The City of Fort Morgan is accepting sealed unit price bids for 2026 On-Call HBP Paving Services
until 3:00 p.m. (our clock) on May 16, 2026 at City Hall located at 110 Main Street, Fort Morgan,
Colorado 80701. If delivered, they are to be sent to 110 Main Street, Fort Morgan, CO 80701. If mailed,
the address is PO Box 100, Fort Morgan, CO 80701. If emailed, the address is

Bids must be received at City Hall by 3:00 p.m. (our clock) on May 16, 2026.
All questions regarding this bid should go to Jim Willis, Streets Superintendent in writing and can be e-
mailed to jim.willis@cityoffortmorgan.com. The cut-off date and time for questions is Monday, May
12, 2026, at 9:00 a.m. It is the responsibility of the prospective bidders to contact Jim Willis, Streets
Superintendent at (970) 542-3987 to verify receipt of questions. Based upon such inquiry, the City
may choose to issue an Addendum.
Opening Date: The opening will not be a public bid opening as it will be subject to staff review of costs,
options, qualifications, possible short list and/or interviews.

I. GENERAL INSTRUCTION
1. Authorized Representative. All bids must be properly signed by an authorized representative of
the company with the legal capacity to bind the company to the contractual agreement.
2. Withdrawal. Bid(s) may be withdrawn up to the date and time set for closing upon written, faxed
or e-mailed notice to the City. Negligence upon part of the bidder in preparing their bid(s) shall not
constitute a right to withdraw a bid(s) after the bid opening. A conditional or unqualified bid may
be cause for rejection.
3. Acceptance of Bid. Only bids properly received will be accepted. Each bid, deposits and
applicable documentation as requested must be submitted in a sealed envelope, if mailed or
delivered, clearly identifying on the outside of the envelope:

II. TERMS AND CONDITIONS
1. During normal maintenance and minor street/utility projects, the Streets Department occasionally
requires services deemed urgent and/or beyond the capabilities of "in-house" resources.
2. The City intends to create a roster of qualified Contractors willing to contract with the City of Fort
Morgan on an as-needed basis and to establish in advance the unit pricing for compensation for
such services.
3. No minimum amount of work is implied or guaranteed under this Invitation.
4. By seeking Bids from Contractors, the city does not represent that it will utilize the Contractor's
services or that it will utilize the Contractor's services any guaranteed number of times over the
course of the year.
5. All Bidders must be properly licensed and/or registered in the services being performed.
Photocopies of company and employee licenses and/or registrations must be submitted with a
properly executed Bid Form. The Bidder/Contractor is responsible for updating information as
necessary.
6. Bid(s) shall be in unit pricing, inclusive of all management, operators, tools, supplies, equipment
and labor necessary to ensure timely performance of the required services on an as-needed basis.
Fueling and vehicle service will not be provided by the city.

7. All Bids must be made on the required Bid Form. All blanks' spaces for Bid prices must be filled in,
in ink or typewritten, and the Bid Form must be fully completed and executed when submitted. Only
one copy of the Bid Form is required. Should the Bidder not provide certain services, or desire not
to bid certain items, the Bid price shall be filled in as "N/A".
8. The Bidder agrees that by submitting its Bid as set forth in its Bid Form, the Bid price will remain in
effect through December 31, 2026.
9. Bidder participants, whether general contractor, prime contractor, joint venture contractor or sub-
contractor, shall provide documented evidence of having completed projects of a similar nature to
the project being bid. Bidder shall be required to submit references of previous projects for which
City verify references. This experience documentation shall be submitted as a requirement for,
being considered for award of the contract for the subject project.
10. No bid bond or performance bond will be required.
11. A two-year Maintenance Warranty or Letter of Credit to cover defective workmanship and materials
may be required for a project, as defined by the Work Order and accepted Notice to Proceed from
the Contractor(s) utilized no later than at the end of the contract year.
12. Successful Contractor(s) will be notified of their placement on the roster by a Notice of Acceptance
within ten (10) days of the bid opening.
13. Each Contractor who receives a Notice of Acceptance will be required to execute the Agreement
and provide current Workman's Compensation Insurance verification and proof of liability insurance
naming the City of Fort Morgan as an additional insured within ten (10) calendar days from the date
when the Notice of Acceptance is delivered to the Bidder(s). THE PRIMARY GENERAL
CONTRACTOR IS RESPONSIBLE FOR VERIFICATION OF WORKMEN'S COMPENSATION
INSURANCE REGARDLESS OF THE BID PRICE FOR ALL SUBCONTRACTORS.
14. The Notice of Acceptance shall be accompanied by the necessary Agreement and sample Bond
forms. In case the Contractor fails to execute the Agreement, the City reserves the right to exercise
its option to consider the Contractor in default, in which case the City will remove the Contractor
from the roster and will not consider the Contractor for any as-needed services pursuant to this
Invitation.
15. Contractors placed on the roster will generally be utilized in order of rate per unit for the services
needed. The City reserves the right; however, to consider responsiveness as well as past
performance in determining which Contractor will be contacted first and given the opportunity to
perform the work. Should the first contacted Contractor be unable or unwilling to perform the
needed service, the City will proceed down the roster as necessary to meet the needs of the city.
16. Contractors who are placed on the roster and who undertake the work will be required to perform
services pursuant to the terms described herein.
17. The City shall retain the right to remove any Contractor from the roster if the Contractor fails to meet
and maintain the terms described in this Invitation or fails to provide services that meet the
standards set in the industry within the demands and time constraints established by the City for the
project.

