INVITATION TO BID
June 19, 2019
Dear Sir/Madam:
Unified School District No. 489, will receive bids for produce products for the
2019-2020 school year.
All bids must be received in the office of Jessica Younker, Director of Nutrition
Services by 2:00 p.m., Tuesday, July, 23, 2019. Bids will be opened at the above stated
time and bidders are invited to be present. All bids are subject to the following
conditions:
1) Unified School District No. 489 reserves the right to reject any or all bids and to
waive any informalities in the bid procedure.
2) We understand produce is a fluctuating market. This bid will be awarded based
on current prices. Bids may be submitted as firm prices for the school year 2019-2020
or with an escalator clause. A company may submit both pricing structures. This bid
will be awarded as a bottom line bid with our top purchased items carrying the most
weight. Customer service and frequent in-person visits will also play a role in the
award per the discretion of the director.
3) Bids are to be marked, ‘PRODUCE BID’. Bids received after the hour and date
above will not be considered. The bids are to be mailed, delivered to me at the above
address, or emailed to jyounker@usd489.com.
4) Bid sheet enclosed must be completed, signed, and dated by authorized
company representative in order for bid to be valid.
5) This bid is for August 2019 through July 2020. Shipments will be made to 6
individual schools in Hays from 6:00 a.m. – 9:00am every Monday school is in session,
unless otherwise agreed upon prior to bid award. The dollar amounts on bid are an
estimated amount per week. Actual requests will be made on weekly orders and will
fluctuate throughout the year.
6) All prices quoted shall be F.O.B. Hays. Vendor shall be responsible for proper
packaging or crating of all supplies and ensures delivery of all items in good condition,
and shall, at his expense, replace any defective or unsatisfactory items delivered to the
school system.
6) Buy American: Schools participating in the federal school meal programs are
required to purchase domestic products for school meals to the maximum extent
practicable. Domestic product means an agricultural commodity that is produced in
the US and a food product that is processed in the US substantially (at least 51
percent) using agricultural commodities that are produced in the US.
Federal regulations require that all foods purchased for Child Nutrition Program be of
domestic origin to the maximum extent practicable. While rare, two (2) exceptions may
exist when:
-the product is not produced or manufactured in the US in sufficient, reasonable
and available quantities of a satisfactory quality, such as bananas and pineapple; and
-competitive proposals reveal the cost of a domestic product is significantly
higher than a non-domestic product.
ALL products that are normally purchased by Distributor as non-domestic and
proposed as part of this solicitation must be identified with the country of origin.
Distributor shall outline their procedures to notify School when products are
purchased as non-domestic.
Any substitution of a non-domestic product for a domestic product (which was
originally a part of the solicitation), must be approved, in writing, by the Food Service
Director, prior to the delivery of the product to the School.
Any non-domestic product delivered to the School, without the prior, written approval
of the Food Service Director, will be rejected.
Distributor must affirm their willingness to assert their best and reasonable efforts to
ensure compliance with this federal rule.
7) It is the responsibility of the vendor to inquire about any requirement of this
bid that is not understood. Responses to inquiries, if they change or clarify the bid in
a substantial manner, will be forwarded by addenda to all parties that have received a
copy of the bid. The district will not be bound by oral responses to inquiries or written
responses other than addenda. Inquiries should be made to Jessica Younker, Director
