This is an invitation to submit a bid to Lamar County for the Recreation Lighting project as indicated herein. Sealed bids will be received at the office of the Chairman (in Lamar County Administration Building at the above address) up to 2:00 p.m., May 15, 2026 at which time they will be opened and publicly read. This project will be funded with 2023 SPLOST funds.

Bid Documents may be obtained at the County Office Location by appointment. Proposers are encouraged to request Bid Documents via email. All proposers bid documents will be emailed bid document. No documents will be mailed. Request for Bid Documents and any questions regarding the project or to schedule an appointment to pick-up Bid Documents at the County's office should be emailed simultaneously to tlowe@lamarcountyga.com and stownsend@lamarcountyga.com (Questions must be received no later than 2:00 p.m. on Friday, May 1st, 2026).

Responses will be posted to the Instructions for preparation and submission of a bid-proposal are contained in this packet. Bids must be typed or printed in ink. Bids submitted as a result of this invitation must include the "Bid Sheet" and bids on both options to be considered along with all required documents and be returned in a sealed envelope or container marked, "SEALED BID for Lamar County Recreation Complex Lighting" on the outside. Bids may not be considered unless so received.

Any questions and /or misunderstandings that may arise from this invitation shall be submitted in writing at least 10 days prior to the bid opening. The County will not respond to any questions received within 72 hours prior to the bid opening. Answers to questions submitted that materially change the conditions and specifications of this invitation for bid will be promulgated to all addresses as an addendum. Any discussions or documents will be considered non-binding unless incorporated and promulgated in an addendum.

INSTRUCTION TO BIDDERS

1. Intent: It is intended that the Instructions to Bidders, General Conditions, and Detailed Specifications shall define and describe the complete work to which they relate.

2. Work to Be Done: The Project Area is:

3. Site Examination: The Bidder is advised to examine the location of the work and to inform themself fully as to its conditions; the conformation of the ground; the character, quality and quantity of the products needed preliminary to and during the prosecution of the work; the general and local conditions and all other matters which can in any way affect the work to be done under the Contract. Failure to examine the site will not relieve the successful bidder of their obligation to furnish all products and labor necessary to carry out the provisions of this contract.

The Bidder shall notify the Owner of the date and time he/she proposes to examine the location of the work. The Bidder shall confine their examination to the specific areas designated for the proposed construction, including easements and public rights of way. The Bidder is solely responsible for any damages caused by his/her examination of the site.

4. Determination of Successful Bidder: A responsible bidder is one who has the capability, experience, financial resources, and integrity necessary to perform the work as specified.

(a) Responsibility: The determination of the bidder's responsibility will be made by the Owner based on whether the bidder:

1. Maintains a permanent place of business,

2. Has appropriate technical experience,

3. Has adequate plant and equipment to do the work properly and expeditiously

4. Has suitable financial means to meet obligations incidental to the work.

The Bidder shall furnish to the Owner all such information and data for this purpose as the Owner may request. The Owner reserves the right to reject any bid if the evidence submitted by, or investigation of, the bidder fails to satisfy the Owner that he/she is properly qualified to carry out the obligation of the Contract.

5. Submission of Bids: Bids shall be submitted at the time and place indicated in the Invitation. Lamar County will not accept late bids. On the outside of the envelope containing the bid shall be noted the following:

6. Georgia Open Records Act: Bidders are reminded that documents and information in the possession of Lamar County will be treated as confidential/proprietary information only to the extent permitted by the Georgia Open Records Act, and will be exempt from disclosure to a third party only to the extent permitted by the Georgia Open Records Act. Any trade secrets in your bid must be placed in a separate envelope, clearly identified and marked as such. Marked at a minimum by a cover letter explaining exactly where such information is, and otherwise marked, highlighted, etc. so as to be plainly visible.

7. Proposal Forms: Bids shall be submitted on the Proposal Forms included. Bids shall be based upon unit prices for estimated quantities excepting where bid items require lump sum proposals as indicated by the Proposal Forms. Where errors or omissions result in discrepancies in bid totals, prices per unit as submitted will be binding.

8. Gratuities: Lamar County acknowledges that, particularly during the holiday season, it may be customary to provide gifts to employees or departments. However, the Lamar County Personnel Policy prevents the acceptance of such gifts. Your cooperation in respecting the policy is appreciated.

9. Permits and Regulations The County shall obtain and pay for construction permits with the City of Barnesville. The Contractor shall obtain licenses, and easements of a temporary nature necessary for the prosecution of the work.

