Pursuant to the Georgia Local Government Public Works Construction Law, O.C.G.A. 36-
91-1 et seq. (the "Act"), the Liberty County Industrial Authority d/b/a Liberty County
Development Authority (the "LCDA") hereby publicly advertises the contract opportunity for
Midway Industrial Park - Pond Dredging RFP to be owned by the LCDA or its assigns,
which is described below (the "Project"). This Notice advertises a Request for Sealed
Proposals, dated July 16, 2026 (such document, together with any Addenda thereto, the
"RFP"). Copies of the complete RFP are available online at www.lcda.com or at the offices of
the LCDA at the address set forth below. The RFP is summarized in this Notice, but this
Notice is qualified in its entirety by the complete RFP. This Notice is also subject in all
respects to the Act. Interested offerors must submit proposals in complete compliance with

Basis for Award: The LCDA will evaluate proposals from "responsive" and "responsible" offerors (as defined by the Act) using certain evaluation factors designed to identify the most advantageous proposal as determined by the LCDA, all as more particularly described in the RFP.
Minority Participation: The LCDA desires to promote equal employment opportunities for minority and women-owned small businesses in its construction activities. In this connection, all offerors shall be required to establish and include in their proposals minority and women-owned small business goals, and to use their best efforts to meet these goals when undertaking the Project, all as set forth in the RFP.
Proposal Process: Proposals must be in a sealed envelope addressed to the LCDA and physically received by it at its offices located at 425 W. Oglethorpe Hwy., Hinesville, Liberty County, Georgia 31313, no later than August 17, 2026 at 2:00 pm at which time the proposals submitted shall be received. All sealed proposals shall be submitted on forms provided by the LCDA or as otherwise indicated in the RFP and shall be evaluated and otherwise governed by the terms and provisions contained in the RFP. Copies of such documents are available upon request from LCDA. When obtaining the RFP, the offeror must provide its name, address, facsimile number, and email address to which any Addenda to the RFP can be sent. Offerors will be required to honor their proposals for a period ending 60 days after the LCDA opens the proposals; provided, however, that if an offeror is not selected within 60 days of opening the proposals, any offeror that is determined by the LCDA to be unlikely of being selected for Contract award shall be released from its proposal. However, it is expected that an award will be made no later than sixty (60) days following opening of the sealed proposals unless the LCDA elects to reject all proposals.
Proposal Bond: Each offeror must include with its proposal a proposal bond complying with the Act, in form prescribed by the RFP, in an amount equal to at least ten (10%) percent of the total contract price indicated in the proposal to be submitted. 1. THE PROJECT
The Liberty County Development Authority (LCDA) is requesting Competitive Sealed
Proposals for storage pond dredging at the Midway Industrial Park located along E.
Oglethorpe Highway in Liberty County, Georgia. The Scope of Work is defined in Section
3 of this RFP. It is the full responsibility of the contractor to thoroughly investigate the
needs/requirements of the LCDA, not necessarily specified in this RFP, and to propose a
storage pond dredging concept that will most efficiently meet or exceed the
needs/requirements of the LCDA.
Instructions for preparation and submission of a proposal are contained in this packet.
Proposals must be typed or printed in ink.
Any and all transactions made necessary by this RFP, as well as the Proposal
Documents, shall be subject to the approval of LCDA.
2. INTRODUCTION
The Liberty County Development Authority (LCDA) was created in 1958 by an
amendment to the Constitution of the State of Georgia for the purpose of creating and
enhancing the economic growth and development of Liberty County. It consists of
a seven-member Board of Directors with automatic seats for the Chairman of the
Liberty County Board of Commissioners and the Mayor of Hinesville - the county
seat. Four additional positions are appointed by the Liberty County Board of
Commissioners and one additional position is appointed by the Hinesville City Council.
The purpose of the LCDA is to develop and promote industry for the public good and
welfare of the county. Toward that end, the LCDA has developed industrial parks,
constructed shell buildings, supported local technical college and workforce
development programs, and organized and led partnerships with other public and
private entities.
The Authority currently maintains five (5) industrial parks: Hinesville Technology Park,
Walthourville Industrial Park, Midway Industrial Park, Tradeport East Business Center,
and Tradeport West Business Center. The Authority operates a water and wastewater
system and is a partner in the MidCoast Regional Airport joint-use facility.

