ADVERTISEMENT AND NOTICE TO BIDDERS
Notice is hereby given that sealed proposals will be received by the Borough of Freehold for the "Lead
Service Line Replacement" project and publicly opened and read aloud at the Office of the Freehold
Borough Hall, 30 Mechanic Street, Freehold, New Jersey, 07728 on Thursday, July 23, 2026, at 11:00
a.m. prevailing time.
The project generally consists of the replacement of approximately 235 customer side known lead and
galvanized water service lines with new Type K copper service lines and identification of approximately 136
unknown service lines throughout the Freehold Borough water system service area. The work includes, but
is not necessarily limited to, test pits, visual inspections of service line material, installation of new copper
water services, service reconnections, curb stops, surface restoration, traffic control, erosion and sediment
controls, coordination with residents, and all appurtenant work as contained in the Contract Documents.
Contract Documents and Plans for the proposed work prepared by Michael Dziubeck, P.E., Consulting
Engineer, CME Associates may be examined at the office of said Engineer at 1 Tower Center Blvd, 20th
Floor, East Brunswick, New Jersey and at the office of the Freehold Borough Hall, 30 Mechanic Street,
Freehold, New Jersey 07728 during business hours and may be obtained at the offices of CME Associates
until 48 hours prior to the time set for the opening of Bids upon payment of $ 100.00 per set. No refunds will
be made except as provided in N.J.A.C. 40A:11-24b which allows for the return of documents in reasonable
condition within 90 days of notice that the contract has NOT been awarded.
In lieu of purchasing a hard copy of the Contract Documents and Plans, a digital copy will be made
available to Bidders at no charge via Mimecast Large File Send by submitting the following required
information to bids@cmeusa1.com:

Neither the Owner nor the Engineer will be responsible for full or partial sets of Contract Documents,
including any addenda, obtained from other sources.
NO BIDS MAY BE SUBMITTED ELECTRONICALLY.
Proposals in the Contract Documents must be enclosed in sealed envelopes bearing the name and
address of the Bidder and the name of the work on the outside addressed to the Borough of Freehold and
must be accompanied by a Statement of Consent of Surety from a Surety Company authorized to do
business in the State of New Jersey and acceptable to the Borough. All bids are to be hand delivered. No
bids are to be mailed. Each proposal must be submitted in writing on the proposal pages furnished in the
Contract Documents; this entire document must be submitted at the time of bid.
Each Bid must be accompanied by a certified check or cash in the amount of not less than ten (10%)
percent of the Bid, but not more than $20,000.00, payable without any conditional endorsement as a
guarantee that in case the Contract is awarded to the Bidder, he will within twenty-one (21) days thereafter
execute such contract and furnish satisfactorily performance bonds. Upon failure to do so he shall forfeit
the deposit as liquidated damages and the acceptance of the Bid will be contingent upon the fulfillment of
this requirement by the Bidder. No interest shall be allowed upon any such certified check or cash. A bid
bond in the amount of ten (10%) percent of the Bid, but not more than $20,000.00, may be substituted for
certified check or cash. Each bid must be accompanied by a certificate of experience and certificate of
equipment.

Each Bid must also be accompanied by a certificate of Consent of Surety from a Bonding Company
licensed to do business in the State of New Jersey and named in the current list of "Surety Companies
Acceptable on Federal Bonds", U.S. Treasury Department, guaranteeing that if the proposal of the Bidder
be accepted they will furnish the bond set forth in Paragraph One of the General Conditions of the Contract
and the acceptance of the Bid will be contingent upon the fulfillment of this requirement.
The Borough reserves the right to increase or decrease quantities specified in the manner designated in the
Specifications. The Borough reserves the right to award this Contract based on funds available.
The successful Bidder shall be required to comply with the provisions of the New Jersey Prevailing Wage
Act, Chapter 150 of the Laws of 1963, effective January 1, 1964.
During the performance of this Contract, the Contractor agrees to comply with the requirements of P.L.
1975, c. 127 (N.J.A.C. 17:27), and N.J.S.A. 10:5-31 et seq., all requirements of the State of New Jersey
Worker Health and Safety Act (N.J.A.C. 12:110 et seq.) as amended and the United States Occupational
Safety and Health Act (OSHA) (29 CFR 1910), as amended with regard to worker and jobsite safety.
No Bidder may withdraw his Bid for a period of sixty (60) days after the date set for the opening thereof.
The successful Bidder will be required to furnish a Surety Company Bond in the full amount of Contract
price indemnifying the Borough of Freehold for all proceedings, suits or actions of any kind of description
and conditional for the faithful performance of the work.
All Bid security will be returned to all Bidders except the three apparent lowest Bidders within ten (10)
working days after the opening of Bids, and to the three (3) apparent lowest Bidders within three (3)
working days after the successful Bidder has executed the Contract and his Contract security has been
approved by the Borough.
The Borough reserves the right to reject any, or all Bids if in its opinion it is in the best interest to do so and
to award the Contract for any and/or all items.
This contract or subcontract is expected to be funded in part with funds from the New Jersey Department of
Environmental Protection and the New Jersey [Environmental Infrastructure Trust] Infrastructure Bank.
Neither the State of New Jersey, the New Jersey [Environmental Infrastructure Trust] Infrastructure Bank
nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or
any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C.
7:22-3, 4, 5, 9 and 10.
The project or contract is funded in part by New Jersey wastewater treatment financing programs and the
successful bidder must comply with all the provisions of N.J.A.C. 7:22-9.1 et seq. for the participation of
small business enterprises owned and controlled by socially and economically disadvantaged individuals.
N.J.A.C. 7:22-3.17(a)24, 6.17(a)24 and 7:22A-2.4(a) provide that a goal of not less than 10 percent be
established for the award of contracts to small business concerns owned and controlled by one or more
socially and economically disadvantaged individuals. The goal of 10 percent applies to the total amount of
all contracts for building, materials and equipment, or services (including planning, design and building
related activities) for a construction project. The project sponsor has identified that the SED utilization goal
for this project is 10 percent.
Awards will be made only to socially and economically disadvantaged business concerns that are certified
by the New Jersey Commerce, Economic Growth and Tourism Commission, the New Jersey Department of
Transportation, the Port Authority of New York and New Jersey, New Jersey Transit or other agencies
deemed appropriate by the Office as eligible minority businesses or female businesses.
The invitation to bid is on an unrestricted basis whereby the successful bidder must fulfill the SED utilization
requirements.

All advertisements for Bids shall be published in a legal newspaper sufficiently in advance of the date fixed
for receiving the Bids to promote competitive bidding, but in no event less than ten (10) days prior to said
date. The advertisement notice shall also appear on the Project Sponsor's website.
