Description:

The City of Eureka, Missouri is accepting bids for Kircher Park Playground Resurfacing located at 25 Williams Road, Eureka, MO 63025.  Sealed bids will be accepted until 2:00 PM, December 4, 2024, at The Timbers of Eureka (Recreation Center), 1 Coffey Park Lane, Eureka, MO 63025. Amendments to a submitted sealed bid are permitted if received in writing in sealed form prior to the bid closing, and if endorsed by the same party or parties who signed and sealed the initial submission. Bids submitted after the above stated time will be returned to the bidder unopened.

Bids must be signed by an authorized officer of the company.  Bids shall be submitted in a sealed envelope clearly marked "Kircher Park Playground Resurfacing" along with the bidder's name on the outside (in the event bidders need to be contacted), and be directed to the attention of Kristin Christenson, Director of Parks and Recreation.

Each bidder shall familiarize themselves with the project site and become aware of the extent of the work being requested.

The City reserves the right to reject any or all of the bids, to waive technicalities, to award a bid that is most advantageous to and in the best interest of the City, and to make investigations concerning the experience and ability of the bidder to perform the work.

The City of Eureka does not discriminate against any company or individual on the basis of race, religion, creed, color, gender, physical disability or national origin.

In connection with the review of responses to this bid invitation the City will take necessary measures to ensure that the apparent lowest and best bidder is not a debarred company.

Pursuant to Section 285.530 RSMo, as a condition of the award of any contract in excess of five thousand dollars ($5,000.00), the successful bidder shall, by sworn affidavit and provision of documentation, affirm its enrollment and participation in a Federal work authorization program with respect to the employees working in connection to the contracted services. Successful bidders shall also sign an affidavit affirming that they do not knowingly employ any person who is an unauthorized alien in connection to the contracted services.

Attention is called to the fact that not less than the minimum prevailing wages and salaries for the appropriate trades as set forth in St. Louis County shall be paid on this project.  A copy of Annual Wage Order Number 31 follows this document.   The contractor will forfeit a penalty to the City of ten dollars ($10.00) per day (or portion of a day) if a worker is paid less than the prevailing wage rate for any work done under contract by the contractor or by any subcontractor.

CITY TAX EXEMPT STATUS
This project is exempt from all sales taxes for construction materials and supplies used directly in fulfilling contract requirements.  Sales tax shall not be included into the prices for this project.  The contractor shall follow the regulations as outlined in Section 144.062 RSMo, Construction Materials Exemption Allowed.  The City will issue the Contractor a Missouri Form 5060 Sales Tax Exemption Certificate. This document is to be given to the contractor's suppliers, and used only for the specific project identified and will expire on the date indicated unless extended by the City.

OSHA REQUIRED TRAINING
Pursuant to Section 292.675 RSMo, the Contractor shall require all on-site employees to complete the ten (10) hour training program required under Section 292.675, RSMo.  This program shall be provided by Contractor and shall be a ten (10) hour Occupational Safety and Health Administration (OSHA) construction safety program for Contractor's on-site employees which includes a course in construction safety and health approved by OSHA or a similar program approved by the Missouri Department of Labor and Industrial Relations ("MoDOLIR") which is at least as stringent as an approved OSHA program.  All employees are required to complete the program within sixty (60) days of beginning work. The Contractor shall further require all subcontractors under the Contractor to provide the ten (10) hour training program required under Section 292.675 RSMo to such subcontractor's on-site employees.   On-site employees who have previously completed such ten (10) hour training program must hold documentation of prior completion of the program.

DISADVANTAGED BUSINESS ENTERPRISE
The City of Eureka hereby notifies all bidders that it will affirmatively ensure that in any contract entered into pursuant to this solicitation, disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color or national origin in consideration for an award.

BIDDER QUALIFICATIONS
The bidder represents that they are properly licensed in the State of Missouri, St. Louis County and the City of Eureka to render the services described herein.  Bidder further represents that it has the available facilities and/or equipment to render the services required herein; technical knowledge and at least three (3) years of experience in work as described herein; the available workforce to render the services in a timely manner; adequate financial status to meet obligations incidental to the work; has no just or proper claim pending against them or their company; will share references with the City as requested and will provide the City with verification of insurance, such as Workers' Compensation, Employer's Liability and Commercial General Liability insurance.

SCOPE OF WORK
The scope of work includes the following:

A.    Removal of existing poured-in-place surfacing.
B.    Preparation and cleanup of existing concrete base as required for manufacturer recommended installation of new poured-in-place surfacing.
C.    Poured-in-place resilient play surfacing on existing concrete base.
D.    Installation and warranty for surfacing and other work performed.
E.    Include all necessary product and warranty information
F.    Itemized bid for the above-mentioned items.

SUMMARY
A.  Play surfacing shall be poured-in-place resilient surfacing installed in an existing concrete base.  Surfacing shall include a 50% blend of black and another color to be selected by the City of Eureka from a list of standard colors.
B.  Project includes resurfacing an approximate 3,000 square foot playground at Kircher Park.  Bidder is responsible for visiting project site and verifying square footage of surfacing needed.  Information must be included in bid.
C.  Bidder shall verify necessary surfacing thicknesses based on heights of existing play equipment.  Information must be included in bid.
D.  Bidder shall verify area of surfacing needed. Information must be included in bid.

BID SUBMISSION AND REVIEW
1. State all applicable warranties pertaining to materials and installation.
2. Bid prices shall include the purchase, delivery and installation of surfacing material along with associated site demolition and preparation work.
3. Submit any applicable purchasing programs available to the City of Eureka for direct purchase surfacing.  Provide all pertinent information related to program(s).

ADDITIONAL INFORMATION
1. No poured-in-place rubber surfacing work shall take place after 2:00 PM.  Contractor is responsible for securing site until surfacing process is complete.
2. Owner shall be notified if any equipment or materials are to be stored overnight on-site.
3. Bidder shall coordinate with the City of Eureka for storage location of materials.
4. Bidder shall coordinate with City of Eureka for access to the site during construction.
5. The resulting installation and materials must be in compliance with the Americans with Disabilities Act.
6. All surfacing and materials must comply with Consumer Product Safety Commission (CPSC) guidelines for playgrounds and equipment and with the American Society for Testing Materials (ASTM) applicable guidelines and regulations for all materials used in the manufacture of playground equipment.  Bids failing to comply with CPSC and ASTM guidelines will be disqualified.
