PUBLIC NOTICE is hereby given that the following Ordinance was submitted in writing, introduced, read by title and passed on first reading at a meeting of the Township Committee of the Township of Millburn, in the County of Essex on Tuesday, April 21, 2026. The ordinance will be considered for final passage and adoption at the public hearing held at a Township Committee meeting beginning at 7:00 p.m. on Tuesday, May 5, 2026 at the Millburn Education Center, 434 Millburn Avenue, Millburn, New Jersey when and where or at such time and place to which said meeting may be adjourned, all persons interested will be given an opportunity to be heard concerning said ordinance. The Millburn Education Center will open for this meeting beginning at 6:45PM and details on the meeting and agenda may be located at town hall, on our website

ORDINANCE NO. 2747-26
ORDINANCE CREATING A TEMPORARY OPEN CONTAINER AREA
WHEREAS, effective January 18, 2022, N.J.S.A. 40:48-1, et seq. was amended to delegate municipalities the specific authority to designate an open container area upon which people are permitted to carry and consume open containers of alcoholic beverages outdoors pursuant to N.J.S.A. 40:48-1(36) and N.J.S.A. 33:1-24.4; and
WHEREAS, it is now legal for municipalities to designate an “Open Container Area” upon which people are permitted to carry and consume open containers of alcoholic beverages outdoors; and
WHEREAS, the Special Improvement District (SID) for the Township known as Explore Millburn-Short Hills is hosting a series of live music performances during the summer of 2026 in the Millburn Courtyard in Downtown Millburn for the purpose of outdoor recreation and community enjoyment; and
WHEREAS, allowing for the consumption of alcoholic beverages will increase the potential use of the space and will support local businesses including beer and wine retailers and restaurants; and
WHEREAS, the Township Committee has the authority to create an “Open Container Area” and wishes to do so for Block 1212 Lots 4 and 28, which includes the Millburn Courtyard and Lot 5 on Fridays and Saturdays from 5:00PM to 10:00PM and Sundays from 1:00PM to 6:00PM starting on Friday, July 10, 2026 and continuing through Saturday, August 29, 2026; and
WHEREAS, any individual consuming alcohol must be at least 21 years old and must present identification if requested and allowable under state law; and
NOW, THEREFORE, BE IT RESOLVED, by the Millburn Township Committee in the County of
Essex and State of New Jersey, hereby creates a Temporary “Open Container Area” for Block 1212 Lots 4 and 28 on Fridays and Saturdays from 5:00PM to 10:00PM and Sundays from 1:00PM to 6:00PM starting on Friday, July 10, 2026 and continuing through Saturday, August 29, 2026 and any violation of the location, times or days stipulated herein will be subject to penalty as prescribed by existing law;
BE IT FURTHER RESOLVED that this Ordinance shall take effect upon passage and publication in accordance with applicable law.
