The Pavement Management unit of SCDOT's Director of Maintenance office utilizes three Pathway
PathRunner Profilers to collect pavement condition data for the state's non-Federal Aid highway
System. These profilers were purchased by SCDOT and have been in service since 2018. They
require on-site coltection system maintenance, upgrades and calibrations to assure specifications
set forth upon their purchase are consistently maintained, allowing the collection of accurate and
repeatable pavement condition data. Our original purchase of this fleet from Pathway included a
Period of free maintenance and system calibrations which was extended by Pathway to 5 years, but
the continuation of our non-Federal Aid pavement condition data collection depends on their
continued troubleshooting, maintenance and calibration verifications. The proprietary mix of
Pavement condition and imaging collection systems are exclusive to Pathway Services.

Describe the Market Based on Research Performed: (See instructions on last ' page for guidance)

This agency proposes to secure a maintenance contract for three Pathway PathRunner pavement
profiters equipped with Laser Crack Measurement Systems (LCMS), Distance Measuring
Instrumentation (DMI), accelerometers, road profile lasers, forward imaging cameras, distress
Collection computer, imaging computer and additional surveying equipment that are no longer
under the original purchase equipment warranty since 12/31/2023. Because the PathRunner
collection systems are intellectual property of Pathway Services, we have no other sources to
remedy collection system failures. Pathway PathRunner profilers are built by Pathway and the
communication between collection system components that includes wiring, software and
hardware are all proprietary. Pathway Services has Previously kept our profiler fleet in proper
working order with Sole Source contracts in 2024 and 2025. An internet search for similar service
providers for Pathway Pathrunners comes up empty. Fully equipped LCMS road profilers are not a
common product that would attract interest in the maintenance, troubleshooting and twice a year
calibration verifications of profilers built by a provider who possesses the sole intellectual
knowledge and capacity to render such services.

Based upon the following determination, Agency proposes to acquire the supplies, construction,
information technology, and/or services described herein from the vendor named above per SC
Code Ann 11-35-1560 and SC Regulation 19-445.2105, Sole Source Procurement.

Pathway Services offers this extended warranty for profiler maintenance to include software and
hardware technical support, software and hardware upgrades, and on-site repairs inclusive of
Parts and labor when required. The hardware covered in this warranty includes on-aboard
computers for data and imaging collection and storage, three forward imaging cameras, the Laser
Crack Measurement System (LCMS), profiler lasers, accelerometers, distance measurement
instrumentation, GPS unit and all wiring associated with the profiling equipment therein. This
warranty includes yearly on-site maintenance and twice a year on-site calibration and data
verification checks required to assure accurate and repeatable data collection for three
PathRunner profilers.

Pathway Services produces the PathRunner profiler and is the only vendor qualified to provide tech
support for the equipment that they designed and for which only they possess the expertise to assure
these SCDOT profilers continue collecting South Carolina's Non-Federal Aid Eligible state-maintained
roadway system.
