Lower Artichoke Raw Water Pump Station Upgrades
ADVERTISEMENT FOR BIDS
The City of Newburyport, acting through Sean Reardon, Mayor, will receive sealed Bids from qualified contractors for the City of Newburyport Invitation for Bids No. 26-23: Lower Artichoke Raw Water Pump Station Upgrade, until 11:00 am local time, on May 21, 2026 at 16 Perry Way, Newburyport, MA 01950, at which time and place all General Bids will be publicly opened and read aloud.
Sub-bids for HVAC, and Electrical Work to be performed under this Contract will be received until 11:00 am local time, on May 14, 2026 at 16 Perry Way, Newburyport, MA 01950, at which time and place all Sub-bids will be publicly opened and read aloud.
A non-mandatory pre-bid conference will be held for all prospective bidders at 1:00 pm local time on April 30, 2026, at the Lower Artichoke Raw Water Pump Station at 239 Storey Avenue, Newburyport, MA.
The project involves removing three existing vertical turbine pumps, motors and Magna Drives, and associated electrical cabling and cable supports along with cleaning and inspecting pump cans, and connecting piping and fittings up to the existing valve assembly on the manifold. This work also includes furnish and install three new vertical turbine pumps and motors, and associated variable speed drives, and associated ductile iron pipe and fittings, furnish and install electric cabling from new variable speed drives to new pump motors and new HVAC split units and power cabling in existing electrical room. Demolish and remove an existing potassium permanganate system and furnish and install a new potassium permanganate system. Relocate and reconnect the existing air backwash system. In the electrical room remove one window and one motorized louver in the north wall, remove one fan, frame, and concrete sill in the west wall, block up openings, and finish existing exterior and interior surfaces. Lastly, provide SCADA integration services for instrumentation and controls via the City’s preferred integrator.
The total time period for completion of all Work required under this Contract is 365 consecutive calendar days. Work performed beyond the 365 consecutive calendar day period will be subject to liquidated damages in the amount of $1,500 for each consecutive calendar day.
All Bidders are advised that their Bids must be accompanied by a copy of their Certificate of Eligibility issued by the Commissioner of the Division of Capital Asset Management and Maintenance (DCAMM). The Certificate of Eligibility shall be for the category of pumping stations. An Update Statement form covering the period from the date of the Bidder’s most recently filed Contractor Qualification Statement (CQS) to the Bid date shall also be submitted with the bid.
Any general bid submitted without the appropriate DCAMM Certificate of Eligibility and Update Statement shall be invalid.
Subcontractors shall file with their sub-bids a copy of their DCAMM Certificate of Eligibility and Sub-Bidders Update Statement.
Bid Forms and Contract Documents will be available for download online at www.cityofnewburyport.com , beginning April 22, 2026. Documents may be downloaded at no cost.
Addenda, if issued, will be posted to the city website, and shall be accompanied by e-mail notification to every individual or firm whom has downloaded the documents from the city website. It is the sole responsibility of the Bidder to review and acknowledge all Addenda. Hard copies of addenda will not be mailed or faxed. It shall be the sole responsibility of the Contractor to ascertain the existence of any and all addenda. Neither OWNER, OWNER’S PROJECT MANAGER (OPM) nor ENGINEER will be responsible for full or partial sets of the Contract Documents, including Addenda, if any, obtained from sources other than the Issuing Office.
Each Bid shall be accompanied by a Bid security in the amount of 5% of the Bid price and in the form described in the Instructions and Information for Bidders.
For the successful Bidder a performance bond and a payment bond, each in the amount of 100% of the Contract Price will be required in the form described in the Instructions and Information for Bidders. All such bonds shall be issued by eligible sureties listed in the current U. S. Department of Treasury Circular 570, qualified to do business under the laws of the Commonwealth of Massachusetts, follow standards as provided at 2 CFR 200.326, and satisfactory to the Owner.

This Contract is being bid under the provisions of Massachusetts General Laws Chapter 149, Sections 44A through 44J and is additionally subject to requirements of 2 CFR Part 200.
Attention of Bidders is particularly called to the requirements as to conditions of employment to be observed, minimum wage rates to be paid and payroll submission requirements under the Contract.
Successful bidders and subbidders shall certify that all employees to be employed at the worksite will have successfully completed a course in construction safety and health approved by the United States Occupational Safety and Health Administration that is at least 10 hours in duration at the time the employee begins work and who shall furnish documentation of successful completion of said course with the first certified payroll report for each employee.
This Contract to be awarded is funded in part through an EPA Assistance Agreement and, as such, is subject to Disadvantaged Business Enterprise requirements. The Contractor shall not discriminate on the basis of race, color, national origin or sex in the performance of this Contract. The Contractor shall carry out applicable requirements of 40 CFR Part 33 in the award and administration of contracts awarded under EPA financial assistance agreements. Failure by the Contractor to carry out these requirements is a material breach of this Contract which may result in the termination of this Contract or other legally available remedies.
Minimum Wage Rates as determined by the Executive Office of Labor and Workforce Development under the provision of the Massachusetts General Laws, Chapter 149, Sections 26 to 27D, as amended, apply to this project. It is the responsibility of the contractor, before bid opening, to request, if necessary, any additional information on Minimum Wage Rates for those trades people who may be employed for the proposed work under this contract. Federal Minimum Wage Rates as determined by the United States Department of Labor under the Davis-Bacon Act also apply to this project.
No Bidder may withdraw his Bid within 30 days (Saturdays, Sundays and legal holidays excluded) after the actual date of the bid opening.
Complete instructions for filing Bids and Sub-Bids are included in Section 00100, Instructions and Information for Bidders.
The Awarding Authority reserves the right to accept any Bid, waive any informalities or minor defects, or reject any or all Bids, if in its sole judgment it is in the best interest of the City of Newburyport to do so.

