Description
LUMP SUM for furnishing all labor, materials and equipment required for all General Construction
work associated with construction involving the interior fit-out of approximately 13,400 square feet of
floor area on a portion of two (2) levels within the new Family and Matrimonial Court building, located
at 101 County Seat Drive, Mineola, NY, make complete and ready for operation. The Family and
Matrimonial Court project is being completed in phases, and Phase 2 of the project will create a “gray
box” space for the new Family Justice Center. The Scope of Work for this project must be performed
in conjunction with on-going Phase 2 construction activities and conclude simultaneously with the
Phase 2 contract. Both projects shall be administered under a Project Labor Agreement.

Bids on Lump Sum Contracts will be compared on the basis of the total bid price, arrived at by taking the Sum of each Bid Item,
including Allowance Item(s), if any, and plus or minus the cost difference of the Alternate(s), if any, as may be selected by the
Architect and/or Owner. The sum of all “Amounts Bid” will determine the low bid and the subsequent award of this Contract.
Prospective bidders are cautioned to carefully review the requirements of Paragraph H, Bid Security, of The Instructions to Bidders.
SUPPLEMENT TO GENERAL CONDITIONS
SECTION 009100
PART 1 GENERAL
1.01 PROJECT ADMINISTRATION
A. This Project shall be administered under a Project Labor Agreement (PLA). The
Master PLA is available, upon request, from the Nassau County Department of
Public Works. The project specific addendum to that agreement is included in the
bid documents.
1. The Contractor’s attention is directed to the Project Labor Agreement
(PLA) which is incorporated into these Supplemental Conditions by
reference. The act of submitting a bid constitutes Contractor’s assent to
be bound to the terms of the PLA, regarding performance of the work
covered by the PLA.
2. Contractor shall execute a letter of assent identical in substance and form
to the one provided in the bid documents, and shall deliver same to the
County prior to any award of contract.
B. No subcontractors may be employed in performing the Work without prior
written approval of the County. All subcontractors, regardless of tier, must
provide proof of required insurances, prior to commencing work on site.
1. Contractor shall require all subcontractors regardless of tier to execute a
similar letter of assent as a condition precedent to request for approval of
subcontractor.
C. Reporting Requirements: In addition to General Conditions GC-41, each
Contractor will comply with all MBE, LBE, WBE and SDVOB requirements, as
set forth in the Contract Documents, and shall comply with all reporting
requirements as listed therein, and as may be revised by the County from time-
to-time. The Contractor’s initial Utilization Plan must be submitted for approval
by the Commissioner prior to issuance of the Notice to Proceed.
1.02 SUMMARY
A. These Supplemental Conditions contain the Contract Special Conditions and
amends or supplements the General Conditions, as enumerated in this Section,
unless otherwise indicated:
B. Project: The Project is entitled “Family and Matrimonial Court – Family Justice
Center”, and is located at 101 County Seat Drive, Mineola, NY 11501.

C. The project site shares a parking lot with other government buildings and
courthouses. Contractor must ensure that the work of this contract does not
disrupt the continued and continuous use and occupancy of the parking lot or
other nearby facilities.
1.03 DEFINITIONS
A. Project: As used herein, the term “Project” includes the Work, as described in the
Contract Documents.
B. Construction Manager: As used herein, the terms “Construction Manager”, and
the abbreviation “CM” shall mean “a representative of the County, assigned to
manage the construction of the project on the County’s behalf, or a consultant
employed by the County to provide Construction Management services in
connection with the Project”. Contractor shall cooperate fully and completely
with the Construction Manager (CM), and shall perform work when and as
directed by the CM. The CM may require the Contractor to perform work out of
sequence. The CM may direct the Contractor to temporarily omit any section or
portion of the work and later fill in such sections or portions, as may be
necessary for temporary services, or for any other reason. All out-of-sequence
and comeback work will be at no additional cost to the County.
C. Commissioning Agent: As used herein, the terms “Commissioning Agent”, and
the abbreviation “CxA” shall mean “a consultant employed by the County to
provide Commissioning services in connection with the Project”, such as CM,
Architect, Program Manager or any other consultant. Contractor shall cooperate
fully and completely with the CxA and shall coordinate all testing, inspections,
start-up procedures, training and commissioning of mechanical, electrical,
plumbing, and other equipment and systems required by the construction
documents to be provided and/or commissioned by the Contractor.
1.04 CONTRACTOR’S OBLIGATIONS
A. The term “Contractor” is defined in the Agreement; and the terms “General
Construction Contractor”, “Electrical Contractor”, “Mechanical Contractor”,
“Plumbing Contractor”, “Prime Contractor(s)” and “Contractors” as used in the
General Conditions, shall mean “Contractor”. Contractor's obligation to perform
and complete the Work in accordance with the Contract Documents shall be
absolute. None of the following will constitute an acceptance of Work that is not
in accordance with the Contract documents or a release of Contractor's obligation
to perform the Work in accordance with the Contract Documents:
1. Observations by Architect, Engineer, Commissioning Agent, or CM.
2. Recommendations of any progress or final payment by CM.

3. The issuance of a certificate of Substantial Completion or any payment to
Contractor under the Contract Documents.
4. Use or occupancy of the Work or any part thereof by the County.
5. Any acceptance by CM or CxA, or any failure to do so.
6. Any review and approval of a Shop Drawing or Sample submittal or the
issuance of a notice of acceptability of Architect.
7. Any inspection, test or approval by others.
8. Any correction of defective Work by the County or CM.
B. Contractor’s attention is directed to New York State Finance Law Article 9,
Section 139 F. In connection therewith, Contractor is required to pay each of his
subcontractors/suppliers within 7 days of receipt of payment from the County, an
amount representing the value of work/material supplied by each
subcontractor/supplier for whose work/material the Contractor was paid.
C. Pursuant to the Article in the Agreement entitled “Prevention of Delay”, Clause
GC-42 of the General Conditions, and the terms of the Project Labor Agreement,
Contractor’s forces shall work harmoniously in the same areas, if necessary, with
the forces of all other Contractors. Contractor is responsible for maintaining
labor harmony throughout the course of the project and shall advise the CM
immediately of any labor disputes experienced or anticipated, and shall take the
necessary steps to resolve such disputes. Should questions of trade jurisdiction
arise, the Contractor shall immediately take steps to settle such disputes and will
use such trade labor as may be determined to have jurisdiction, at no additional
cost to the County. Nothing in the foregoing shall restrict the County in any way
from performing work in any portion of the site, at any time, utilizing its own
forces or those of other contractors employed by the County.
D. The Contractor shall develop detailed coordination drawings in such a manner
that all mechanical, plumbing, fire protection, and electrical systems are
coordinated and the layout and sequence of installation of these systems (and
components thereof) is workable in every respect; and conforms to the
requirements of the Contract Documents. The coordination drawings shall be
prepared by the Contractor using Revit 2017 software and the complete Revit file
contain the 3 D model shall be provided to the County, the Architect and BIM
Consultant for review. The Contractor shall cooperate fully with the Architect
and BIM Consultant to resolve any clashes detected in the model during their
review. The Contractor will be provided a point cloud survey of the building
interior as constructed in Phase 1 for use and reference in preparing the Revit
model. All costs for preparing the detailed coordination drawings in Revit are
