1 Requirements

1. Part 1: Information and Instruction to Contractors
1. Services Being Procured: This Request for Proposals ("IFB") from qualified contractors
("Contractor" or "Contractors") by the City of Atlanta (the "City") seeks to procure the services
("Services") detailed in the Scope of Services.
2. Contract Duration & Pricing: This Request for Proposals ("IFB") from qualified contractors
('Contractor" or "Contractors") by the City of Atlanta (the "City") seeks to enter into a contract with
an effective period of 36 months and the "City" has the option to renew up to an additional 24
months. All pricing (including any suggested increases due to inflation) from qualified contractors
will be reviewed and adjusted in accordance with the U.S. Bureau of Labor Statistics - Consumer
Price Index.
3. Method of Selection: This procurement is being conducted in accordance with all applicable
provisions of the City of Atlanta's Code of Ordinances, including its Procurement and Real Estate
Code, and the particular method of source selection of the services sought in the IFB is Code
Section 2-1180; Competitive Sealed Proposals. By submitting a Proposal concerning this
procurement, a Contractor acknowledges that it is familiar with all laws applicable to this
procurement, including but not limited to, the City's Code of Ordinances and Charter, which laws
are incorporated into this IFB.
4. No Offer by City; Firm Offer by Contractor: This procurement does not constitute an offer by
the City to enter into an agreement and cannot be accepted by a Contractor to form an
agreement. This procurement is only an invitation for offers from interested Contractors and no
offer shall bind City. A Contractors offer is a firm offer and may not be withdrawn except under
the rules specified in City's Code of Ordinances and other applicable law.
5. Proposal Deadline: Your response to this IFB must be received by the Department of
Procurement, no later than 2:00 P.M., ET on the date specified in the Project Overview. Any
Proposal received after this time will not be considered and will not be accepted by the electronic
procurement system.
5.1. To participate in the City's new eProcurement bid process. Respondents must first register
as a supplier with the City of Atlanta. Prospective suppliers can visit the Department of
Procurement's supplier website at the following address: ATLSuppliers.com
6. Pre-Proposal Conference: Each Contractor is highly encouraged to attend the scheduled Pre-
Proposal Conference. Each Contractor must be fully informed regarding all existing and
expected conditions and matters which might affect the cost or the performance of the Services.
Any failure to fully investigate the Job site(s) and requirements shall not relieve any Contractor
from responsibility for estimating properly the difficulty or cost of successfully performing any
Services. A site tour may be scheduled following the Pre-Proposal Conference.
7. Procurement Questions; Prohibited Contacts: Any questions regarding this IFB should be
submitted in writing to the City's contact person as designated in the Project Overview on or
before the date so designated. Questions received after the designated period will not be
considered. Any response made by City will be provided in writing to all Contractors by
addendum. It is the responsibility of each Contractor to obtain a copy of the addendum issued for
this procurement by monitoring the City's website at www.atlantaga.gov. No Contractor may rely
on any verbal response to any question submitted concerning this IFB. All Contractors and

