Description

The Centers for Disease Control and Prevention (CDC) intends to award a sole source, firm fixed price contract to LUMINEX CORP.



This contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 13.106-1(b) (SAP) and 41 U.S.C. 3304(a)(1). The North American Industry Classification System code for this procurement is 811210 - Electronic and Precision Equipment Repair and Maintenance. Interested persons may identify their interest and capability to respond to the requirement or submit proposals.



This notice of intent is not a request for competitive proposals; however, all responses received within fifteen (15) days of the issuance of this notice will be considered by the government. A determination by the government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The Newborn Screening Molecular Biology Branch (NSMBB) within the Division of Laboratory Sciences (DLS) requires a vendor capable of providing comprehensive service and preventive maintenance for Luminex instruments. The required capabilities include: (1) providing recurring training for manufacturer-certified engineers; (2) providing access to proprietary technical developments, repair procedures, software application updates, and planned maintenance procedures; (3) implementing instrument or software updates and modifications when mandated by the original equipment manufacturer (OEM); (4) supplying new replacement parts certified to manufacturer specifications; (5) providing 24-hour technical support for hardware and software troubleshooting; (6) providing direct application technical phone support; (7) utilizing factory-trained service engineers; (8) performing maintenance and repairs without reliance on third-party service providers; (9) including labor and travel costs within the maintenance agreement; (10) performing scheduled annual preventive maintenance; and (11) guaranteeing a response time of no more than two (2) business days for all service calls.



Market research identified other firms that provide limited maintenance services for certain instruments; however, these firms do not meet all of the Government’s requirements. Limitations identified include lack of access to proprietary OEM software and updates, inability to provide manufacturer-mandated technical support, use of third-party service providers, and inability to meet required response time standards.



An internet search was conducted to identify vendors offering maintenance contracts for Luminex instruments. Based on the results of the market research, only one vendor was identified as capable of meeting all technical, operational, and response time requirements necessary to support the Government’s mission.
