NOTICE OF INTENT

NOTICE OF INTENT TO AWARD A SOLE-SOURCE CONTRACT

Army Contracting Command – Aberdeen Proving Ground (ACC-APG), Tobyhanna Division, Tobyhanna, PA 18466 intends to award a sole source contract to Orqa D.O.O, JJ Strossmayera 341, Osijek, Slavonia 31000, Croatia.

This supply requirement is for small, unmanned aircraft system kits that include brand name items. The associated North American Industry Classification System (NAICS) code is 336411 with a size standard of 1,250 employees.

Orqa is the only source able to provide fully mission-capable electronics kits that are guaranteed to integrate seamlessly with the RIA-JMTC-produced airframe. Orqa’s solution ensures complete interoperability and mission readiness within Tobyhanna Army Depot required fielding window. Additionally, Orqa is fully compliant with National Defense Authorization Act (NDAA) Section 889, ensuring supply chain integrity and adherence to all applicable federal regulations.

The Government intends to acquire this supply under the guidelines of FAR Part 13, Simplified Acquisitions Procedures and FAR Part 12, Commercial Items. The Government intends to solicit and negotiate directly under the authority of 13.501(a)(1)(ii), sole source (including brand name) under the authority of the simplified procedures for certain commercial items.

This is not a solicitation for competitive quotes. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government. Interested parties may submit information regarding their capability to perform this requirement with no negative impact to the Government regarding schedule, warranty, mark ups, etc. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