The Contractor shall comply with all County, State, and Federal laws, statutes, ordinances, rules and regulations applicable to furnishing and performance of the work.

10. Verbal Agreements: No verbal agreement or conversation with any officer, agent, or employee of the Owner either before or after execution of this Contract shall affect or modify any of the terms of obligations contained in any of the documents comprising said Contract.

11. Comprehensive General Liability -The successful Bidder shall exercise proper precaution at all times for

the protection of persons and property. He shall carry approved insurance from insurance companies authorized to do business in Georgia and having an A.M. Best's rating of B+ or better with the following minimums:

*The limits of insurance are as follows:

general liability insurance of at least One Million (1,000,000) Dollars (Combined Single Limit per

occurrence);

Workers' Compensation Insurance as will protect potential bidder or offered from Workers'

Compensation Acts.

12. Business License: Contractors and subcontractors shall have a current Occupation Tax Certificate and shall furnish certificate and license numbers prior to entering a contract with the Owner.

Scope of Work

Project Name: Lamar County Recreation Complex Lighting Project

Primary Objective: Establish the performance and installation criteria necessary for a lighting system that is safe for players, enjoyable for spectators, respectful to neighbors, and includes the security of a long-term performance warranty.

Quality Assurance: The manufacturer shall have a minimum of 10 years of experience in the design and fabrication of sports lighting systems that meet the required type and performance criteria. The proposal shall include a list of 10 LED sports lighting installation references located within the state of Georgia. References shall include the type of LED fixture proposed for this project.

Playability: The lighting design shall comply with the latest version of ANSI/IES RP-6 Recommended Illuminance Criteria for Sports and Recreational Areas based on the designated class of play. The following parameters shall be included:

Color Temperature: The lighting system shall have a color temperature of 5700K and minimum CRI of 75.

Vertical Illumination: Provide adequate illumination above the field to allow visibility of the ball in flight on all fields.

Pole Heights: Pole height minimum requirements to achieve optimal control of spill and glare.

Beam Type Restriction: To minimize player glare, NEMA beam types 1-3 shall not be used on the field of play.

Player glare limits (Baseball/Softball Fields):

Home plate: Player glare shall not exceed 1,000 cd from any outfield pole fixture.

Outfield positions (LF, CF, RF): Glare shall not exceed 4,500 cd from any A-pole fixture.

Light Pollution & Glare Control:

Lighting Ordinances: Lighting design must meet all local lighting ordinance criteria.

Offsite Glare: Maximum candela shall not exceed 6,000 cd measured 150 feet from perimeter of field 5 feet above grade.

Warranty: 25-year parts and labor warranty is required, covering equipment rental, shipping, and guaranteed light levels.

Maintenance Design: Drivers, fuses, and other electronic components shall be housed in an aluminum enclosure no higher than 10 feet above grade, accessible via step ladder.

Control & Monitoring: The system shall provide remote control, monitoring, and scheduling capabilities. The system shall be accessible 24/7 through a website, phone app, or call center. Fields must be proactively monitored to detect luminaire outages. All subscription costs during the warranty period shall be included.

Management Tools: An online dashboard shall be included to report usage metrics and system health.

Structural Design: Manufacturer shall provide steel poles with pre-stressed concrete base or an anchor bolt foundation embedded in concrete backfill. Direct bury steel (including concrete encased), hinged, and wood are not permitted. Manufacturer shall design foundation based on Geotechnical report parameters. If there is no Geotechnical report, design shall use Class 5 soil standards per IBC 2024.

Electrical Design: Electrical control shall use contactor switching rather than dimming drivers. Include 50 kA surge protection per pole per ground line. All wiring shall be fully enclosed. The system must be UL listed, or internal wiring shall be enclosed in raceway per NEC.

Installation Requirements: Contractor shall provide all labor, materials, and equipment needed for a complete operational system, including:

Contractor shall demo and remove from site all existing wood poles and attached fixtures. Poles to be cut 2' below grade.

Contractor furnished materials and labor: The electrical contractor shall provide and install all equipment necessary to provide a complete operational sports lighting facility. Items to be provided and installed by the contractor include, but shall not be strictly limited to the following:

Electrical wire (Copper).

Electrical conduit shall be provided.

All labor and materials necessary to install new electrical service panels and circuits from utility provided transformer(s).

All labor and materials necessary to install contactors and controls.

No more than two poles will be on a single lighting circuit.

ELECTRICAL DISTRIBUTION SYSTEM

Electrical contractor shall provide as-built electrical drawings with final close out documents.

All electrical work shall conform to the current edition of the National Electric Code.

