RESOLUTION AUTHORIZING A VIRTUAL CITY AUCTION

WHEREAS, the City of Durham has accumulated surplus personal

equipment consisting of automobiles, trucks, heavy equipment, and light
equipment;

WHEREAS, the City of Durham desires to dispose of these items by

sale at an electronic public auction as provided by North Carolina General
Statute 160A- 270;

NOW THEREFORE, be it resolved by the City Council of the City of

Durham, that the sale by public auction at the time, place, and conditions set
out herein is authorized and directed:

1. The single-day, electronic public auction is to take place on May
17 , 2026, starting at 6:00 pm for equipment housed at the City
of Durham Fleet Maintenance Facility located at 1900 Camden
Avenue, Durham, North Carolina. The electronic public auction
will occur at https://westerauction.hibid.com, which is the same
electronic address where bids can be placed once the auction
begins.

2. Immediately after the auction, auction staff will email an invoice
to each buyer. Buyers will be required to make an appointment
to pay for and pick up their item(s). Payments can be made by
cash, certified check, money order, check when accompanied
by an irrevocable bank letter of guarantee issued by an FDIC-
insured check, or other payment method accepted by the
auctioneer.

3. The Purchasing Manager is authorized as the City Official to
dispose of the surplus property. The Purchasing Manager or
designee is directed to publish solely by electronic means at
least once and not less than ten (10) days before the date of the
auction, a copy of this resolution or a notice summarizing its
content as required by North Carolina General Statute 160A-
270(b).

4. Any items remaining past 4:00 p.m. on May 20, 2026, will be
solely at the risk of the purchaser. All items remaining after
May 23", 2026, will be disposed of with no refund.

5. All items will be sold on an "as is" and "where is" basis. The
City of Durham will make no guarantees and assumes no
responsibility for any of the items. THE CITY DISCLAIMS
ALL WARRANTIES EXPRESS OR IMPLIED, INCLUDING
IMPLIED WARRANTY OF MERCHANTABILITY OR
FITNESS FOR A PARTICULAR PURPOSE.
