SECTION 001116 - INVITATION TO BID

TOWN OF MANCHESTER-BY-THE-SEA, MASSACHUSETTS

LINCOLN STREET WELL TREATMENT UPGRADES

PROJECT NO. LSW-2026-01

The Town of Manchester-by-the-Sea, Massachusetts requests bids for construction of the Lincoln Street

Well Treatment Upgrades project. General Contractors and filed Sub-Contractors must be pre-qualified

to bid on the project. Pre-qualifying will be completed prior to public advertisement of this project and

will be conducted in accordance with the requirements of Chapter 193, Section 19 of the Acts of 2004.

This project is being Electronically Bid (E-Bid). E-Bids for the General Contract for construction of the

Lincoln Street Well Treatment Upgrades will be received from pre-qualified General Contractors by

Projectdog on behalf of Manchester-by-the-Sea as noted below until 2:00 PM, April 15, 2026.

E-Bids for the filed Sub-Contracts designated herein will be received from pre-qualified filed Sub-

Contractors by Projectdog on behalf of Manchester-by-the-Sea as noted below until 2:00 PM, April 1,

2026.

The project includes furnishing all labor, equipment, materials, and incidentals required for construction

of a 3,300 square foot (SF) building with two (2) greensand filtration pressure vessels, two (2) granular

activated carbon (GAC) contract pressure vessels, two (2) backwash storage tanks, backwash pumps,

electrical room, mechanical room, bathroom and associated building support systems. The project also

includes chemical feed modifications in the existing Chemical Building. The site will contain a

subsurface equalization tank for washwater, natural gas generator, sewer ejector pump station, stormwater

management system, and associated below-grade utilities. The project will include demolition of the

existing Well Building and other miscellaneous equipment.

The Contract Time shall be 600 Calendar Days commencing ten days following the Effective Date of the

Agreement.

In accordance with M.G.L. Chapter 149, Section 44D, General Bids will be valid only when accompanied

by (1) a current certificate of eligibility issued by the Division of Capital Asset Management and

Maintenance, showing that the General Bidder has the classification of Sewage and Water Treatment

Plants and a capacity to perform this work and (2) an update statement summarizing the General Bidder's

record for the period between the latest Division of Capital Assets Management and Maintenance

certification and the date the bid is submitted. Any General Bid submitted without the appropriate

certificate and update statement is invalid and must be rejected. The estimated project cost is

$11,000,000.00.

In accordance with M.G.L. Chapter 149, Section 44F, Filed Sub-Bids will be valid only when

accompanied by a current certificate of eligibility issued by the Division of Capital Asset Management

and Maintenance, showing that the Sub-Bidders have been certified in their particular Sub-bid category to

participate on public construction projects and to perform the work required. The Sub-bid shall also be

accompanied by a Sub-bidder Update Statement in a form as developed by DCAMM. Any Sub-bid

submitted without the appropriate certificate and update statement is invalid and must be rejected.

This project is being Electronically Bid (E-Bid). All bids shall be submitted online at

www.Projectdog.com. Hard copy bids will not be accepted by Projectdog or the Awarding Authority.

Bid Forms and Contract Documents shall be available online at www.Projectdog.com, Project Code

872589. Bid documents are made available to all bidders in electronic form at no cost. Bidders desiring

hard copies shall be solely responsible for all costs related to printing and shipping of hard copy

documents. Neither Owner nor Architect/Engineer shall be responsible for full or partial sets of the

Bidding Documents, including Addenda if any, obtained from sources other than Projectdog, Inc.

Each General Bid and Sub-Bid shall be submitted in accordance with the Instructions to Bidders and shall

be accompanied by Bid Securities in the amount of five percent of the bid. The following are the filed

Sub-Bids required for this work:

1. Electrical Work

2. Heating, Ventilating and Air-Conditioning (HVAC)

3. Plumbing

4. Masonry Work

5. Miscellaneous and Ornamental Iron

6. Roofing and Flashing

7. Painting

8. Waterproofing, Damp-Proofing and Caulking

Bidders may not withdraw their Bids for a period of sixty days, excluding Saturdays, Sundays, and legal

holidays after the actual date of the opening of the General Bids.