The electrical service shall be rated at least 12% of calculated KA load. Panel boards shall be rated for service entrance; NEMA 3R (Outdoor) and each shall include a main breaker. All branch breakers shall be bolt types.

All wiring shall remain underground before entering the base of the pole and no wiring shall be exposed to sun or weather as it transitions through the pole and to the electrical enclosure.

No trench line or branch circuit shall cross the playing area. Branch circuits shall be all copper wires in conduit. Wiring in conduit shall be THHN or THWN copper wire.

All wiring shall be new.

All conduits above grade shall be rigid galvanized steel.

Each branch circuit will have a dedicated contactor.

Electrical switch gear installed outdoors will be housed on a frame constructed from 3" galvanized angle iron with hardware that is either stainless steel or hot dipped galvanized.

The installing contractor shall be responsible for locating all underground utilities including, but not limited to, natural gas, electric, water, sewer, cable TV and telephone.

The Owner shall be responsible for locating and staking any underground facilities that are not utility related.

Trenching depth and width shall be adequate to install appropriately sized conduit and to meet local and National Electrical Codes.

Trenches shall be back-filled with excavated soil and compacted to approximately the same density of the surrounding soil to minimize settlement.

The contractor shall obtain and pay for all permits and inspections required by the building and safety code and ordinances and the rules and regulations of any legal body having jurisdiction.

Pre-Bid Site Visit: All bidders must visit the site prior to bid submission. Site familiarity is required.

Submittals: Proposals must include a photometric lighting design reflecting all specified values. The Owner / engineer will review bid submittals from all the manufacturers to ensure compliance to the specification. Proposals that do not include all necessary information to support specified values will be disqualified.

1. DRUG FREE WORKPLACE CERTIFICATION

In order to have a drug- free workplace, a business shall:

Publish a statement notifying employees that the unlawful, manufacture, distribution,

dispensing, possession, or use of controlled substances is prohibited in the workplace and

specifying the actions that shall be taken against employees for violation of such prohibition.

CONTRACT FOR SERVICES BY AND BETWEEN LAMAR COUNTY BOARD OF

COMMISSIONERS AND ___________________________

This Agreement made and entered into by and between Lamar County, Georgia, party of the first part

(hereinafter called the "County") and ___________________________________ party of the second

part (hereinafter called the "Contractor"); and

WHEREAS, The Lamar County Commissioners at their _______________, 2025 meeting awarded the

bid for Lamar County Recreation Complex Lighting Project hereinafter referred to as the Project and;

WHEREAS, the Contractor and the County for the consideration hereinafter named, agree and

acknowledge that:

Part A: Contract Form

ARTICLE 1. The Contractor agrees to provide all the staff, facilities, materials, equipment and labor

necessary to carry out, in good faith, the complete requirements of the project specified as Lamar County Recreation Complex Lighting Project in strict conformity with all sections of Lamar County Recreation Complex Lighting Project, hereinafter set forth, whose program services together with the Contractor's Bid, the Advertisement for Bids, Instructions to Bidders, General Conditions, Representations, this Agreement, and all addenda hereto annexed, shall form essential parts of this Agreement as if fully contained herein.

ARTICLE 2. The Contractor agrees to commence the project included in this Contract on a date to be

specified in a written Notice to Proceed and shall be fully completed within a period Two Hundred

Seventy (270) consecutive calendar days after the effective commencement date. Time is of the

essence and is an essential element of this Contract, and the Contractor shall pay to the County, not as

a penalty, but as liquidated damages, the sum of Three hundred dollars ($300) for each calendar day

that he shall be in default of completing the work within the time limit named herein. If the Contractor

abandons the contract before commencement of the work or defaults in completion of all the work after

commencement thereof, the Contractor shall be liable for such liquidated damages.

These fixed liquidated damages are not established as a penalty but are calculated and agreed upon in

advance by the Owner and the Contractor due to the uncertainty and impossibility of making a

determination as to the actual and consequential damages incurred by the County and the general public

of Lamar County, Georgia as a result of the failure on the part of the Contractor to complete the work on

time. Such liquidated damages referred to herein are intended to be and are cumulative and shall be in

addition to every other remedy now or hereafter enforceable at law, in equity, by statute, or under the

Contract.