3. SCOPE OF WORK
MIDWAY INDUSTRIAL PARK DREDGING:
Contractor shall remove and dewater sludge from two storage ponds located within the
Midway Industrial Park with final disposal at a location approved by the LCDA.
West Pond
Size: 0.8-acre

Dimensions listed above are approximate. Actual size and depth of sludge may vary.
Dredging of the storage ponds shall include, but is not limited to, removal of sludge from
ponds, dewatering of sludge, and disposal of sludge in accordance with applicable
guidelines and regulations. Contractor is responsible for all labor, materials, equipment,
permits, and insurance necessary to complete the work and shall provide erosion
control, traffic control, survey, and testing services as required. In the instance a waste
characterization profile is deemed necessary, the contractor shall perform sampling and
testing and make the final report readily available. An allowance has been included
within this contract for this. The Allowance is not to be used without prior authorization
from the Owner. Contractor shall pay all fees, costs, and processing expenses necessary
to perform the scope of work. Upon completion of sludge removal, project area shall be
returned to former conditions.
Contractors shall provide with the Proposal a listing of equipment and references
demonstrating the potential contractor's ability to perform the work. Vehicle(s) shall be
currently licensed and meet all state, federal, county, and Department of Transportation
requirements. Vehicle(s) shall be of sound quality and in good working order.
Contractor shall transport sludge in a method consistent with safe transfer of sludge,
taking care not to spill or leak sludge, or otherwise contaminate roadways, ditches,
waterways, Owner's facilities, or the disposal site facilities. Contractor shall diligently
clean up all spills and/or leaks of any materials such as, but not limited to sludge, fuels,
motor oil, hydraulic fluid, brake fluid, antifreeze, and/or grease and notify facility
personnel as soon as possible to avoid any potential contamination. Any spills and leaks
shall be removed by the end of the same workday when the spills or leaks occur. This
applies to all such materials, whether the spill or leak originates from the trucks or other
items, such as maintenance equipment, drums, jugs of antifreeze, etc. Any breach of
proper handling of materials shall be just cause for the LCDA to void the resulting

Contract and/or arrange for proper cleanup of spills at the contractor's expense.
Contractor shall be in responsible charge of title of sludge upon removal from ponds and
provide daily manifest of the weight of sludge removed and location of disposal.
Contractor shall declare intent regarding disposal of materials with the Proposal.
Contractor shall not dispose of any materials in a manner not consistent with safe
practices and approved disposal sites. Failure to declare disposal site or to list a site not
properly permitted will cause the rejection of the Proposal. Failure to notify the project
contact person of any change of disposal location will be just cause for voiding the
Contract and declaring the contractor to be in breach. Breach of Contract or default
authorizes the LCDA to exercise any or all rights. The LCDA may exercise any right or
pursue any remedy available at law or in equity for breach of this Contract. The exercise
of any right to pursuit of any remedy by the LCDA for breach of this Contract shall not
prevent the LCDA from exercising any other right or pursuing any other remedy available
under this Contract, under law, or in equity.
Contractor agrees to perform the sludge hauling services under contract in accordance
with all applicable statutes, rules, and regulations of the Resource Conservation and
Recovery Act. The contractor shall be responsible for compliance with all state, federal,
and local regulations regarding the disposal of sludge materials. All sludge material
hauled hereunder by the contractor shall be disposed of in a proper site/facility duly
permitted to receive such material. The contractor shall inform and provide records to
the contract administrator of disposal events such as change of disposal location,
diversion to beneficial land use, or other. The LCDA shall retain rights to approve or not
approve of disposal locations. Prior to any dredging activities, the contractor shall
provide the LCDA with all necessary documentation demonstrating environmentally
compliant disposal. This documentation shall include a letter stating the ability to
accept anticipated character and volume of dredged material and facility permits or
licenses.
Contractors performing services for the LCDA shall comply with all Occupational Safety
and Health Administration (OSHA), State and County Safety and Occupational Health
Standards, and any other applicable rules and regulations. All contractors shall be held
responsible for the safety of their employees and any unsafe acts or conditions that may
cause injury or damage to any persons or property within and around the work site area
under this Contract.
Both the contractor and the LCDA acknowledge that time is of the essence in this
Agreement. Contractor shall perform all of the work required herein. The contractor
shall develop and submit a Work Plan that includes a description of the work to be
performed, a preliminary schedule, and drawing details or sketches as
applicable. Dredging shall be coordinated with the operator in responsible charge of the
facility to allow for continuous performance at the facility.

