SECTION 1 - GENERAL INFORMATION

1.1 Background

The Don Young Port of Alaska (POA) owns and maintains petroleum-related

infrastructure used by third-party petroleum operators for transferring fuel between

marine vessels and privately owned storage and transfer facilities (commonly

referred to as “tank farms”).

The POA owned infrastructure includes:

• Petroleum Cement Terminal (PCT) dock,

• Port of Alaska Valve Yard (POAVY),

• Associated pipelines and valves that connect the docks to the POAVY.

Pipelines and storage facilities downstream of the POAVY are owned and operated

by the third-party petroleum users.

The facility operates under a landlord-tenant business model in which; the POA

provides and maintains shared infrastructure and, the petroleum users conduct

independent fuel transfer operations. The POA does not direct or manage the

petroleum user’s operations.

Typical operations involve fuel tankers or barges moored at POA docks and fuel

transferred through the POAVY to or from a privately owned storage facility.

The governing terms of use are established in applicable tariffs and user

agreements. While POA does not take ownership of petroleum products, regulatory

responsibility may still apply based on infrastructure ownership and operational

control. This project will evaluate POA’s role under applicable regulatory definitions

of ‘owner’ and ‘operator.’”

Historically the POA has owned two petroleum related docks; POL1 and POL2.

POL1 is scheduled for decommissioning in May 2026 to make room for a new

cargo Terminal One (T1.) PCT was recently placed in service and is now

available for petroleum operations. This transition—removal of POL1 and addition

of PCT—has introduced new operational configurations and procedures,

prompting the need for clarification of detailed operating procedures and about

roles and responsibilities.

The POAVY has been designated as Sensitive Security Information (SSI) Facility

by the Department of Homeland Security (DHS.) There are specific Federally

required procedures for recognizing, marking, protecting, safely sharing, and

destroying SSI. A SSI non-disclosure agreement will be required for this project.

1.2 Purpose

The purpose of this project is to provide a POA petroleum operations guidelines

document. At a minimum, the document will address the following key components:

Roles and Responsibilities. The project will define and document the POA’s roles

and responsibilities for providing and maintaining petroleum related infrastructure

as well as any obligations the POA may have to the petroleum users. The project

shall specifically identify and distinguish roles and responsibilities between

infrastructure ownership, product ownership, and operational control. A roles and

responsibility matrix will be created as part of this project.

Operating Parameters The project also includes identifying and documenting any

required operating parameters and procedures for petroleum users, including valve

operation procedures for fuel transfer, line stripping procedures, supporting

diagrams and system schematics This effort will supplement existing user manuals

with clear, standardized written guidance. The intent of this project is to develop a

petroleum operations guideline document that defines required operational

practices and responsibilities at a functional level. Development of detailed

standard operating procedures (SOPs) will be limited to those necessary to resolve

identified operational ambiguities of Port owned facilities. Identification of required

tenant specific / tenant responsibility SOP’s is also part of this task.

Regulatory Summary The project will also include a detailed description and

identification of responsibility (POA or petroleum user) for any regulatory

requirements related to fuel transfer such as testing and maintenance

requirements, spill prevention plans etc. This will include a detailed code study for

regulations originating from US Coast Guard (USCG), Alaska Department of

Environmental Conservation (ADEC), The Environmental Protection Agency (EPA)

the Department of Transportation (DOT) and others. Any identified POA required

planning or compliance documents will be provided by this project. It is anticipated

that a spill response plan for certain areas of Port owned infrastructure will be

required. A regulatory summary matrix will be created as part of this project.

the deadline indicated on the RFP cover letter.

1.4 Preparation Costs

The Municipality shall not be responsible for proposal preparation costs, nor for

costs including attorney fees associated with any (administrative, judicial, or

otherwise) challenge to the determination of the highest ranked proposer and/or

award of contract and/or rejection of proposal. By submitting a proposal, each

proposer agrees to be bound in this respect and waives all claims to such costs

and fees.

2.1 Examination of Proposals

Proposers should carefully examine the entire RFP, any addenda thereto, and all