This Addendum No. 1 forms a part of the Contract Documents and modifies the Bidding Documents dated April
2026 as noted below. Acknowledge receipt of this Addendum in the space provided in SECTION 00300, FORM
FOR GENERAL BID. Failure to do so may subject the Bidder to disqualification.
This Addendum consists of 5 pages and 76 pages of attachments for a total of 81 pages.
A non-mandatory pre-bid meeting was held on April 30, 2026. A copy of the handout and sign-in sheet are included
as Attachment 1 of this Addendum 1.
RESPONSE TO PLAN HOLDERS' QUESTIONS
Responses to these questions do not modify the Bidding and Contract Documents.
1. Please confirm the contractor responsible for furnish and installing conduit and wire for HVAC thermostats
and interconnects to dampers.
a. HVAC Contractor. See Table of Responsibility - Electrical & HVAC on drawing 00 E-601 and 00
M-002.
2. Are stainless steel flexible whips required in NEMA 4X areas where flexible connections are required?
a. Provide stainless steel, braided flexible conduit in NEMA 4X, corrosive areas per Section 16110-
2.02.B.2.
3. Is it the engineers design to reuse the existing pump (RWP-X) disconnect?
a. Yes. See Note #1 on drawing 10 ED-001.
4. Section 16265 states Allen-Bradley only in the Note at the top. Is ABB approved as it will meet and exceed
the specifications?
a. City has standardized VFDs around Allen-Bradley.

5. Is an active front end ultra-low-harmonic drive acceptable?
a. Active front end could be proposed as an alternate product provided that it is included with a 5%
input line reactor.
6. Please provide NEMA ratings per dedicated area regarding electrical drawings.
a. See Area Classification Schedule on drawing 00 E-601.
7. Please confirm HVAC contractor owns conduit wire from X-ACCU-X to X-ACU-X. Regarding E-601.
a. HVAC Contractor owns control wiring and associated conduit between indoor and outdoor heat
pump units. Electrical contractor owns power wiring and associated conduit.
8. What time length can the existing MCC be shut down for?
a. See modification to Specification Section 01010 in 'Changes To Be Made To The Contract
Specifications' portion of this Addendum 1.
9. Is flood coverage required under the Builders Risk policy (Section 00800.6.05.A.2)?
a. See modification to Specification Section 00800 in 'Changes To Be Made To The Contract
Specifications' portion of this Addendum 1.
10. Are the existing HOA and Speed modules at each pump to be demolished after existing pumps are
cutover?
a. Existing pumps are to be replaced. Per Drawing 10 ED-001 Note 1 the existing HOA and speed
control are to be demolished.
11. Please confirm conduit type to be installed in the Potassium Permanganate Area.
a. See modification to Specification Section 16110 in 'Changes To Be Made To The Contract
Specifications' portion of this Addendum 1.
12. Are as built plans available for the existing Flow Serve Pumps?
a. See Attachment 2 for excerpt of record plans for the existing pumps.
13. Has the owner determined where the discharge site is for the work of cleaning and inspecting and
disinfection? (Section 01010 1.02 A 4.-5.)
a. The Owner will work with the awarded Contractor to identify a discharge site. The Owner will
provide sodium bi-phosphate or similar dechlorination method.
14. Please clarify areas for compost silt sock and silt sediment trap. (Sheet 00 C-101)
a. See modification to Drawing 00 C-101 in 'Changes To Be Made To The Contract Documents'
portion of this Addendum 1.
15. There is an electrical filed sub-bid. For the temporary KMnO4 the plans call for the wiring to be the
responsibility of the GC, is this correct? (Sheet 10 DD-102)
a. This is correct.
16. What is the maximum time allowed for the station to be offline?
a. The pump station is not allowed to be taken offline at any time. Contractor is responsible for
scheduling, sequencing, and performing work so the pump station remains online.

Owner can accommodate up to a 5-hour shutdown of the MCC for work within the MCC provided the
work is scheduled in advance and notice of shutdown is provided at least 72 hours in advance of the
shutdown.

A. The City of Newburyport, MA has received approval to construct the potassium permanganate
system as detailed in the Contract Documents and as conditioned in the MassDEP letter dated April
17, 2026 and included as Attachment D - MassDEP Potassium Permanganate System Approval.
This Attachment D is made part of the Contract Documents. The CONTRACTOR is responsible
for complying with the terms, conditions and any special conditions specified in Attachment D.
The CONTRACTOR is not responsible for revision of the City's O&M Manual.
6. 11324 - CHEMICAL PERISTALTIC METERING PUMPS AND APPURTENANCES
A. Replace Section 11324 in its entirety with Attachment 3 of this Addendum 1.