18. Contractor shall be knowledgeable and comply with all federal, state, and local laws, rules,
regulations and ordinances that may be applicable to the operation of the equipment provided by
Contractor for HBP Paving services.
19. The Contractor shall give adequate attention to the faithful prosecution and completion of this
contract and shall keep on the worksite, during its progress, a competent superintendent and any
necessary assistants. The superintendent shall represent the Contractor in his absence and all
directions given to him shall be as binding as if given to the Contractor.
20. The City reserves the right to inspect all equipment at any time.
21. Invoice: Contractor shall invoice the City within thirty (30) days after the work has been completed.
The City shall make payment within thirty (30) days of receipt of the invoice.
22. Independent Contractor: Contractor must be and remain an independent Contractor with respect to
all services performed under this Invitation. Contractor accepts full and exclusive liability for the
payment of any and all contributions of taxes for social security, worker's compensation insurance,
Medicare, unemployment insurance, or old age retirement benefits, pensions or annuities, now or
hereafter imposed under any state or federal law, salaries or other remuneration paid to persons
hired, including deposits of income tax withholding amount due, and it agrees to indemnify and save
harmless the City from any claims for contributions, taxes or liability thereof.
Contractor's employees shall not be deemed employees of the City for any purpose and shall at all
times be recognized as the Contractor's employees and work under Contractor's control and
supervision. The Contractor's employees shall not acquire any rights or benefits provided for
employees of City of Fort Morgan. However, the Contractor's supervisors shall, in the performance of
services herein requested, comply with the written or verbal instructions received from the Contract
Manager. Supervisors shall then be directly responsible for transmitting this information to the
Contractor's employees.
The Contractor and their personnel are required to adhere to all Federal, State and Local laws that
apply to the provisions of the services under this Contract, as well as those laws that regulate the
public.
23. Provisions: By submitting a Bid Schedule, the Contractor agrees to the following:
a. Worker Without Authorization: Contractor warrants that it does not knowingly hire or engage any
persons not authorized to work in the United States; it takes steps to verify that it does not hire or
engage any persons not authorized to work in the United States; and that any misrepresentation
in this regard or any employment of person not authorized to work in the United States
constitutes is material breach and shall cause for termination of its contract.
b. Insurance: Contractor shall carry such public liability and property damage insurance that will
protect them and the City of Fort Morgan from claims for damages for bodily injury, including
accidental death, as well as for claims for property damages, which may arise from operations
under this Contract whether such operations be by themselves or by anyone directly or
indirectly employed by either of them. The contractor warrants and guarantees that it maintains
adequate insurance with minimum limits of $1,000,000.00, for activities undertaken pursuant to
this Invitation and meet the Insurance Certificate Requirements included with this Invitation.
c. Workers' Compensation: Contractor shall carry Workers' Compensation insurance in amounts
sufficient to cover those obligations imposed by the Workers' Compensation Act of Colorado,

