Sealed Bids will be received at the Office of the City Clerk of the City of Peekskill, New York, until
11:00 A.M. on Thursday, September 17, 2020, at City Hall, 840 Main Street, Peekskill, New York
10566, and immediately thereafter the bids will be publicly opened and read aloud in said office. No bids
will be accepted after said time and date.
The City of Peekskill (the “City”), the County of Westchester (the “County”) and 645 Main Limited
Partnership (the “Developer”) have entered into an Inter-Municipal/Developer Agreement wherein the
City has agreed to implement, and the County has agreed to fund, the construction of certain
Infrastructure Improvements (defined below) to support the private development of affordable housing
by Developer consisting of an 8-story, 82-unit multifamily building (5 floors of apartments over 3 floors
of parking garage)(the “Affordable Housing Development”) on property owned by the Developer located
at 645 Main Street, Peekskill, NY.
The Infrastructure Improvements, which comprises the work for Bid No. 2020-006, consists of the
construction of CIP concrete garage foundations, superstructure and related footing drains and
vapor barrier, including possible add-alternate work as detailed in the Construction Documents.
The Infrastructure Improvements shall be subject to the administration and inspection services to be
performed by a professional consulting engineer (the “Engineer” or “Project Manager”) acting on behalf
of the City and County and otherwise in accordance with the terms set forth in the Construction
Documents. The Engineer (anticipated to be the structural engineer which designed the Infrastructure
Improvements) shall be retained by the Developer and shall report directly to the City and County. The
Infrastructure Improvements shall be performed in strict compliance with the times provided for
commencement and completion of work as set forth in the Construction Documents, including, without
limitation, the Contract, General Conditions and Special Conditions. The performance of the
Infrastructure Improvements by the successful bidder must be closely coordinated by the successful
bidder with the Developer (under the supervision and direction of the Engineer) so as not to unreasonably
interfere with or delay the Developer’s construction schedule and work for the Affordable Housing
A USB flash drive of Plans, Specifications and Contract Documents may be obtained as of Friday,
August 21, 2020 between 9:00 A.M. to 3:30 P.M. at the Department of City Services, Bureau of Public
Works, City Hall, 840 Main Street, Peekskill, NY, upon payment of $10.00 for USB flash drive. This is
a non-refundable fee. No paper copies will be distributed.
All Bidders must submit one (1) USB flash drive containing all Bid documents as part of the bid package.
Bid forms (Section C) must be copied from the USB flash drive, filled out, and submitted in paper form.
Bid forms must also be scanned onto the provided USB flash drive and submitted as part of the bid.
As bid security, each bid must be accompanied by a certified check or a bid bond acceptable to the
City in the amount of not less than 5% of the total amount of the Bid. Certified Checks shall be made
payable to the City of Peekskill, New York and are to be held by the City as a guarantee for the proper
execution and delivery of the Contract and Bonds to secure the faithful performance thereof. In default
of such execution and delivery of Contract and Bonds, the amount of the deposit represented by the check
shall be forfeited and retained by the City of Peekskill as liquidated damages.
The executed Bid forms, USB flash drive, and the certified check or bid bond must be enclosed in a
sealed envelope bearing the name and address of the Bidder, addressed to the City Clerk, City of
Peekskill, NY and endorsed "Infrastructure Improvements 645 Main Street, City of Peekskill, NY,
Bid Number 2020-006”. All questions to be emailed to Jean Friedman, JFriedman@cityofpeekskill.com
by 4PM on Thursday, September 10, 2020. All questions, answers, and addendums, if any, will be
posted on the City’s ‘Bid/RFP’ webpage with a link emailed to all who provided a legible email address
when purchasing the USB flash drive of the Bid documents.
Bidders are strongly urged to attend a Pre-Bid Site Inspection at 10:00AM, Tuesday, September 1, 2020
at the site, 645 Main Street, Peekskill, NY 10566, as this site is privately owned and thus not available
for inspection by the bidders at other times.
Current prevailing wage rates (Residential Construction Rates) shall apply to all work, and the project
will be subject to audit(s) by the agencies of the State of New York.
The successful bidder will be required to document compliance with Chapter 165 of the Peekskill City
Code, which requires the contractor who enters into any construction contract in the amount $1,500,000
or more with the City, or enters into a subcontract for $500,000 or more to have (and/or the
subcontractor(s) to have) an apprenticeship agreement appropriate for the type and scope of work to be
performed that has been registered with, and approved by, the Commissioner of Labor pursuant to the
requirements of Article 23 of the Labor Law.
The City of Peekskill reserves the right to accept or reject any or all Bids, or portions of a Bid, and to
waive any informality in any Bid if deemed in the best interest of the City of Peekskill to do so.