representatives of any Contractor are strictly prohibited from contacting any other City employees
or any third-party representatives of City on any matter having to do with this IFB. All
communications by any Contractor concerning this IFB must be made to the City's contact
person, or any other City representative designated by the Chief Procurement Officer in writing.
8. Ownership of Proposals: Each Proposal submitted to the City will become the property of the
City, without compensation to a Contractor, for the City's use, in its discretion.
9. Georgia Open Records Act: Information provided to the City is subject to disclosure under the
Georgia Open Records Act ("GORA"). Pursuant to O.C.G.A. 50-80-72(a)(34), "[a]n entity
submitting records containing trade secrets that wishes to keep such records confidential under
this paragraph shall submit and attach the records an affidavit affirmatively declaring that specific
information in the records constitute trade secrets pursuant to Article 27 of Chapter 1 of Title 10
[O.C.G.A 10-1-760 et seq.]"
10. Insurance and/or Bonding Requirements: The insurance and/or Bonding requirements for any
Contract that may be awarded pursuant to this IFB are set forth in the Insurance and Bonding
Requirements attached to this IFB.
11. Applicable City OCC Programs: The City's Office of Contract Compliance ("OCC") Programs
applicable to this procurement are set forth in the Office of Contract Compliance Requirements
attached to this IFB. By submitting a Proposal in response to this procurement, each Contractor
agrees to comply with such applicable OCC Programs.
12. Special Rules Applicable to Evaluation of Proposals: A Contractor may be required to
submit, in writing, the addresses of any proposed sub-Contractors or equipment manufacturers
listed in the Proposal and to submit other material information relative to proposed subcontractor.
The City reserves the right to disapprove any proposed sub-Contractors whose technical or
financial ability, resources or experience are deemed inadequate.
13. Examination of Proposal Documents:
12.1. Each Contractor is responsible for examining, with appropriate care, the complete IFB and
all Addenda and for informing itself with respect to all conditions which might in any way affect the
cost or the performance of any Services. Failure to do so will be the sole risk of the Contractor,
who is deemed to have included all costs for performance of the Services in its Proposal.
Each Contractor shall promptly notify the City in writing should the Contractor find discrepancies,
errors, ambiguities, or omissions in the Proposal Documents, or should their intent or meaning
appear unclear or ambiguous, or should any other question arise relative to the IFB. Replies to
such notices may be made in the form of an addendum to the IFB, which will be issued
simultaneously to all potential Contractors who have obtained the IFB from City.
12.2. The City may, in accordance with applicable law, by addendum, modify any provision or
part of the IFB at any time prior to the Proposal due date and time. The Contractor shall not rely
on the oral clarifications to the IFB unless they are confirmed in writing by the City in an issued
addendum.
14. Oral Presentations and Demonstrations: All responsive Contractors may be required to make
an oral presentation of their proposed solution to the City's Evaluation Committee. The Key
Personnel (or some group thereof) as identified in the Contractor's proposal must be active
participants in the oral presentation. The Contractor's presentation should focus on an
understanding of the capabilities of the proposed solution. The City will notify the responsive

contractors of the date, time, and location for the presentation, and will supply an agenda or
topics for discussion.
15. Cancellation of Solicitation: Pursuant to Section 2-1194 of the City's Code of Ordinances, this
solicitation may be cancelled, and any bid or proposal may be rejected in whole or in part for
good cause when in the best interest of the City.
16. Disqualification of Contractors: Any of the following may be considered as sufficient for
disqualification of a Contractor and the rejection of the Proposal:
a. Submission of more than one Proposal for the same work by an individual, firm,
partnership of Corporation under the same or different name(s);
b. Evidence of collusion among Contractors;
c. Previous participation in collusive bidding on Work for the City;
d. Submission of an unbalanced Proposal, in which the prices quoted for the same items
are out of proportion to the prices for other items;
e. Lack of competency of Contractor (the agreement will be awarded only to a Contractor(s)
rated as capable of performing the Work; the City may declare any Contractor ineligible
at any time during the process of received proposals or awarding the Agreement where
developments arise which, in the opinion of the City, adversely affect the Contractors
responsibility.
f. Lack of responsibility shown by past Work judged from the standpoint of workmanship
and progress; financial irresponsibility, including but not limited to, leaving retainage in
City account.
g. Uncompleted Work for which the Contractor is committed by Agreement, which in the
judgement of the City, might hinder or prevent the prompt completion of Work under this
Agreement if awarded to such Contractor; and
h. Being in arrears on any existing or prior contracts with the City or in litigation with the City
theron or having defaulted on a previous contract with the City.
17. Award of Agreement; Execution: If the City awards an Agreement pursuant to this
procurement, the City will prepare and forward to the successful Contractor an Agreement for
execution substantially in the form included in this IFB.
18. Illegal Immigration Reform and Enforcement Act: This IFB is subject to the Illegal Immigration
Reform and Enforcement Act of 2011 ("IIREA or "the Act"). IIREA was formerly known as the
Georgia Security and Immigration Compliance Act or GSCIA. Pursuant to the Act, the Contractor
must provide with its Proposal proof of its registration with and continuing and future participation
in the E-Verify Program established by the United States Department of Homeland Security. A
completed Contractor Affidavit (Form1), set forth in Part 4; Illegal Immigration Reform and
Enforcement Act Forms, must be submitted with the Proposal. Under state law, the City cannot
consider any Proposal which does not include completed forms. Where the business structure of
a Contractor is such that Contractor is required to obtain an Employer Identification Number (EIN)
for the Internal Revenue Service, Contractor must complete the Contractor Affidavit (Form 1) on
behalf of and provide a Federal Work Authorization User ID Number issued to, the Contractor
itself. Where the business structure of a Contractor does not require it to obtain an EIN, each