All payments shall be for the services rendered. Contractor shall provide written
confirmation of completion of each pickup, including service dates and total charges.
Contractor shall invoice the LCDA as stated in the Contract. Contractor shall provide a
designated contact person for the purpose of answering and resolving all billing and
customer service issues. Designated contact person shall initiate a call back to the LCDA
within 48 hours of receipt of initial call.
4. DEFINED TERMS
In addition to the terms defined elsewhere in this RFP, the following terms shall have
the meanings indicated below, which are applicable to both the singular and plural
thereof.
(a) Addenda - Graphic or written documents issued by LCDA prior to the opening
of Proposals intended to clarify, revise, add to, or delete information in the
original Proposal Documents or in previous addenda.
(b) Contract - The contract to be awarded to the Successful Offeror pursuant to
this RFP. At present, it is anticipated that LCDA will provide the Contract. LCDA
is under no legal duty or obligation to enter into said Contract prior to or
following an award pursuant to this RFP, and shall in no event be bound under
said Contract until such time, if at all, as the same is duly approved by the
LCDA board at a duly called public meeting. The Contract shall additionally
be reviewed and approved by the legal counsel for LCDA.
(d) Offeror - One who submits a Proposal directly to LCDA as distinct from a sub-
offeror of sub-bidder, who submits a proposal to an Offeror.
(e) Proposal - A complete and properly signed offer to perform the services for
the prices stipulated in the form submitted by the Offeror in accordance with
the Proposal Documents.
(f) Proposal Documents - Shall collectively refer to this RFP and any and all
contracts, instruments, or other documents specifically made a part of this
RFP or otherwise contemplated to be entered into between LCDA and the
Successful Offeror in connection with the Project (to include the Contract).
(g) Selection Committee - The committee appointed by the LCDA Board to
oversee th e RFP process, evaluate the Proposals, and recommend
action regarding the same t o the Board.
(h) Successful Offeror - The responsive and responsible Offeror whose Proposal
LCDA determines to be most advantageous to LCDA (on the basis of LCDA's
evaluation as hereinafter provided) and to whom LCDA makes an award, all in
the sole and absolute discretion of LCDA.

Additionally, for purposes of this RFP, "herein," "hereby," "hereunder," hereof,"
"hereinbefore," "hereinafter" and other equivalent words refer to this RFP and
not solely to the particular portion thereof in which any such word is used,
and "including" or "include" means including without limitation.
5. RESTRICTED COMMUNICATION
From the issue date of this RFP until a Successful Offeror is selected and the
selection is announced and Proposal Documents are executed, Offerors are not
allowed to communicate for any reason with any employees of LCDA or
members of the Selection Committee with respect to this RFP or the Scope
of Work, except for (i) submission of questions as authorized by this RFP, (ii)
during any pre-proposal conference, (iii) during scheduled and authorized
interviews, if any, for purposes of evaluation, and (iv) during authorized
negotiations, if any, following opening of the Proposals. For violation of this
provision, the LCDA reserves the right to reject the Proposal of the offending
Offeror.
6. SCHEDULE OF RFP EVENTS
The following Schedule of Events represents the LCDA's best estimate of the
schedule that will be followed. All times indicated are prevailing times in
Midway, Georgia. The LCDA reserves the right to adjust the schedule as it deems
necessary or convenient.

