1. Request for Bid
The Waukee Community School District is seeking to secure a Bidder to provide comprehensive
driver education and training services, including behind-the-wheel instruction, to students of the
Waukee Community School District (WCSD) in Waukee, Iowa. All instruction shall comply with
applicable federal, state, and local laws and regulations, including Iowa Administrative Code
761-634.
Waukee CSD may Award multiple bidders.

1.1. Please complete and include the following in the Bid:
1.1.1 Complete Attachment A - Pricing Form. (Bids should include all goods and
services necessary to complete the services).
1.1.2 Attachment B- Bid Certification Form.
1.1.3 Attachment C - Conflict of Interest Form.
1.1.4 Attachment E - Sex Offender Acknowledgement Form
1.1.6 Certifications and Qualifications
1.2 Definitions
For the purposes of this RFB and the resulting contract, the following terms shall mean:
"District" means Waukee Community School District (or Waukee CSD) that is issuing the
RFB and shall utilize and purchase the services of the selected Respondent.
"Contract" means the Contractual Agreement(s) entered into with the successful
Respondent(s).
"Contractor" means the awarded Respondent(s) to provide the contractual services
agreed upon.
"Deliverable" means all of the services, goods, products, work, work product, data
(including data collected on behalf of the Agency), items, materials and property to be
created, developed, produced, delivered, performed, or provided by or on behalf of, or
made available through, the Bidder (or any agent, Bidder or subcontractor of the
Contractor) in connection with any contract resulting from this RFB
"Class Cost" means the amount the Bidder will charge the District for an individual who
is enrolled in a driver's training class that concluded during the billing period.

"General Terms and Conditions" means the General Terms and Conditions for Services
OkContracts.
"Bid" means the Bidder's Bid submitted in response to the RFB.
"Bidder" means the company, organization or other business entity submitting a
proposal in response to this RFB.
"Responsible Bidder" means a Bidder that has the capability in all material respects to
perform the scope of work and specifications of the Contract. In determining whether a
Bidder is a Responsible Bidder, the District may consider various factors including, but
not limited to, the Bidder's competence and qualifications to provide the goods or
services requested, the Bidder's integrity and reliability, the past performance of the
Bidder's and the best interest of the Agency and the State.
"Responsive Bid" means a Bid that complies with the material provisions of this RFB.
"RFB" means this Request for Bids and any attachments, exhibits, schedules or addenda
hereto.
2. Contract Term
Final award is contingent upon approval by the Waukee CSD Board of Education and the
District's legal counsel.
After selection, Waukee CSD will meet with the Bidder for the purpose of negotiating an
Agreement that is acceptable to both parties. In the event that the parties do not achieve an
acceptable agreement, Waukee CSD reserves the right, at its sole discretion, to negotiate with
other Bidders. Should the above process not result in a contract, Waukee CSD will re-evaluate
relevant issues and take appropriate follow-up action.
The initial contract term shall be three (3) years, beginning on June 1, 2026 and ending on May
31, 2029 with an option for up to two (2) one-year renewals by mutual agreement.

3.7 Public Records and Requests for Confidential Treatment
Waukee CSD shall treat all information submitted by Bidder as public records unless the
Bidder properly requests that specific parts of the Bid be treated as confidential at the
time of submitting the Bid AND the information is confidential under Iowa or other
applicable law. Waukee CSD's release of public records is governed by Iowa Code
Chapter 22. Bidders are encouraged to familiarize themselves with Chapter 22 before
submitting a Bid. Waukee CSD will copy and produce public records as required to
comply with Chapter 22 or other applicable laws.
3.8 No Minimum Guaranteed
Waukee CSD anticipates that the awarded Bidder will provide services as requested by
Waukee CSD. Waukee CSD will not guarantee any minimum compensation will be paid to
the Respondent or any minimum usage of the Bidders services.

