CONSTRUCTION SERVICES AGREEMENT GENERAL SCOPE OF SERVICES

CITY OF ATLANTA

EMERGENCY ON CALL SERVICES FOR DEBRIS REMOVAL

Scope of Services:

The City of Atlanta ("the City") is seeking hourly rate quotes from qualified firms and individuals who are willing and able to provide various types of equipment with experienced drivers/operators to assist City personnel with the permanent removal and disposal of debris, ice, and snow (herein referred to as "obstruction") due to severe weather of disaster. Emergency services are defined as treatment and/or clearing roadways, bridges, culverts, parking lots, sidewalks, steps, ramps, landings, crosswalks, entryways, and other public property throughout or owned by the City and demolition of structures. Selected contractors shall provide all labor, equipment, tools, materials, and supervision necessary to remove obstructions in the event of snow/ice abatement, and any other disaster. This contract will be used by the Department of Transportation, whose point of contact will be Ibrahim Abousaud; Department of Parks and Recreation, whose point of contact will be Doug Voss; Department of Public Works, whose point of contact will be Michael Mason; Department of Watershed Management, whose point of contact will be Tahaya Xuarez; and the Department of Enterprise Assets Management, whose point of contact will be Remy Saintil.

The City of Atlanta reserves the right to award multiple awardees that are determined to be responsible and responsive.

PART A- REQUIRED SCOPE OF SERVICES

Snow and Ice Abatement Removal Service Activities to Include:

Pretreatment activities to support anti-icing efforts and Treatment activities to support deicing efforts with City approved chemicals and/or materials including brine and sodium chloride.

Snow plowing and removal.

Snow hauling to City of Atlanta designated facility/site.

Non-Hazardous Debris Removal Service Activities to Include:

Debris removal of non-hazardous materials for processing and disposal/reuse in accordance with state law, to include the following.

Fallen/damaged trees and tree branches affecting COA property and the Right-of-way

Trash, concrete sections/pieces, large boulders and stones, furniture, etc.

Tires

All debris associated with illegal dumping on COA property.

PART B- OPTIONAL SCOPE OF SERVICES

Debris Removal Service Activities to Include:

Hazardous Waste- Hazardous waste is a waste that appears on one of the four hazardous waste lists in Title 40 of the Code of Federal Regulations (CFR) Part 261 or exhibits at least one of the following four characteristics:

Ignitability

Corrosivity

Reactivity

Toxicity

Household Hazardous Waste- Household Hazardous Waste is a hazardous product or material used and disposed of by residential consumers including some paints, stains, varnishes, solvents, pesticides, and other products or materials containing volatile chemicals that catch fire, react, or explode under certain circumstances, or that are corrosive or toxic.

White Goods- White goods are household appliances including but not limited to refrigerators, ranges, washers, dryers, water heaters, dishwashers, and other similar items.

Electronic Waste- Electronic waste (e-waste) includes electronics that contain hazardous materials, such as computer monitors, televisions, cell phones, and batteries. These products may contain minerals and chemicals that require specific disposal methods.

Soil, Mud, and Sand- Floods, landslides, winds, and storm surges often deposit soil, mud, and sand on improved public property and public rights-of-way. Facilities commonly affected by this type of obstruction include streets, sidewalks, storm and sanitary sewers, water treatment facilities, drainage canals and basins, parks, and public swimming pools.

Vehicles and Vessels- Vehicles and vessels may be damaged, destroyed, displaced, or lost as a result of a disaster. These vehicles and vessels may eventually be abandoned because of the damage incurred or because the original owners have relocated. Vehicles and vessels may be classified as obstructions if they block public access and critical facilities.

Putrescent Debris- Putrescent debris is any debris that will decompose or rot, such as animal carcasses and other fleshy organic matter.

Infectious Waste- Infectious waste is waste capable of causing infections in humans and can include contaminated animal waste, human blood, blood products, medical waste, pathological waste, and discarded sharp objects (needles, scalpels, or broken medical instruments).

Chemical, Biological, Radiological, and Nuclear- Contaminated Debris-Chemical, biological, radiological, and nuclearcontaminated debris is any debris contaminated by chemical, biological, radiological, or nuclear materials.

Demolition of Structure Debris Demolition of structure debris is components of buildings and structures such as lumber and wood, gypsum wallboard, glass, metal,

roofing material, tile, carpeting and floor coverings, window coverings, pipe, concrete, fully cured asphalt, equipment, furnishings, and fixtures.

Compliance and Requirements:

Removal of any of these items should follow local, state and federal laws. Contractor shall have all licenses, certifications and insurance to complete sections identified in Part A and or Part B if selected.

Adherence to all City, state and federal procurement laws including the 2 CFR 200.

All debris, construction material & obstruction will be taken to a City of Atlanta designated facility/site.

In the event of a disaster involving hazardous materials, the contractor shall notify the City, immediately.

Equipment Inspection and Certification

Each piece of equipment offered will be visually inspected by City personnel. The contactor will ensure that the equipment meets all Federal Department of Transportation and Georgia State Inspection standards as applicable. Location and time of inspection and any needed re-inspection shall be determined and performed at the convenience of the City. Contractor is responsible for calibration of equipment to City specifications. Calibration will be verified by the City prior to deployment. The City reserves the right to reject any equipment if deemed ineffective by the C

Required Equipment:

Contractor(s) must have available all listed equipment as per attached pricing sheet. The City will notify the contractor of required equipment for each event.