ARTICLE 3. The County agrees to pay the Contractor, in current funds, for the performance of this

Contract the sum of ______________________________________ Dollars (__________), which sum

shall also pay for all loss or damage arising out of the nature of the project aforesaid, or from unforeseen

obstructions or difficulties encountered in the performance of the project and for all expenses incurred

by, or in consequence of the project, its suspension or discontinuance, and for well and faithful

ARTICLE 4. The County and Contractor agree that the Specifications, and all Addenda thereto together

with this Agreement, form the Contract and that such Specifications are as fully a part of the Contract as

if attached or herein repeated. The Contractor, recognizing the particular requirements of the County

budgetary process, agrees to waive the terms of O.C.G.A. Section 13-11-1 et seq., known as the "Georgia Prompt Pay Act". Contractor agrees that the work and services required by this contract may

require inspection and approval of the County's engineers or consultants and that the time for payment

shall be tolled for a reasonable time as required for said inspection and approval.

This agreement consists of the documents associated with and contained in the Invitation for Bid and the

following parts.

Contractor agrees to perform the project as contemplated herein in a manner that does not jeopardize

the safety of Contractor's workers, County personnel or any other person. In addition, Contractor agrees

to perform the project contemplated herein in a manner that poses no threat to the environment or

violates any federal, state or local statute, ordinance, rule or regulation regarding environmental

concerns.

Contractor agrees to comply with the laws of Georgia which require authorization or licensing to conduct

business in the State. Notwithstanding statutory exemptions or exclusions, Contractor agrees to subject

itself to the jurisdiction and process of the Courts of the State of Georgia as to all matters and disputes

arising or to arise under this Agreement and the performance thereof, including all issues relating to

liability for taxes, licenses or fees levied by the State. Contractor irrevocably consents that any legal

action or proceeding against it under, arising out of or in any manner relating to this Contract shall be

brought in any court in Lamar County, Georgia.

Contractor designates the Secretary of the State of Georgia as its agent for service of process, provided

no such agent located in Georgia is on file with said Secretary. Contractor, by the execution and delivery

of this Contract, expressly and irrevocably assents to and submits to the personal jurisdiction of any court in Lamar County, Georgia and in any said action or proceeding. Contractor hereby expressly and

irrevocably waives any claim or defense in any said action or proceeding based on any alleged lack of

jurisdiction, improper venue or forum non conveniens or any similar basis.

Contractor shall take affirmative action in complying with all federal and State requirements concerning

provision of services or fair employment and treatment of all applicants for employment without regard

to or discrimination based on race, color, religion, sex, national origin or disabilities (particularly in regard

to the Americans with Disabilities Act.)

Contractor represents that it is in compliance with O.C.G.A. 13-10-91 and has registered with and is

participating in a federal work authorization program [Employment Eligibility Verification (EEV).

Contractor assumes sole responsibility for completion of the work undertaken pursuant to this

Agreement. The County shall consider Contractor the sole point of contact with regard to contractual

matters. Sub-contracting of any part of the work or service contemplated by this Agreement may not be

entered in by Contractor without prior written approval by the County.

Contractors and all approved subcontractors shall compensate its employees, at a rate equal to or

greater than the prevailing local wage rate in Lamar County as determined and announced by the Wage

and Hour Division of the U.S. Department of Labor.

To the fullest extent permitted by law, contractors and subcontractors shall comply with the Official Code

of Georgia, Section 34-9-410 et seq., as amended from time to time. Proof of Certification of Drug Free

Workplace Programs under the named statute shall accompany each bid for public improvements

projects submitted to the County for consideration.

No assignment or transfer of this Agreement or any right accruing here under shall be made in whole or

in part by Contractor without the express written consent of the County.

A waiver by either party of any breach of the provisions hereof shall not be deemed a waiver of any

succeeding breach of such provision or any other provision of this Agreement.

Should any term, provision or other part of this Agreement be declared illegal or unenforceable, it shall

be excised or modified to conform to the appropriate laws or regulations, and the remainder of the

Agreement shall not be affected but shall remain in full force and effect.

The provisions, covenants, and conditions in this Agreement apply to and bind the parties, their legal

heirs, representatives, successors and assigns.

No modification or amendment of the terms hereof shall be effective unless written and signed by the

authorized representatives of all parties hereto.

This Agreement constitutes the final and complete agreement and understanding between the parties

regarding the subject matter hereof. All prior and contemporaneous Agreements and understandings,

whether oral or written, are to be without effect in the construction of any provisions or term of this

Agreement if they alter, vary or contradict this Agreement.

The Contractor and the County, their successors, executors, administrators and assigns hereby agree

to the full performance of the covenants herein contained.

The parties hereto have executed this Agreement under their respective seals as of the date last written

below in three (3) counterparts, each of which shall without proof or accounting for the other Counterparts, be deemed an original contract.
