TERMS OF DELIVERY

C-1 Purpose
The purpose of this purchase order is for the purchase of labor and material for the
hydraulic cylinder repair and/or replacement.
Price Lists and Parts
All parts shall be provided by the vendor. The City reserves the option to purchase all
parts if deemed to be in the best interest of the City of Cleveland.
All welding materials, fasteners, shop supplies, and environmental charges must be
provided by the vendor and must be included in the labor cost.
All bids shall be based on the latest manufacturer's published price list. Prospective
vendors shall indicate price column, and any discount. The vendor shall fill in
appropriate pages indicating discounts. Only the latest published price list date, prior
to the bid opening date shall be accepted. If no price sheet is available, vendor must
state how the City is to be charged.
Labor charges must remain firm for the duration of the contract period.

C-2 Requirements for rebuilding of cylinders
* Disassemble, clean, inspect, quote, re-assemble, and test
* Paint cylinder to original color
* The cylinder must be re-packed with new seal kits
If the rod, barrel, cylinder head, or packing gland, or any other hard part is beyond
rebuilding, the City of Cleveland, Division of Motor Vehicle Maintenance will advise
the vendor of how to proceed with the repair or replacement of the cylinder.
Bidder must have a minimum of one (1) full shift of repair services per day.
Bidder must have sufficient plant capacity, machine tools, shop equipment, and skilled
labor to perform all work as outlined in this specification.

C-3 The City of Cleveland reserves the right to inspect t the plant and facilities of
the prospective bidder prior to the award of contract and anytime during the term of the
contract.
All parts, components, repair, and all necessary machining must meet the latest
recommended rebuilding procedures of the OEM. All parts must be new replacement
parts equal to OEM or parts approved to be equal quality by the Division of Motor
Vehicle Maintenance.
Comply/Exception
C-4 Warranty
All labor must be warranted by the contractor. All work performed by the vendor must
be guaranteed to be free from defects in workmanship under the City of Cleveland
normal use and service for twelve (12) months from date of delivery or six (6) months
from date of installation. In the event that a cylinder should fail under the vendor
warranty period, the vendor will be responsible for the crediting/paying the City of
Cleveland for the labor charges involved in the removal and replacement of the
cylinder.
C-5 If at any time, the cost of the repair exceeds 60% of the cost of a new hydraulic
cylinder, the City of Cleveland, reserves the right to purchase a new OEM cylinder or
other recognized approved equal. Substitute to be approved by the Division of Motor
Vehicle Maintenance.
C-6 Estimates must show the hours of work to be performed with cost per hour and
the parts cost for each job. If the City of Cleveland elects to continue with estimated
repairs, an ID ticket will be issued before work commences.

All rights and remedies provided in this contract shall be deemed cumulative and
additional; and not in lieu of or exclusive of each other or any other remedy available
to the City of Cleveland at law or in equity.

C-8 Capacity to Perform
The intent of the City of Cleveland is to award the contract in total to one bidder with
the lowest and most qualified bid with sufficient plant capacity and manpower to
perform repairs as outlined in the bid. Vendor shall also have the capability of in-
house storage for multiple vehicles as well as an outdoor secured storage. Garage door
opening is to be a minimum 12 ft. in height and 14 ft. in width. Bidder must also
supply a letter from the manufacturer on their letterhead stipulating that they are, in
fact dealer/distributors for the manufacturer. Partial bids shall be considered
unresponsive.

C-9 Pick-up and Delivery
Bidders shall be capable and willing to pick up, upon request of the Division of Motor
Vehicle Maintenance, items in need of repair. Bidders shall be capable and willing to
deliver, upon completion, repaired items. Pick-up and delivery is to be at no charge to
the city.

Effective Immediately: In accordance with Codified Ordinance 181.13 (l) the City shall
receive competitive sealed bids through email. All City of Cleveland bids estimated to be
less than 50K in value will be submitted and received electronically via email. All bids
must be emailed to CityofClevelandbids@clevelandohio.gov. Upon receipt of your bid,
you will receive a reply indicating your bid has been received.