7. PROPOSAL FORM AND CONTENT
All Proposals shall be prepared in accordance with this RFP, and shall include the
following: (i) a Statement of Qualification (see Sec. 16 below); (ii) a Proposal Form
(attached); (iii); an Authorization to Investigate (attached); (iv) a Statement of Non-
Collusion (attached); and (v) all other items or documents required or authorized by this
RFP.
In order to be considered for selection, offerors must submit a complete response to
the RFP. Incomplete proposals may not be considered if the omissions are determined
to be significant.

Proposals must be submitted in two parts: (A) one (1) original marked "original", and
seven (7) copies of the Technical Proposal for a total of eight (8) sets of the Proposal,
and (B) one (1) original of the Cost Proposal. The Cost Proposal must be submitted in a
separate sealed envelope which specifies on its face the name of the CONTRACTOR and
"Cost Proposal." Each such set shall be identical and include a transmittal letter.
All Proposals shall be prepared simply, succinctly, and economically, to provide a
straightforward and concise description of the matters requested. Emphasis must be
on completeness, relevance, and clarity of content.
To expedite the review of Proposals, it is essential that offerors follow the format
and instructions set forth herein.
The Proposal shall be signed as follows:
(a) A Proposal submitted by a partnership shall list the names of all partners and
shall be signed in the partnership name by one of the authorized members of the
partnership. If there is no partner who is a Georgia resident, the name and address
of an entity designated to receive service of process for the partnership in Georgia
must be provided.
(b) A Proposal submitted by a corporation, limited liability company, or other legal
entity not a partnership shall be signed under the legal name of the entity by
the officer, manager, or other person(s) duly authorized to bind said entity. The
name of each person signing the proposal shall be typed or printed below the
signature. If not a Georgia Corporation, there must also be evidence that the
corporation is authorized to transact business in Georgia.
(c) A Proposal from an individual who is not a Georgia resident shall provide the
name and address of an entity in Georgia with the authority to accept service of
process for the individual.
(d) All names must be typed or printed in ink below the signature.
(c) The address, email address, and telephone number for communications regarding
the Proposal must be shown.
8. MANDATORY PRE-PROPOSAL CONFERENCE
A mandatory pre-proposal conference will be held at 1:00pm on Thursday July 23rd at
the LCDA office at 425 W. Oglethorpe Highway, Hinesville, GA 31313. A
representative, but not necessarily the binding agent, for each Offering firm, must
be present. Minutes of the conference will be issued as an addendum and will be
made a part of the contract.
The site will be available for inspection on Thursday July 23rd, following the Pre-
Proposal Conference.

9. EXAMINATION OF PROPOSAL DOCUMENTS, OTHER DATA, AND PROJECT SITES
(a) It is the responsibility of each Offeror before submitting a Proposal:
(i) To examine and study thoroughly the Proposal Documents and other
related data identified in the Proposal Documents;
(ii) To become familiar with and consider as part of the Proposal all federal,
state, and local laws and regulations that may affect cost, progress, or
performance of the services requested;
(iii) To study and carefully correlate Offeror's knowledge and observations
with the Proposal Documents and such other related data;
(iv) To promptly notify LCDA of all conflicts, errors, ambiguities, or
discrepancies which Offeror has discovered in or between the Proposal
Documents and such other related documents;
(v) To determine that the Proposal Documents are generally sufficient to
indicate and convey understanding of all terms and conditions for the
performance of the services requested.
(b) The submission of a Proposal will constitute an incontrovertible
representation by Offeror that Offeror has complied with every requirement
of this Section 9, that without exception, the Proposal is premised upon
performing and furnishing the services and materials required by the Proposal
Documents and applying any specific means, methods, techniques, sequences,
and procedures that may be shown or indicated or expressly required by the
Proposal Documents; that Offeror has given the LCDA written notice of all
conflicts, errors, ambiguities, and discrepancies that Offeror has discovered
in the Proposal Documents and the written resolutions thereof by LCDA are
acceptable to Offeror; and that the Proposal Documents are generally sufficient
to indicate and convey understanding of all terms and conditions for
performing and furnishing the Work.
10. INTERPRETATION, CHANGES, AND ADDENDA
(a) All questions about the meaning or intent of the Proposal Documents are