The Successful Bidder must furnish a 100 percent Performance Bond and a 100 percent Payment Bond

with a surety company acceptable to the Owner.

Complete instructions for filing Bids and Sub-Bids are included in the Instructions to Bidders.

Procurement Considerations - Six Good Faith Efforts. 40 CFR, Part 33, Subpart C: Pursuant to 40 CFR

Section 33.301, the sub-recipient agrees to make good faith efforts whenever procuring construction,

equipment, services, and supplies under an EPA financial assistance agreement, and to require that sub-

recipients, loan recipients, and prime contractors also comply. Records documenting compliance with

the six good faith efforts shall be retained. The specific six good faith efforts can be found at: 40 CFR

Section 33.301 (a)-(f).

Minimum Wage Rates as determined by the Executive Office of Labor and Workforce Development

under the provision of the Massachusetts General Laws, Chapter 149, Section 26 to 27H, as amended,

apply to this project. It is the responsibility of the Contractor, before bid opening, to request if necessary,

any additional information on Minimum Wage Rates for those tradespeople who may be employed for the

proposed work under this Contract. Federal Minimum Wage Rates as determined by the United States

Department of Labor under the Davis-Bacon Act also apply to this project. A copy of the Massachusetts

and Federal Minimum Wage Rates have been included in Section 007300 “Supplementary Conditions”,

Part II of these Specifications.

The bidding and award of this Contract will be under the provisions of M.G.L. Chapter 149, Section 44A

- 44J.

The Owner reserves the right to waive any informality in or to reject any or all Bids if deemed to be in its

best interest.

The work under this Contract is funded in part by the Massachusetts Clean Water Trust (the "Trust")

through a Drinking Water State Revolving Fund (DWSRF) loan. Prospective contractors shall be aware

and comply with all requirements of receiving monies from the “Trust”.

This Project requires compliance with the Department of Environmental Protection's (DEP) Diesel

Retrofit Program by use of after-engine emission controls that are EPA certified, or their equivalent, on

all of the off-road (non-registered) diesel vehicles/equipment, and vehicles greater than 50 brake

horsepower, which will be used in the performance of the work.

The Bidder acknowledges to and for the benefit of the Owner and the State of Massachusetts (“State”)

that it understands the goods and services under this Agreement are being funded with monies made

available by the Clean Water State Revolving Fund that have statutory requirements commonly known as

the “American Iron and Steel”; that requires all of the iron and steel products used in the project to be

produced in the United States (“American Iron and Steel Requirement”) including iron and steel products

provided by the Contractor pursuant to the Agreement. The Contractor hereby represents and warrants to

and for the benefit of the Owner and State that (a) the Contractor has reviewed and understands the

American Iron and Steel Requirements, (b) all of the iron and steel products used in the project will be

and/or have been produced in the United States in a manner that complies with the American Iron and

Steel Requirements, unless a waiver of the requirement is approved, and (c) the Contractor will provide

any further verified information, certification, or assurance of compliance with this paragraph, or

information necessary to support a waiver of the American Iron and Steel Requirement, as may be

requested by the Owner or the State. Notwithstanding any other provision of the Agreement, any failure

to comply with this paragraph by the Contractor shall permit the Owner or State to recover as damages

against the Contractor any loss, expense, or cost (including without limitation attorney’s fees) incurred by

the Owner or the State resulting from any such failure (including without limitation any impairment or

loss of funding, whether in whole or in part, from the State or any damages owed to the State by the

Owner). While the Contractor has no direct contractual privity with the State, as a lender to the Owner for

the funding of its project, the Owner and the Contractor agree that the State is a third-party beneficiary

and neither this paragraph, nor any other provision of this Agreement necessary to give this paragraph

force or effect, shall be amended or waived without the prior written consent of the State.

As previously stated, it is the Contractor’s responsibility along with the manufacturer of materials to

document where the pieces of each item are manufactured. All manufactured goods and their components,

including but not limited to pipe, hydrants, valves, tapping sleeves, fittings, mechanical joints, etc. shall

be made in the United States. As part of the shop drawing review process, a signed letter from an

executive with the manufacturer shall be included, breaking down each component and stating where it is

made. If the manufactured good does not meet the American Iron and Steel provision, it will not be

accepted, unless a waiver is approved.
