NOTICE
ORDINANCE 2720-25

PUBLIC NOTICE is hereby given that the following Ordinance was submitted in writing, introduced, read by title and passed on first reading at a meeting of the Township Committee of the Township of Millburn, in the County of Essex on Tuesday, October 21, 2025. The ordinance will be considered for final passage and adoption at the public hearing held at a meeting beginning at 7:00 p.m. on Wednesday, November 12, 2025 at the Millburn Education Center, 434 Millburn Avenue, Millburn, New Jersey when and where or at such time and place to which said meeting may be adjourned, all persons interested will be given an opportunity to be heard concerning said ordinance. The Millburn Education Center will open for this meeting beginning at 6:45PM and details on the meeting and agenda may be located at town hall, on our website https://www.twp.millburn.nj.us/AgendaCenter or by contacting the Municipal Clerk's Office at 973-564-7092. All ordinance exhibits are available upon request for no charge from the Municipal Clerks Office.

ORDINANCE NO. 2720-25
AN ORDINANCE OF THE TOWNSHIP COMMITTEE OF TOWNSHIP OF MILLBURN AWARDING THE LEASE OF GROUND SPACE AND APPROVING THE TOWNSHIP OF MILLBURN ENTERING INTO A LEASE WITH THE WINNING BIDDER FOR GROUND SPACE TO BE USED IN CONNECTION WITH CONSTRUCTION AND OPERATION OF A SMALL WIRELESS FACILITY ON A PORTION OF THE PROPERTY LOCATED AT BLOCK 1602 LOT 2, ALSO KNOWN AS 15 CHATHAM ROAD, OF THE TOWNSHIP OF MILLBURN

WHEREAS, the Local Lands and Buildings Law, at N.J.S.A. 40A:12-14, allows a municipality to lease any real property not needed for public use to the highest bidder by open public bidding at auction or by submission of sealed bids; and

WHEREAS, the Mayor and Township Committee previously solicited bids for the lease of ground space for a portion of the property located at Block 1602 Lot 2, commonly known as 15 Chatham Road (the “Property”); and

WHEREAS, on September 16, 2025, at 10:00AM, the bid solicitation process was completed, and the Mayor and Township Committee have determined that New York SMSA Limited Partnership, d/b/a Verizon Wireless has submitted the highest responsible bid; and

WHEREAS, the Mayor and Township Committee believe it to be in the best interest of the Township of Millburn to award the lease to New York SMSA Limited Partnership, d/b/a Verizon Wireless for the annual rent of four thousand eight hundred ($4800.00) dollars and no cents, with five percent (5%) annual escalators; and

NOW, THEREFORE, BE IT RESOLVED, that the Township of Millburn, pursuant to the terms, conditions and limitations of the bid solicitation process referenced herein, hereby awards to New York SMSA Limited Partnership, d/b/a Verizon Wireless, the lease of 100 square feet of ground space for a small wireless facility that shall be no taller than 40 feet in height, and which shall be designed to accommodate a single wireless service provider, at Block 1602, Lot 2, of the Township of Millburn’s tax map; and

BE IT FURTHER RESOLVED, that the Township of Millburn, via the Township Business Administrator, or other such official with applicable signatory authority, is authorized to enter into a lease agreement with New York SMSA Limited Partnership, d/b/a Verizon Wireless for the use and occupancy of said ground space, in substantially the same form as the bid specifications lease template attached to this ordinance as Exhibit A, and under substantially the same terms and conditions specified in the bid specifications of said bid solicitation, with minor non-substantive deviations to said Exhibit A and from said terms and conditions permissible, with the approval of the Township Attorney; and

BE IT FURTHER RESOLVED, that the Township Business Administrator, or other such official with applicable signatory authority, is authorized to execute any other documents necessary to effectuate this Ordinance; and

BE IT FURTHER RESOLVED, that a copy of this Ordinance shall be filed with the Clerk of the Township of Millburn