entity comprising Contractor must submit a separate Contractor Affidavit (Form 1). It is not the
intent of this notice to provide detailed information or legal advice concerning the Act. All
Contractors intending to do business with the City are responsible for independently apprising
themselves of and complying with the requirements of the Act and assessing its effect on City
procurements and their participation in those procurements. For additional information on the E-
Verify program or to enroll in the program, go to: https://e-verify.uscis.gov/enroll. Additional
information on completing and submitting the Contractor Affidavit (Form 1) precedes the Affidavit.
19. Multiple Awards: The City reserves, at its sole discretion, the option to award to multiple
Contractors. Multiple awards may be made on the total Scope of Services or components of the
Scope of Services.

FENCE MAINTENANCE SERVICES AT DEPARTMENT OF WATERSHED FACILITIES
EXHIBIT A - SCOPE OF WORK & TECHNICAL SPECIFICATIONS
The following outlines the scope of services and responsibilities required of the Contractor but may not be
inclusive of the entire range of services. The specifications describe the quantity and category of work
required. Other parts of the contract (not included here) provide requirements such as insurance,
bonding, and licensing standards, hours of work, work authorizations, etc.
The Contractor shall furnish all labor, equipment, tools, transportation, supervisors and materials
necessary to perform the following tasks in accordance with applicable city and state regulations.
1. GENERAL SCOPE OF WORK: COMPONENTS A, B, C, D and E. The Scope of Work under
the Agreement consists of five (5) components: [I]Component A, Installation of New Fences and
Gates at City of Atlanta's Department of Watershed Facilities (DWM). Component B, Includes
the complete care and maintenance repair guarantee of all Fences and Gates. Policing all areas,
removing all debris, damaged fence, etc. Component C, Installation of New Gate Automator's at
City of Atlanta's Department of Watershed Facilities (DWM). Component D, Includes the
complete care and maintenance repair guarantee of all Gate Automator's. Policing all areas,
removing all debris, damaged gate operator, etc. Component E, Emergency Services,
Contractors shall be available for emergency repairs 24/7 and respond & resolve within 24 hours
for requested repairs or maintenance services.
2. LICENSING. CONTRACTOR shall maintain a valid, General Contractor License, Georgia
Contractor License, Certification in Gate Automation and Installation. Certification in Fence
Installation (Optional).
3. PERSONNEL.
3.1 CATEGORIES. CONTRACTOR shall provide the following personnel as a minimum
requirement:
3.1.1 Full Time Employees:
3.1.1.1 Fence Installation Manager.
3.1.1.2 Fence Installation Supervisor; and
3.1.1.3 Fence Installation Laborers.
3.1.1.4 Gate installation Manager
3.1.1.5 Gate Installation Laborer
3.1.2 Hourly Employees, to be utilized on an as needed basis, and invoiced in accordance with
the Hourly Rates listed in Exhibit A-2, Form A-2, are as follows:

3.2 REQUIRED QUALIFICATIONS.
3.2.1 Fence Installation MANAGER. The Fencing Maintenance
Manager shall have a minimum of seven (7) years' full-time experience in a supervisory position
in fence installation and maintenance on projects of similar scope (installation, repair, rebuilding
and demolition of various types of fences. The Fencing Maintenance Manager shall have a
minimum of seven (7) years full-time experience in gate automation, installation and maintenance
on projects of similar scope. The Fence Maintenance Manager shall coordinate with the City of
Atlanta representative concerning all projects.
3.2.2 Fence Installation SUPERVISOR. The Fence Installation Maintenance
Supervisor shall have a minimum of five (5) years' experience in a supervisory position in
fence installation and maintenance on projects of similar scope (installation, repair,
rebuilding and demolition of various types of fences. The Fencing Maintenance
Supervisor shall have a minimum of five (5) years' full-time experience in gate
automation, installation and maintenance on projects of similar scope. He/ She shall be
fully capable of supervising all labor forces, executing all Work, managing people and
shall be totally responsible to the Fence Installation Maintenance Manager.
3.2.3 Fence Installation LABORER. The Fence Installation Maintenance Laborer shall
have a minimum of one (1) full-year experience in Fence maintenance services
(installation, repair, rebuild and demolition) on projects of similar scope. The Gate
Automation Laborer shall have a minimum of one (1) full-year experience in gate
automation maintenance on projects of similar scope.
3.3 APPROPRIATE DRESS. All employees shall be properly dressed at all times. A shirt
with a company identifying patch is required, with matching work pants to accompany the
company shirt and proper work shoes [no sneakers are allowed]. Company jackets with
company identifying patch are required in climate weather.
3.4 STANDARDS OF CONDUCT. CONTRACTORS shall maintain satisfactory standards of
employee competency, conduct, courtesy, appearance, honesty, and integrity and shall
discipline any employee, as may be necessary.
3.5 DISMISSAL OF EMPLOYEES. CITY may request CONTRACTOR to immediately
remove from the Jobsite and/or dismiss any employee found unfit to perform duties due
to, but not limited to, one (1) or more of the following reasons:
3.5.1 Neglect of duty;
3.5.2 Disorderly conduct, use of abusive or offensive language, quarreling, intimidation
by words or action or fighting;
3.5.3 Theft, vandalism, immoral conduct, or any other criminal activity;
3.5.4 Selling, consuming, processing or being under the influence of intoxicants,
alcohol, or illegal substances while on duty; or
3.5.5 Inability to properly perform required work.
3.6 ADDITIONAL PROJECTS. CITY reserves the right to request additional Fencing and
Gate Automation Maintenance projects to be performed at its sole discretion.
3.7 INDUSTRIAL & MUNICIPAL BUILDINGS EXPERIENCE. Shall have a minimum of (3)

years of local, state, and/or federal municipal properties and buildings experience in
fencing maintenance services.
4. EXTERIOR and Interior Fence and Gate Automation MAINTENANCE SERVICES AT DWM
FACILITIES:
COMPONENT A.
4.1 BASE WORK: At the request of the City of Atlanta representative, The CONTRACTOR is
required to install, repair or perform any maintenance service on fences, gates or gate
automators, remove all debris and trash once services are completed.
4.1.1 After the Contract has been executed, the CITY's Designated Representative will issue
written authorization to commence work to provide all fencing, gate and gate automator
maintenance and service on a list of properties. The CONTRACTOR will be responsible
for providing the services as outlined in the scope of work (Section 1 above).
4.1.2 Fence Installation, Gate Installation and Gate Automation Installation will be performed
on a as needed basis. Maintenance repairs will be performed on an as needed basis all
year round.
4.1.3 Hours of Operation shall coincide with the CITY's hours of operation (6:00
a.m. to 6:00 p.m.) Sunday through Saturday, unless otherwise specified by local
jurisdiction(s).
4.1.4 It is the CONTRACTOR responsibility to clean up all acts of GOD.

4.3 CONTRACTOR shall fully execute all the Work as defined in the specifications under this Exhibit
A, Scope of Work and Technical Specifications.
4.4 CONTRACTOR shall provide a detailed written quote for all requested projects. Guarantee all
Fences, Gates and Gate Automator's and ensure the quality of materials. CONTRACTOR shall
not perform any maintenance services without prior authorization from the City Representative.
Contractors shall not enter onto any facility without authorization or escort from the City
Representative.
4.5 CONTRACTOR shall comply with all City, County, and State regulations and restrictions.
CONTRACTOR shall take every precaution to prevent any safety hazards during the term of the
