ORDINANCE 2728-26

PUBLIC NOTICE is hereby given that the following Ordinance was submitted in writing, introduced, read by title and passed on first reading at a meeting of the Township Committee of the Township of Millburn, in the County of Essex on Tuesday, February 3, 2026. The ordinance will be considered for final passage and adoption at the public hearing held at a meeting beginning at 7:00 p.m. on Tuesday, March 3, 2026 at the Millburn Education Center, 434 Millburn Avenue, Millburn, New Jersey when and where or at such time and place to which said meeting may be adjourned, all persons interested will be given an opportunity to be heard concerning said ordinance. The Millburn Education Center will open for this meeting beginning at 6:45PM and details on the meeting and agenda may be located at town hall, on our website https://www.twp.millburn.nj.us/AgendaCenter or by contacting the Municipal Clerk's Office at 973-564-7092. ORDINANCE NO. 2728-26

ORDINANCE DESIGNATING THE "THE WOODFIELD SHORT HILLS ESTATES" AS A HISTORIC DISTRICT PURSUANT TO THE HISTORIC PRESERVATION ORDINANCE OF THE TOWNSHIP OF MILLBURN

WHEREAS, to avoid the loss of integrity and to preserve the historic character of the area known as The Woodfield Short Hills Estates, the Township Committee wishes to designate The Woodfield Short Hills Estates as an Historic District in accordance with 40:55D-65i. and 65.1 of the Municipal Land Use Law; and,

WHEREAS, the said historic district is bounded by the southeastern border of the district beginning on the south side of Delbarton Drive at 6 Delbarton Drive (Bl. 2405 Lot 5), the southern boundary will continue up the north side of Parsonage Hill Road to 2 Woodfield Drive (Bl. 2902 Lot 3), the northern boundary will continue to follow Woodfield Drive until it reaches Oakey Road and Woodfield Drive turns left at 71 Woodfield Drive (Bl. 2401 Lot 19) and the eastern boundary continues on both sides of Woodfield Drive and when Woodfield Drive terminates at Kenilworth Drive, which boundaries of said district are delineated in the attached map

WHEREAS, there are 54 properties located within this district, inside the boundary there are 26 contributing properties and 28 non-contributing properties, with the specific properties identified in the Table below; and

WHEREAS, said Historic District nomination was proposed by the Historic Preservation Commission with a hearing held on January 22, 2026 in accordance with the provisions outlined in Article 8 of the Township’s Development Regulations for Zoning and approved by the Historic Preservation Commission to be referred to the Township Committee to propose an ordinance for the designation of the Woodfield Short Hills Estates historic district; and

WHEREAS, regulatory requirements are necessary to preserve the integrity of the Woodfield Short Hills Estates historic district, and its distinctive buildings and structures and their materials and historic character-defining features, and to convey the district’s historical significance, and, where the buildings and structures within the district require extensive repair, or if alterations or a new addition is necessary for a new or expanded use, regulatory requirements will assist property owners and applicants to rehabilitate, restore or replace or to add onto such character-defining elements, materials and features of the buildings or structures with the most appropriate design and treatment to avoid loss of historic character or integrity;

WHERAS, the following properties shall be included in the Woodfield Short Hills Estates District designation;

SECTION 2           Consistent with 40:55D-111 of the Municipal Land Use Law, prior to the issuance by the Township of any permit for demolition, destruction, removal, alteration, construction, building, grading, addition(s) or any other changes to the land or to the exterior of the properties, buildings, structures and objects within the aforementioned Woodfield Short Hills Estates Historic District, including roofing and siding, except for ordinary maintenance (excluding roofing and siding), applications to make such changes shall be  referred to the Historic Preservation Commission which shall determine whether the application is minor, in which case it may be considered and acted upon by the Commission’s Minor Work Review Committee in place of the full Commission, and if not minor, the Commission shall consider the application and hold a hearing on it after notice has been provided by the applicant of the hearing on the application pursuant to 40:55D-12 of the Municipal Land Use Law if such notice is required, and the Commission shall submit its report to the administrative officer within 45 days of referral of the application to the Commission.

SECTION 3           This Ordinance shall take effect upon final adoption and publication in accordance with law.
