ElDorado,Kansas,until1:30p.m.,May7th,2026andopenedthereafter. Theclockintheroom
shallbeusedastheofficialtimefortheBidOpening. TheBidsshallbeacteduponattheCity
Commissionmeetingat5:30p.m.,May18th,2026.
2. PlansandSpecificationsmaybesecuredattheofficeoftheCityEngineerat226NVine,
ElDorado,Kansas.
3. ThisprojectisSalesTaxExempt.
DEFINITIONS:
A. BiddingdocumentsincludetheInvitationtoBid,InstructionstoBidders,GeneralSpecificationsfor
alltypesofConstruction,SpecialConditions,BidForm,andproposedContractDocumentsinclud-
inganyAddendaissuedpriortoreceiptofbids.
B. AddendaarewrittenorgraphicinstrumentsissuedpriortotheexecutionoftheContractwhich
modifyorinterpretthebiddingdocuments,includingtheDrawingsandProjectManual,byaddi-
tions,deletions,clarifications,orcorrections. AddendawillbecomepartoftheContractDocuments
whentheConstructionContractisexecuted.
EXAMINATIONOFBIDDINGDOCUMENTS:
Eachbiddershallexaminethebiddingdocumentscarefullyand,nolaterthanseven(7)dayspriortothe
dateforreceiptofbids,shallmakewrittenrequesttotheEngineerforinterpretationorcorrectionorany
ambiguity,inconsistencyorerrorthereinwhichhemaydiscover. AnyinterpretationorcorrectionbyAd-
dendumshallbeissuedtoallbiddersinwriting,andonlyawritteninterpretationorcorrectionshallbebind-
ing.
ADDENDA:
A. Priortothereceiptofbids,Addendawillbemailedordeliveredtoeachprimecontractbidderrec-
ordedbytheEngineerashavingreceivedthebiddingdocuments.
B. BiddersshallacknowledgereceiptofAddendaontheBidForminthespaceprovidedforthesame.
BIDPREPARATION:
A. BidsshallbemadeupontheBidFormorfacsimilethereofasboundinthisProjectManual. Fillin
allblanksontheBidFormclearlywithtypewriterorink. Erasuresorotherchangesinabidmust
beexplainedornotedoverthesignatureofthebidder. Signatureshallbeinlonghandbya
principaldulyauthorizedtosigncontracts;thesignatureshallbeaccompaniedbythecorporateseal

dispositionismadethereof. BidSecurityofallotherbidderswillbereturnedpromptlyafterthe
canvasofbids.

Bond,KansasStatutoryBondwillberequiredinanamountof100%ofthecontractamount.
D. Biddershallrequireattorney-in-factwhoexecutesrequiredbondsonbehalfofthesurety,toaffix
theretoacertifiedandcurrentcopyofhispowerofattorneyindicatingthemonetarylimitofsuch

COMPLETIONTIME:
A. Biddersmustagreefullycompletetheprojectin20workingdaysandcompletednolaterthan
August31st,2026. Biddermaybeginworkuponcompletionofthecontract.
B. Biddersmustagreetopay,asliquidateddamages,thesumof$400foreachworkingdayusedover
theabovestatedconditionsunlessotherwiseprovidedinwriting.

2. Hehasvisitedthesiteandhasfamiliarizedhimselfwiththelocalconditionsunderwhichthe
workistobeperformed.
3. Hisbidisbaseduponthematerials,systemsandequipmentdescribedinthebiddingdocuments
withoutexception.
BIDRECEIVING:
A. Allcopiesofthebid,thebidsecurity,andanyotherdocumentsrequiredtobesubmittedwiththe
bidshallbeenclosedinasealedopaqueenvelopeasprovidedabove. Ifthebidissentbymailthe
sealedenvelopeshallbeenclosedinaseparatemailingenvelopewiththenotation"BIDEN-
CLOSED"onthefacethereof.
B. Bidsshallbedepositedatthedesignatedlocationpriortothetimeanddateforreceiptofbidsindi-
catedintheadvertisementorInvitationtoBid,oranyextensionthereofmadebyAddendum. Bids
receivedafterthetimeanddateforreceipttobidswillbereturnedunopened.