and any other applicable laws for any employee engaged in the performance of work under this
Invitation.
d. Indemnification: Contractor shall indemnify the City against all suits, claims, judgments, awards,
loss, cost or expense (including without limitation attorneys' fees) arising in any way out of the
Contractor's performance or non-performance including but not limited to any injuries or
damages received or sustained by any person, persons, or property on account of the
performance of the Contractor or their employees should such Contractor perform work for the
City pursuant to this Invitation. The Contractor will be responsible for all damages that result
from repair work performed, and will hold the City of Fort Morgan harmless in all claims resulting
from the execution of the repairs for the City of Fort Morgan, i.e. utility disruption, spills, personal
injury, etc. Contractor will defend at its sole expense all such actions with counsel satisfactory to
City and will satisfy any judgment rendered against City in such action.
24. Law: All applicable laws, ordinances, and the rules and regulations of all authorities having
jurisdiction over services of the Project shall apply to this Invitation throughout.
25. Choice of Law: Any action brought to enforce this Invitation shall be brought in the state courts of
Colorado with venue in Morgan County.
26. Nothing stated within this Invitation shall be considered a waiver of the City's immunity under the
Colorado Governmental Immunity Act.
27. THE FOLLOWING ITEMS ARE MANDATORY TO BE SUBMITTED WITH THE BID IN ORDER
FOR THE BID TO BE CONSIDERED:
a. Completed and signed Bid Form/Schedule.
b. Three (3) references of projects of a similar nature to the project being bid.
c. Photocopies of company licenses and/or registrations.
III. SPECIFICATIONS
A. GENERAL
1. The Contractor shall provide adequate traffic control such that traffic shall be directed through
the project with signs, barricades, flag persons when required, or as necessary for the
protection of the work and the safety of the public. All traffic control shall be in conformance
with the MUTCD, 2009 edition. Should the Contractor be notified of unacceptable traffic control,
the Contractor will not be allowed to continue work at that location until the problems are
corrected. Failure to correct the traffic control deficiencies before continuance of the work will
result in non-payment for the work done at the locations in question. Where needed, "No
Parking" signs shall be placed not less than 24 hours in advance of the project.
2. No work shall be performed on local streets before 7:00 A.M. or after 10:00 P.M. each workday,
Monday through Friday, unless otherwise approved by the City Project Representative. No
work shall be performed on arterial or collector streets before 8:30 A.M. or after 4:00 P.M. each
workday, Monday through Friday, unless otherwise approved by the City Project
Representative. There shall be no work allowed on Saturday, Sunday and/or City observed
holiday unless approved by the City Project Representative, 48 hours in advance. At the
completion of each workday, the Contractor shall clean up all construction materials and leave
the construction site in a condition approved by the City Project Representative.

3. The Colorado Department of Transportation (CDOT) Standard Specifications for Road and
Bridge Construction, the CDOT M&S Standards, and ACI Standards, latest editions, are made a
part of these specifications. In case of conflict, documents will have the following priorities.
(a) Specifications and/or Codes,
(b) Standard Detail Drawings,
(b) General Conditions, and
(c) CDOT Specifications and Standards,
(d) ACI Standards
4. The city will not be responsible for any construction down time due to failure on the Contractor's
part to notify utility companies of conflicts.
5. A daily charge will be made against the Contractor for each calendar day that any work shall
remain uncompleted after elapse of contract time shown on work order. This daily charge will
be deducted from any money due the Contractor. This deduction will not be considered a
penalty but as liquidated damages. The liquidated damages for this project will be as stated in
CDOT Standard Specifications for Road and Bridge Construction, 2011 or latest revision,
Section 108.09 (Failure to Complete Work on Time). All liquidated damages covered or paid by
the City to maintain or complete the projects, as agreed upon, will be the full financial
responsibility of the Contractor, and the City, at its sole discretion, may charge such financial
obligations to the Contractor's Surety or seek judicial remedies in the Morgan County District
Court.
6. Waste material, which is deemed not reusable by the City Project Representative, shall be
legally disposed of by the Contractor at his expense. Excess base material, asphalt and clean
concrete may be taken to the City's staging facility.
7. Intersections and driveways shall be closed only for a minimum amount of time. The Contractor
shall coordinate driveway closures with property owners with final approval by each City Project
Representative.
8. The City shall submit and obtain the necessary right-of-way permits for all work within the CDOT
and/or County rights-of-way. The Contractor's work shall not proceed on CDOT and/or County
rights-of-way without proper permits.
9. The work or any part thereof, or any material brought on the site of the work for use in the work
or selected for the same, shall be deemed by the City Project Representative as unsuitable or
not in conformity with the specifications, the Contractor shall, after receipt of written notice
thereof from the City Project Representative, forthwith remove such material and rebuild or
otherwise remedy such work so that it shall be in full accordance with this contract at the
Contractor's sole expense.
10. The Contractor will take the necessary precautions to barricade and/or secure all work or any
part thereof to always protect the public.
11. All overhead power line crossings shall be marked with proper signage.
12. All roadway cross slopes shall be set at a two percent minimum and three percent maximum
unless otherwise approved by the project manager.