4. Scope of Work
4.1 Bidder Requirements
4.1.1 Bidder shall be listed as an approved driver education provider by the Iowa
Department of Transportation (DOT).
4.1.2 Bidder shall enroll students upon receipt of a request from a student or the
student's parent or guardian.
4.1.3 Bidder shall provide a complete course of driver education instruction designed
to enable students to obtain an Iowa driver's license upon successful completion
of the course and passage of the State-administered driving test.
4.1.4 Bidder shall furnish all necessary instructors, vehicles, equipment, and materials
required to deliver the instruction.
4.1.5 Instruction may occur during or outside normal school hours, at times mutually
agreed upon by the District and the Bidder.
4.1.6 Bidder shall be responsible for the collection of all fees associated with driver
education classes, except as otherwise provided for District-sponsored students.
4.1.7 In the event a student fails to appear for a scheduled behind-the-wheel session
without prior notice, the Bidder may assess a fee to the student per missed
session.
4.1.8 Bidder shall coordinate with the District regarding students eligible for free or
reduced. The District shall pay approved fees on behalf of such students, and the
Bidder shall invoice the District directly. The Bidder shall not charge no-show
fees to the District for subsidized students unless expressly authorized in writing.
4.1.9 Bidder shall provide reasonable assistance to students in completing
requirements necessary to obtain an Iowa driver's license following successful
course completion.
4.2 Personnel
4.2.1 The Bidder shall provide qualified instructors certified by the Iowa Department
of Transportation and authorized by the Iowa Board of Educational Examiners.
4.2.2 All instructors shall comply with District policies and maintain appropriate
professional conduct.
4.2.3 Instructors shall not engage in behavior detrimental to student health, safety, or
welfare.

4.3 Vehicles
4.3.1 The Bidder shall provide properly equipped, licensed, and insured vehicles
compliant with all applicable laws.
4.3.2 Vehicles shall be maintained in safe operating condition and include:
Seating for at least five occupants
Passenger-side brake
Required safety equipment
Student driver signage
4.4 Insurance Requirements
Bidder shall provide evidence of insurance meeting the following minimum
requirements and shall maintain such coverage throughout the term of the Agreement.
4.4.1 Commercial General Liability (Occurrence Form)
General Aggregate: $2,000,000
Products/Completed Operations Aggregate: $2,000,000
Personal and Advertising Injury: $1,000,000
Each Occurrence: $1,000,000
Requirements:
The District shall be named as an Additional Insured on a primary and
noncontributory basis.
A Waiver of Subrogation in favor of the District shall be included.
Governmental Immunities Endorsement.
The policy shall include provisions stating:
The policy does not waive governmental immunity under Iowa law.
Coverage applies only to claims not subject to governmental immunity.
The District retains sole authority to assert governmental immunity
defenses.
Coverage shall not be denied unless a court rules immunity applies.
These provisions do not otherwise alter policy coverage.
4.4.2 Automobile Liability
Combined Single Limit: $1,000,000 per accident
Coverage shall include all owned, non-owned, hired, and leased
vehicles.
Requirements:
The District shall be named as an Additional Insured.
A Waiver of Subrogation in favor of the District shall be included.

4.4.3 Workers' Compensation and Employer's Liability
Workers' Compensation: Statutory limits
Employer's Liability:
$100,000 each accident
$500,000 policy limit (disease)
$100,000 each employee (disease)
Requirements:
A Waiver of Subrogation in favor of the District shall be included.
4.4.4 Umbrella/Excess Liability
Per Occurrence: $5,000,000
Aggregate: $5,000,000
Requirements:
The District shall be named as an Additional Insured on a primary and
noncontributory basis.
A Waiver of Subrogation in favor of the District shall be included.
Coverage shall apply in excess of General Liability and Automobile
Liability policies.
4.4.5 General Insurance Provisions
Policies shall be issued by insurers authorized to do business in Iowa.
Coverage shall not be canceled, non-renewed, or materially modified
without at least thirty (30) days' prior written notice to the District.
The Bidder shall provide certificates of insurance prior to
commencement of services and annually thereafter.
4.5 Reporting Requirements
The Bidder shall provide reporting in an Annual Sales Report submitted in Microsoft
Excel format.
Due within thirty (30) days following each twelve (12) month period after
contract execution.
Shall include: participation counts, fees assessed, fees collected, District-paid
amounts, enrollment, completion rates, pass/fail rates, and incident reporting.
Format shall align with District templates or data specifications.
4.6 Data Privacy and FERPA Compliance
The Bidder shall comply with FERPA and all applicable data privacy laws.
Student data shall be used solely for contract performance.
Bidder shall implement safeguards to protect student data.
Any data breach shall be reported promptly to the District.
Data shall be returned or destroyed upon contract termination.