MODIFICATIONORWITHDRAWALOFBID
A. Abidmaynotbemodified,withdrawnorcanceledbythebidderduringthestipulatedtimeperiod
followingthetimeanddatedesignatedforthereceiptofbids,andbiddersoagreesinsubmittinghis
bid.
B. Priortothetimeanddatedesignatedforreceiptofbids,bidssubmittedearlymaybemodifiedor
withdrawnonlybynoticetothepartyreceivingbidsattheplaceandpriortothetimedesignatedfor
receiptofbids.
Suchnoticeshallbeinwritingoverthesignatureofthebidderandmusthavebeenmailedpost-
markedonorbeforethedateandtimesetforreceiptofbids;itshallbesowordedasnottoreveal
theamountoftheoriginalbid.
C. Withdrawnbidsmayberesubmitteduptothetimedesignatedforthereceiptofbidsprovidedthat
theyarethenfullyinconformancewiththeseInstructionstoBidders.
D. BidsecurityshallbeinanamountsufficientfortheBidasmodifiedorresubmitted.
SUBMISSIONOFPOST-BIDINFORMATION:
A. BidderstowhomawardofacontractisunderconsiderationshallsubmittotheEngineer,uponhis
request,aproperlyexecutedContractor'sQualificationStatement,unlesssuchastatementhasbeen
previouslyrequiredandsubmittedasaprerequisitetotheissuanceofBiddingDocuments. TheEn-
gineerreservestherighttointerviewanyorallbiddersbeforethecontractisawarded.
B. UnlesswaivedbytheEngineer,theapparentlowbiddershall,withintwo(2)hoursofbidopening,
submitthefollowinginformationtotheEngineer:
1. AdesignationoftheWorktobeperformedbythebidderwithhisownforces.
2.Thenamesofsubcontractorsandthesuppliersofprincipalitemsofsystemsofmaterialand
equipmentproposedforthework.
C. ThebidderwillberequiredtoestablishtothesatisfactionoftheEngineerandOwnerthereliability
andresponsibilityoftheproposedsubcontractorsandtofurnishandperformtheworkdescribedin
thesectionsoftheProjectManualpertainingtosuchproposedsubcontractor'srespectivetrades.
D. Priortotheawardofthecontract,theEngineerwillnotifythebidderinwritingifeithertheOwner
ortheEngineer,afterdueinvestigation,hasreasonableandsubstantialobjectiontoanypersonor
organizationsuchlist. IftheOwnerorEngineerhasareasonableorsubstantialobjectiontoany
personororganization,thebiddermay,athisoption,(1)withdrawhisbid,or(2)submitanaccepta-
blesubstitutesubcontractor. Intheeventofeitherwithdrawalordisqualificationunderthissubpar-
agraph,bidsecuritywillnotbeforfeited,notwithstandinganythingtothecontraryinparagraph
abovewritten.
E. Subcontractorsandotherpersonsandorganizationsproposedbythebidderandacceptedbythe
OwnerandEngineermustbeusedontheworkforwhichtheywereproposedandacceptedandshall
notbechangedexceptwithwrittenapprovaloftheOwnerandEngineer.
F. Thesuccessfulbidderwillberequiredtofurnish,within15daysoftheContractAward,hispro-
posedstartingdateforthisproject,andsubmitinwritingallprojectscurrentlyundercontract.

REJECTIONOFBIDS:
TheOwnermayrejectanyorallbidsandinparticularabidnotaccompaniedbyanyrequiredbid
securityordatarequiredbytheBiddingDocumentsorabidinanywayincompleteorirregular.
AWARDOFCONTRACT:
ItistheintentoftheOwnertoawardacontracttothelowestresponsiblebidder,providedthebid
hasbeensubmittedinaccordancewiththerequirementsoftheBiddingDocuments,isjudgedtobereasona-
ble,anddoesnotexceedfundsavailable.
LIQUIDATEDDAMAGES:
A. TheOwnerwillsufferfinancialdamageifProjectNo.640isnotsubstantiallycompletedandavail-
ableforusewithinthetimespecified. Portionsoftheworkmaybedeemedsubstantiallycomplete
beforecompletionoftheentireprojectandacceptanceofaportionoftheworkwillnotrelievethe
Contractorfromhisresponsibilitytocompletetheremainingwork. Intheeventthatthisdeadlineis
notmet,ascertifiedbytheEngineer,theContractor(andhissurety)shallbeliableforandshallpay
totheOwnerthesum(s)hereinafterstipulatedasfixed,agreedandliquidateddamagesforeach
workingday,intheamountofFourHundredDollars($400),untiltheworkissubstantiallycom-
pleted.

THIS CONTRACTANDAGREEMENTmade andenteredintoinduplicate
this 18th ofMay,2026,byandbetweentheCityofEl Dorado,Kansas (City),thePartyofthe
First Part,and , hereinaftercalledtheContractor,Partyof theSecondPart.
WITNESSETH: That theCityandContractorfor theconsiderations named,
agree as follows:
Article1. Scopeofthe Work. TheContractorherebyagrees to furnish at its owncost and
expenseall material andlaborandperform all theworkshownonthedrawings, anddescribed
inthespecifications, entitledPlans andSpecifications forworkintheCityofElDorado,Kan-
sas, orso muchthereofas toapply totheworkcoveredbythe resolutionoftheCityCommis-
sion,andshall doeverythingrequiredbythis agreement and contract documents.
Article2. It is agreedthat theNoticetoContractors, Instructions toBidders, Form ofTender,
Contractor's Bond,all proceedings oftheCityCommissionrelatingtothisimprovement,the
writtenbidandproposal oftheContractor, acopy ofwhichis heretoattached,andthegeneral
anddetailedPlans andSpecifications, arebyreferencemadeapart ofthis contract as ifthe
samewereincorporated hereinat length.
Article3. TheContractorshall regularly anddiligentlyprosecutetheproject workandfully
completebyAugust 31st,2026,unless otherwiseprovidedinwriting,signedbytheCity
Manager andapprovedbytheCityCommissionofElDorado,Kansas.
Article4. TheCityshall paytheContractor forperformanceoftheContract,subject toaddi-
tions anddeductions therein,inthemannerset forthintheofficial NoticetoContractors
whichis heretoattached andmadeapart thereof.
Beforepayment is made totheContractor,it shall submit evidencesatisfactorytotheCity
that all payrolls, material bills, andotherindebtedness connectedwiththe workhavebeen
paid.
Article5. Uponwritten noticethat theworkis readyforfinal inspectionandacceptance,the
Engineershall promptly makesuchinspection.WhentheEngineerfinds theworkacceptable
underthecontract andthecontract fullyperformed,theEngineershall issueacertificate,
signedbytheEngineer,statingthat theworkprovidedforinthis contract has beensatisfacto-
rily completedandis acceptedbytheEngineer.
Article6. BeforetheContractorshall be entitledtoreceiveanypayment forworkdoneunder
this contract,it shall fileaPerformance andMaintenanceBondandaStatutoryBond.
