Summary

The proposed contract action is for product or services for which the City of Pembroke Pines intends to negotiate and award with only one source under the authority of the City of Pembroke Pines Code Section 35.18 (C) (3) City standard, single-source and sole-source commodities or services. Any responses received as a result of this Notice of Intent shall be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Responses will not be considered as proposals, bids, or quotes.

The Procurement Department has received a request to make the following sole-source procurement:

Product and/or services to be purchased: NexGen Chlorine Generator Retrofit.
The NEXGEN-80R On-Site Chlorine Generator is a high-capacity, commercial-grade system designed to produce up to 96 pounds of chlorine per day directly on-site. The proposed NexGen Chlorine Generator is a direct retrofit of the existing Chlorine Generator that was specifically built for the Academic Village pool.

Sole Source Justification: The current chlorine generation system at the Academic Village Pool is over 13 years old and has reached the end of its useful life. It suffers from significant corrosion issues and is frequently out of service due to persistent leaks and the need for constant repairs. These ongoing maintenance problems have led to increased operational costs, reduced reliability, and an elevated risk of service disruption. In order to maintain consistent water sanitation and meet safety and health code requirements, it is necessary to replace the failing system.
After multiple attempts to identify alternative providers or suitable piggyback contracts for the replacement of the chlorine generator at the Academic Village Pool, it was determined that only a sole source is available. Commercial Energy Specialists (CES) is the exclusive authorized distributor and service provider for the NexGen80R on-site chlorine generator in the state of Florida. The NexGen80R is the only system that offers a direct, compatible retrofit specifically designed to fit the existing infrastructure at the Academic Village Pool without requiring costly modifications. As such, this procurement qualifies as a sole-source purchase based on the unique compatibility, system requirements, and vendor exclusivity.

Action To Be Taken: No action is required if you agree this proposed purchase is a valid sole-source. If you do not agree that this proposed purchase is a sole-source, you may respond by submitting in writing through OpenGov with the vendor’s name, address, point-of-contact, telephone number, email, and a statement regarding the capability to provide the specified procurement. Interested vendors will be considered only if they respond with clear and convincing documentation that they are capable of meeting or exceeding the requirements stated herein. All responses received by 10:00 am on Tuesday, May 13, 2025 will be reviewed by the City.
