may not be withdrawn within twenty-four (24) hours of the stipulated time of opening
of Bids.
B-6 ADDENDA AND INTERPRETATIONS (PRE-BID)
No interpretation of the meaning of the Contract Drawings, Specifications or other Contract
Documents made to any bidder orally are binding in any way. Every request for such interpretation
should be in writing, addressed to the Purchasing Agent, at the address included in the
advertisement and to be given consideration must be received no later than ten (10) days
(Saturdays, Sundays and holidays excepted) prior to the date fixed for the opening of bids. Any and
all such interpretations and any supplemental instruction will be in the form of written addenda to
the specifications which, if issued, will be mailed by registered or certified mail, by certified facsimile
transmission or by certified
delivery service to all perspective bidders (at the respective addresses furnished for such purposes)
not later than seven (7) days, Saturdays, Sundays and holidays excepted, prior to the date fixed for
the opening of bids in accordance with N.J.S.A. 40A:11-23. Failure of any bidder to receive any
such addendum or interpretation shall not relieve the bidder from any obligation under his bid as
submitted. All addenda so issued shall become part of the Contract Documents.
B-7 INSPECTION OF DOCUMENTS
The Bidder should thoroughly examine and familiarize himself with the Specifications and
all other Contract Documents. The Contractor, by the execution of the Contract, shall in no
way be relieved of any obligation under it due to his failure to receive or examine any form
or legal instrument, and the Township will be justified in rejecting any claim based on facts
regarding which he should have been on notice as a result thereof.
B-8 ALTERNATIVE BIDS
No alternative Bids will be considered unless alternative Bids are specifically requested by the
Technical Specifications and Bid Forms.
B-9 BIDDING PROCEDURE
Each Proposal will be made upon the prescribed forms furnished with the Specifications
and will be accompanied by a Bidder’s Certified or Cashier’s Check drawn on a solvent
bank, in the sum of ten percent (10%) of the amount bid but in no case in excess of Twenty
Thousand Dollars ($20,000.00) or in lieu of a Certified or Cashier’s Check, a Bid Bond in
the same amount prepared on the form of Bid Bond attached hereto, duly executed by the
Bidder as principal and having as surety thereon a Surety Company approved by the
Township of West Orange. Such checks or Bid Bonds will be made payable to the Township
of West Orange and will be by it held as a guaranty that in the event the bid is accepted and
a Contract awarded to the Bidder, the Contract will be duly executed, and its performance
properly secured, and in default thereof, said check or Bid Bond and the amount
represented thereby will be retained by the aforesaid Township of West Orange as
liquidated damages.
Proposals will be accompanied, in the case of corporations not chartered in New Jersey, by
proper certificate that such corporation is authorized to do business in the State of New Jersey.
