INVITATION FOR BID

The City of Newburyport invites bids from qualified sport court installers to furnish the materials and labor for the installation of the Lower Atkinson Common Multi-Sport Court Project, located at 447 Merrimac St., Newburyport, MA. Qualified contractors must subit their bids to the City of Newburyport, Department of Public Services/Sewer Business Office, located at 16C Perry Way, Newburyport, MA 01950, the Awarding Authority.  All bid responses shall be addressed to Tom Watkins, Business Manager. Bids will be received until 11:00 am on September 10, 2026, at which time the bids will be publicly opened and read aloud. Any bid received after this deadline will not be accepted.

Bid Forms and Contract Documents shall be available online at www.cityofnewburyport.com/bids beginning at 12:00 pm on August 19, 2026. Each bid must be accompanied by a bid deposit/security issued by a responsible bank or trust company in the amount of 5% of the bid price.  All required forms shall be submitted with the bid submittal. Failure to include any or all of these forms may result in the rejection of your bid.

Scope of Work for the Lower Atkinson Common Multi-sport Court Project includes but is not limited to: demolition of the existing court, site preparation, installation of erosion controls, earthwork, installation of 2 basketball goals (post, backboard & footing), installation of approximately 1,050 sf of base material to extend the existing court, installation of approximately 50’x 93’ asphalt paving (4” thick), installation of plexipave resilient court surfacing, painting the entire court surface using two coat full acrylic playing surface, painting one set of basketball lines and three sets of pickleball lines with acrylic textured line paint (standard colors to be determined), loaming and seeding all disturbed areas, and any potential add alternates as listed.

An optional pre-bid conference will be held on site at 447 Merrimac St., Newburyport, MA at 1:00 pm on August 27, 2026 (meet at the basketball court, parking available at the park). Prospective bidders are encouraged to visit the project site to become familiar with the existing conditions prior to submitting their bid.

A labor and materials payment bond in an amount equal to 50% of the total amount of the contract price with a surety company qualified to do business in the Commonwealth of Massachusetts will be required for the faithful performance of the contract.

All bids for this project are subject to applicable public bidding laws of Massachusetts, including, but not limited to G.L. c.30, §39M.

Attention is directed to the minimum wage rates to be paid as determined by the Commissioner of Labor and Workforce Development and the weekly payroll record submittal requirements under the provisions of Massachusetts General Laws, Chapter 149, Section 26 through 27D inclusive.

Selection of the contractor will be based upon bidder qualifications, including evidence of past performance in similar projects, and bid price.  The contract will be awarded to the bidder deemed by the awarding authority to be the lowest responsible and eligible bidder. All bidders should be prepared to enter into a Contract/Agreement in accordance with this bid package within one (1) week of a Notice of Award by the City.

The bidder agrees that its bid shall be good and may not be withdrawn for a period of 30 days, Saturdays, Sundays and legal holidays excluded, after the opening of the bids.

The City reserves the right to waive any informalities, to accept or reject, in whole or in part any or all bids, or take whatever other action may be deemed to be in the best interest of the City.