B. SCOPE
1. In general, the work consists of roto milling and hauling existing asphalt, stabilizing subgrade
and repaving with hot bituminous pavement. The unit pricing shall consist of furnishing all labor,
materials, and equipment necessary to complete for various infrastructure projects located
throughout the City.

requirements involved. This will involve the City Project Representative providing a listing of the
work to be completed through issuance of a Work Order. This listing will include location
information such as: addresses and/or site maps indicating the HBP Paving locations. A
mutually agreed upon approach will be determined for each job.

4. Intersections and driveways shall be closed only for a minimum amount of time. Prior to
initiation of construction, the Contractor shall coordinate driveway closures with property owners
with final approval by each City Project Representative. This notification can be verbal or in
writing. The Contractor will be responsible for proper backfill and compaction requirements of
all excavations using suitable backfill material. The Contractor will be responsible for removal of
construction material and debris from each site at the end of each day's activity.
5. Contractor will be responsible for cutting and removing any pavement required during repair
jobs. Asphalt shall be saw cut prior to removal.
6. The Contractor will be responsible for proper base preparation and after job completion. The
City Representative will inspect the base preparation and final HBP Paving. All work must be
inspected by the City Project Representative or his/her designee.
7. It is anticipated that all jobs will not require cut and/or fill for subgrade over 2 feet.
8. The Contractor shall protect all work areas and facilities from surface runoff. All areas and
facilities subjected to flooding, regardless of the source of the water, shall be promptly
dewatered.
9. It shall be the Contractor's responsibility to verify the actual location and elevation of all
underground utilities prior to beginning work.
10. The Contractor shall make efforts to prevent or minimize erosion, sedimentation and dust
pollution.
11. The Contractor shall make all efforts to locate irrigation systems and shall use caution to avoid
damaging irrigation systems during the course of work. The Contractor may be held responsible
for repairs to irrigation systems if City staff determines damages were caused by the negligence
and carelessness of the Contractor.
C. WORK SCHEDULE
1. Work Orders: This contract is for acquiring services for on-call HBP Paving. When this type of
work is required to be performed within the City's right-of-way and on public property, the City
will notify the Contractor to discuss the work that needs to be performed.
2. Acceptance: The effective date of the work to be performed will be agreed upon by the City
and the Contractor. Should the Contractor decline more than three (3) consecutive work
requests, the Contractor may be in default of the Contract at the City's sole discretion. The City,
at its sole discretion, may then elect to terminate the Contract.
3. Notice to Proceed: Initial Notice to Proceed (NTP) will be issued in writing by the City. Both
parties shall mutually agree on the number of consecutive calendar days allowed to complete
the work requested prior to Contractor's written acceptance of the Work Order. Should the work
involve improvements that were not included in the bid, the Contractor shall submit a proposal
for the work, and the City shall approve of the proposal prior to work being performed. The

Contractor shall perform the work and request a City Representative inspect the work and
certify work is completed.
4. Period of Performance: The Period of Performance under this Contract shall commence upon
the effective date of initial NTP. All work to be performed under this Contract shall be completed
no later than December 31, 2026, or as specified in the individual work order(s); whichever is
sooner.
5. Certificate of Completion: A Certificate of Completion shall be issued within five (5) days of
final inspection and approval of Work by Contract administrator or his designer. Following a
Certificate of Completion, the Contractor shall submit an invoice with the itemized costs of the
actual work performed. The itemized costs shall reflect the bid prices submitted. The City will
process the invoice for payment upon acceptance of the work performed.
CI. DRAWINGS
1. There are no site-specific plans and/or drawings for this project with the exception the City
representative will describe the work, location and timing requirements involved on a case-by-
case basis through a Work Order.
CII. MATERIALS
1. The selected Contractors unit pricing shall be inclusive of all management, operators, tools,
supplies, equipment, material, transportation and labor necessary to ensure timely performance
of the required services on an as-needed basis, unless otherwise specified in a writing by the
City to the Contractor prior to the starting of any and all projects.
2. The Contractor will provide all materials required for repairs including brick and mortar, cement,
suitable backfill material, stone, crusher run, and all other materials incidental to the work and
necessary to meet all current specifications of the City of Fort Morgan.
3. The City shall provide all truncated domes necessary to complete any work involving curb
ramps and pedestrian crossings. Domes will be red, pre-manufactured fiberglass panels.
4. The City shall provide grassing and make available backfill and class 5/6 base materials.
5. All materials used in the work must be new and suitable for the intended use and must meet all
current specifications as referenced herein.