Contractor Provided Supervisors:

Any contractor who offers and provides four (4) or more pieces of equipment to the same assignment location shall also provide Supervisors for each shift with a 4-wheel drive vehicle and his/her own cell phone. The number of Supervisors required shall be:

If providing four (4) to nine (9) contracted pieces of equipment: One supervisor with vehicle per shift.

Supervisors responsibilities shall be to ensure their drivers sign in properly, have the necessary equipment, know their assigned routes, participate in monitoring debris and obstruction activities, and remove obstruction according to City standards.

Supervisors will ensure adequate rest periods for drivers. The Contractor must adhere to all federal, state and local labor laws and Occupational Safety and Health Administration safety standards.

Supervisors will be required to inspect the routes during the emergency operations. Supervisors must remain in telephone and Global Positioning System (GPS) (if assigned) contact with assigned Departmental Operational Headquarters at all times during obstruction removal operations.

Driver/Operator Requirements:

The Contractor will ensure each vehicle/piece of equipment will be accompanied and operated by a qualified driver/operator.

The Contractor's drivers/operators shall be at least 18 years of age and capable of working nights. No minors under the age of 18 will be allowed on the City's work site(s), to include in the Contractor's vehicle, where this contract will be carried out.

Under no circumstance shall a Contractor, while performing under the terms of this Agreement, allow or be permitted to have private or minor-aged passengers ride in vehicles while performing work under this Agreement. Contractors observed to allow private or minor-aged passengers in vehicles during obstruction removal operations shall be issued an unsatisfactory performance notice and instructed to immediately cease obstruction removal operations for the remainder of the event.

If the driver/operator is not capable of understanding requisite instructions, the Contractor will be notified, and a replacement driver will be required. Requisite instructions will include: techniques appropriate to the route; detailed yard requirements, such as standby area, as well as parking, road map comprehension and emergency road procedures.

It will be the Contractor's responsibility to provide valid licenses and proper certification for all drivers/operators. Failure to comply with this request constitutes unsatisfactory performance and

may result in cancellation of the contract and/or forfeiture of the demobilization payment. The City may check the validity of driver's licenses with the Department of Motor Vehicles at any time during the contract period.

The Contractor shall be responsible for establishing schedules and must adhere to the federal wage, hour and schedules laws. If the duration of the event requires it, the Contractor shall ensure that properly trained and licensed relief drivers are available to sustain an around-the-clock operation.

Response Requirements -Time for Reporting:

The City will make only one (1) call to the Contractor's lister number or send an email 24

hours prior to the emergency event as notification for the Call-in. The Call-in establishes and tailors the contractor's equipment availability to the emergency event and details the time of

reporting.

The Contractor will be responsible for ensuring that current contact numbers and email addresses are provided to the assigned Departmental Operational Headquarters. The City will establish and advise the Contractor of the time for reporting during this Call-In notification.

The Contractor's vehicles and drivers must report to the assigned Department Operational Headquarters two (2) hours before the established operational start time.

The City reserves the right to ask for immediate mobilization should a catastrophic event occur.

Payment Schedule:

Hourly rate for Emergency Services: The City will pay the Contractor the approved hourly bid rate according to the offered equipment description provided in Section "Cost Proposal". equipment will be paid for at the unit price per hour for emergency operation performed on the roadway. The hourly rate shall include the cost for the truck, drivers, operators, fuel, supplies, tools, and any other equipment or incidentals needed to perform the contracted services. An overtime rate of 1.5 times the labor rate will be paid once the removal has been in operation for more than 40 consecutive hours. At no time after submission of this bid shall the Contractor be permitted to change or adjust its hourly rate.

Standby/Mobilization Rate

In the event an emergency activation is cancelled or does not require deployment after the City issues a call-in, the Contractor shall be compensated the mobilization fee for that event.

Should the Contractor report earlier than the time for reporting, the Contractor will not be paid standby until the time for reporting. If the Contractor reports later than (2) hours, the contractor may be disqualified.

Worksite/ Equipment Damage:

Any damage to existing utilities, equipment, or finished surfaces resulting from work performed pursuant to this Agreement shall be repaired within a reasonable time to the City satisfaction. The Contractor shall be responsible and held liable for any damage caused to City-owned equipment and/or property due negligence of the Contractor, as determined by the City.

Priority:

There will be no guarantee on rate, duration of work, or contract amount. The services will be as needed and determined by the City. The City reserves the right to refuse any contracted equipment that is stated as available on the contract during times of the emergency. If and when the Contractor decides to use its equipment elsewhere during the time of the emergency, the contractor must first confirm with the City that services or equipment are not needed. The City may release equipment; however, the City has the right to recall the equipment for use in the emergency event. If there is any need for the equipment, the City will notify the Contractor at that time and the equipment will be placed in use or on standby within two (2) hours of that notification in accordance with the terms of this scope.

Invoicing Log:

A daily time log recording daily hours worked for each piece of equipment shall be completed and submitted to City staff at end of each shift. signature will be required at the beginning and end of the shift to ensure appropriate documentation of hours worked. The completed time log must be submitted with all invoices before payment is issued.

Performance:

Contractors who fail to perform satisfactorily may be disqualified from further emergency services consideration.

The City of Atlanta reserves the right to award multiple awardees that are determined to be responsible and responsive.