4.7 District Responsibilities
4.7.1 District shall provide reasonable opportunities for program promotion.
4.7.2 District shall permit job-related communications to staff.
4.7.3 District shall pay approved fees for eligible students.
4.8 Additions/Deletions of Services
Waukee CSD reserves the right to add or delete similar services during the term of the
Contract as necessary.
4.10 Work Rules and Site Safety Conditions
Waukee Community School District buildings have specific security and safety policies
and procedures established which must be adhered to at all times, per their instructions.
4.9.1 Bidder must perform all work services in a safe and orderly manner and must
protect all existing property and persons from damage and injury.
4.9.2 Bidder must conduct all work operations in strict accordance with all applicable
local, State, Federal, OSHA safety law, statute, code and regulations.
4.9.3 All labor, parts and materials must be provided in accordance with the American
Society for Testing and Materials (ASTM) and the American National Standards
Institute (ANSI) and the City of Waukee building and fire codes.
4.9.4 Bidder must at its sole expense immediately correct any dangerous condition
caused by or as a result of the Bidder's work.
4.9.5 If any shutdown of services is required, Bidder must contact the Waukee CSD
Operations Site Administrator prior to shutdown.
4.9.6 Bidder must supply, install and remove all temporary safety and warning
signage, barricades and fencing at Work Service locations as necessary.
Signs and verbiage must be preapproved by Waukee CSD Operations. Signs
must be posted in sufficient quantities in advance to the locations of scheduled
work. (Twenty Four to Forty Eight) 24-48 hours.
Signage must be removed immediately upon final completion of service work at
each location.
4.9.7 Bidder must keep the site clean, and swept on a daily basis, or more often if
required to keep premises clean and safe. The Bidder must remove all materials,
and debris from the work site on a daily basis.

4.9.8 Existing walks, driveways and parking areas are to be kept free and clean at all
times. Parking spaces should be arranged with the District. All parking costs are
the responsibility of the Bidder.
4.10 Hazardous Materials
4.10.1 Where the Bidder encounters suspected areas of hazardous materials such as
asbestos, Bidder must immediately cease operations and notify Waukee CSD
Operations Site Administrator.
4.10.2 No work must proceed until Waukee CSD Operations has the areas tested and
has initiated an approved method of neutralizing or removing the hazard, as per
E.P.A. requirements.
4.10.3 Bidder agrees to accept responsibility for notifying his or her employees of any
hazard which exists and to protect all personnel from the same, holding
harmless Waukee CSD, his or her employees, and the Designer from any claims
against them by the Bidder, his or her employees or third parties.
4.10.4 Waukee CSD must advise the Bidder of any verified hazards.
4.10.5 Waukee CSD will also advise the areas suspected as possible hazards.
4.10.6 If the Bidder is required to work in the suspected hazardous area (but not in
direct contact with the hazard), they will be required to accept responsibility and
cost for notifying and protecting his or her personnel as though the area is
contaminated.
4.10.7 Bidder will not be reimbursed for a reasonable delay in work caused by a hazard
during the job.
4.11 Contract Administrator
The resulting contract administrator will be Julie Janssen, Purchasing Specialist for
Waukee CSD. Any Contract changes must be amended by the Contract Administrator.
4.12 Customer Service
4.12.1 Bidder must designate a Contract manager, customer service representatives,
and project manager capable of adequately serving all Waukee CSD under the
resulting Master Agreement.
4.12.2 Customer Service must respond to all inquiries from the Agency within forty
eight (48) hours of receipt of inquiry.
4.12.3 Bidders must provide the name and contact information of their Customer
Service Representative for the resulting Master Agreement.
